SPECIAL CITY COUNCIL MEETING
At 6:45 p.m. Mayor Steven Scharf called the Special City Council meeting to order. This was a
teleconference meeting with no physical location.
ROLL CALL
Present: Mayor Steven Scharf, Vice Mayor Darcy Paul, and Councilmembers Liang Chao, Rod
Sinks, and Jon Robert Willey. Absent: None. All Councilmembers teleconferenced for the
meeting.
ORAL COMMUNICATIONS
City Clerk Kirsten Squarcia read an email on behalf of Viji requesting a report on fiscal and
budgetary impacts due to COVID‐19 including shortfall of revenues and mitigation plans.
ORDINANCES AND ACTION ITEMS
1. Subject: Potential emergency order requiring face coverings for the public to slow the
spread of COVID‐19
Recommended Action: Confirm a proposed emergency order requiring face coverings
for the public to slow the spread of COVID‐19 and provide any input.
Written Communications for this item included an email to Council.
City Manager Deborah Feng reviewed the staff report.
Santa Clara County Health Program Specialist Ricardo Romero‐Morales said the County
advocates homemade masks for residents instead of buying medical masks due to
personal protective equipment (PPE) shortages, and the County chose guidance instead
of an order because it would limit law enforcement resources for compliance.

Mayor Scharf opened public comment and the following people spoke.
Jennifer Griffin, was concerned about educating the senior population on what
constitutes a face mask and senior access to purchasing these masks.
Mayor Scharf closed public comment.
City Attorney Heather Minner provided information about the authority to adopt rules
and regulations to protect health, public safety, and lives.
Councilmembers asked questions and made comments.
Santa Clara County Supervisor Cindy Chavez answered questions from Council.
Mayor Scharf gave a presentation.
Santa Clara County Sheriff’s Office Captain Ricardo Urena reported out on calls for
service in Cupertino and commented on potential impacts on resources from
enforcement.
Paul moved and Willey seconded that the Cupertino City Council confirm a proposed
emergency order requiring face coverings for the public to slow the spread of COVID‐
19, with discretion provided to the City Manager regarding requirements for children
from ages 3 to 12 following further diligence on the reasoning behind this proposed
exception in the staff report accompanying this agenda item; directing the City Manager
to conduct appropriate outreach to the community to ensure understanding of the
requirement including encouragement of the use of cloth masks in order to preserve
availability of personal protective equipment (PPE) for medical personnel as well as the
existing social‐distancing requirements; and encouraging the City Manager to
communicate to the extent reasonably possible with neighboring jurisdictions and
businesses, and the County, in order to both monitor and optimize the efficacious
development of the requirement.
Chao made a friendly amendment and seconded by Scharf to also notify businesses
within 500 to 1000 feet around Cupertino. Paul accepted the friendly amendment.
The amended motion carried with Sinks voting no.
