CC Resolution No. 21-130 Authorizing the County to submit the PLHA program application to the State on behalf of the CityRESOLUTION N0. 21-130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO, CALIFORNIA, APPROVING THE CITY'S PARTICIPATION IN A COUNTYCONSORTIUM TO RECEIVE AND ALLOCATE FUNDS BY THE ST ATE Or CALIFORNIA PURSUANT TO THE PERMANENT [OCAL HOUSING ALLOCATION (PLHA) PROGRAM WHEREAS, the State of California, Departmei"it of Housing and Community Development (Department) is authorized to provide up to $195 million to Cities and Counties for assistance under the SB 2 Permanent Local Housing Allocation (PLHA) Program Entitlement Jurisdiction Component from the Building Homes and Jobs Trust Fund (as described in Health and SafetyCode section 50470 et seq. (Chapter 364, Statutes of 201 7 (SB 2))); and WHEREAS, the Department issued Permanent Local Housing Allocation Final Guidelines (PLHA Program Guidelines) in October 2019; and WHEREAS, the State of California, Department of Housing and Community Development (HCD) issued a Notice of Funding Availability (NOFA) dated February 26, 2020, under the Permanent Local Housing Allocation Program; and WHEREAS, the Department may approve funding allocations for the PLHA Program, subject to the terms and conditions of the PLHA Program Guidelines, NOFA, Program requirements, the Standard Agreement, and other contracts between the Department and PLHA grant recipients; and WHEREAS, tlie City of Cupertino is an eligible local government to receive aru"iual allocations of PLHA funds and may apply to the Department for the City's allocation of PLHA funds, or the City of Cupertino may participate in a local consortium and delegate aiiother entity to apply for and administer the City's allocation of PLHA funds in accordance with Article III Section 300 (c) of the Program Guidelines; and WHEREAS, the City of Cupertino agrees to participate in a County of Santa Clara (County) PLHA Consortium aitd will enter into a PLHA Consortium Agreement to authorize the County of Santa Clara, as the Administering Jurisdiction, to apply for and administer PLHA funds on the City's behalf pursuant to the terms of the PLHA Consortium Agreement; and CC Resolution No. 21-130 Page 2 WHEREAS, the County, as the Administering Jurisdiction, will be responsible for all PLHA program requirements; and. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of tt"ie City of Cupertino, California, as follows: 1. The City Council authorizes the City Manager or designee to enter into a Consortium Agreement with Santa Clara County authorizing the County to submit funding applications to the State of California on the City's behalf for the City's alloc.ation of State PLHA program funds, and further authorizing the County to administer tlie funds in accordance with State requirements and in accordance with the Consortium Agreement to be executed by the City Manager or designee; and 2 The City Council authorizes Santa Clara County to submit a PLHA program application to the State on behalf of the City, pursuant to the terms of an executed Consortium Agreement.
