CC Resolution No. 20-113 Amending Preivous Fee Schedules RESOLUTION NO: 20-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING PREVIOUS FEE SCHEDULES I WHEREAS, the City of Cupertino is in the process of establishing a Short-Term Rental registration program; and WHEREAS, on August 18, 2020, the City Council of the City of Cupertino requested that options for a Short-Term Rental Registration fee be brought to a future meeting; and WHEREAS, on September 15, 2020, the City Council of the City of Cupertino adopted Ordinance No. 20-2200, amending regulations related to short-term rentals and including a registration fee requirement. Ordinance No 20-2200 will become effective on October 15, 2020 per Government Code Section 36937,but the City will not begin to enforce the registration fee requirement until January 1, 2021. Between the effective date of this Resolution (November 15, 2020) and January 1, 2021, the City may collect registration fees from short-term rental registrants but shall not enforce the registration fee requirement against any person; and WHEREAS, a public hearing was held on September 15, 2020 to add a Short- Term Rental Registration fee to the City of Cupertino's existing Fee Schedule; WHEREAS, the State of California requires fees charged for service rendered not to exceed the cost of delivering said services. Based on information collected by staff and provided in the staff report, it is anticipated that the cost to administer and enforce the short-term rental program would include $34,289 for third-party short-term rental monitoring technology, $286 per short-term rental for one hour of staff time for processing the registration, and costs related to code enforcement. Assuming Cupertino will have an estimated 300 short-term rentals registering, a fee recovering the known costs of the monitoring technology and processing would be $400 per short-term rental registration; and WHEREAS, the City Council of the City of Cupertino has established guidelines j for setting user fees and this fee is consistent with those guidelines. i WHEREAS, the City Council has determined that it is appropriate to subsidize some code enforcement costs associated with short-term rentals from the City's General Fund, and the fee shall be set at less than full cost recovery. User Fee Resolution Number 20-038 is hereby amended to include a Short- Term Rental Registration Fee of$200 in Schedule C, effective November 15, 2020.
