This will confirm the action by the City Council at their meeting of March
30, 1987 at which your Application 1-U-87 was approved per the following
conditions:

Street widening, improvements, and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.
2. CURB, G rIER & SIDEWALK
Curbs, gutters, sidewalks, and structures shall be installed to grades
and be constructed in accordance with standards specified by the City
Engineer.
3. LSC[iPING
Street lighting shall be installed and shall be as approved by the
City Engineer. On -street lighting shall be as required by the
Architectural and Site Approval Catonittee and ordinances and
regulations of the City. All on and off -site lighting shall designed
to in no way interfere with adjacent areas and shall be no higher than
the maximum height permitted by the zone in which the property is
located.
4. FIRE iLYL1EtAPTPS
Fire hydrants shall be located as required by the City.
5. 'TRAFFIC CWML SIGNS
Traffic control signs shall be placed at locations to be specified by
the City.
Street trees will be planted in the public right-of-way and shall be
of a type approved by the City in accordance with applicable standards
and ordinances.
7. GRADING
Grading shall be as approved and required by the City Engineer in
accordance with ordinance No. 214(a).
8. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer.
The developer shall be responsible for complying with the requirements
Of the Undergrannd Utility ordinance No. 331 and other related
ordinances and regulations of the City of Cupertino, and shall make
the necessary arrangements with the utility companies involved for the
installation of said facilities. The developer shall submit a
detailed plan showing utility underground provisions. (This plan must
have prior approval of the utility companies and the City Engineer.)

The project developer shall enter into a development agreement with
the City of Cupertino providing for payment of fees, including'but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for undergrcundirng of utilities. Said
agreement shall be executed prior to issuance of construction permits.

The developer shall provide a recorded easement allowing placement of
the relocated transit shelter facility separately from the adjacent
public sidewalk, as approved by the City Engineer.

12. APPROVED EXHIBITS
That the approval is based on Exhibits A 1st Rev, A-2 1st Rev, B,
ES-1, B-2 and F of Application 1-U-87 except as may be amended by
additional ocnditions enmlerated herein.
The subject Use Permit authorizes expansion of an existing autanobile
dealership to enncmpass the following activities:
1) New/Used vehicle
sales, Dearing and Rental 22,300 sq. ft.
2) Mechanical service 14,800 sq. ft.
4) Body Repair/Paint Shop 9,400 sq. ft.
5) Storage Garage 76,900 sq. ft.
The preceding Table includes all existing developed floor space within
the ac:plex, and all improvements/additions described under "Phase I"
and "Phase II" in Condition 15 of this Resolution.
Test driving and the testing of service vehicles is prohibited on
residential streets.
Authorized vehicle repair activities include both minor and major
automotive repairs. The servicing of vehicles outside the service
stalls or body shop is prohibited.
14. HOURS OF OPERATION
Haul of operation for the dealership facility shall be limited in
accordance with the terms of the General Commercial Zoning ordinance.
No late evening activities, as described in Section 4.5 of ordinance
1344, are authorized under this Use Permit, except that one evening a
month shall be designated as "Tech Night" to allow employees to work
on their own or optional car until 9:00 p.m. (No "polish and ready"
shall be done). In addition, operation of the mechanical service and
body shop area shall be limited to the hours of 7,00am to 7:00 pm
weekdays.
15. PHASING
The following improvements/additions indicated on Exhibit A 1st
Revision shall oomtstitute Phase I of the approved Use Permit: outdoor
display areas on the Stevens Creek and Stelling frontages; additions
to the main showrom/office; polish and "get Ready" canopy; truck area
closing offices; service customer drop off canopy and landscaping
improvements. The multilevel storage garage may be constructed in
conjunction with Phase I or separately.
Phase II improvements include the showroom near the east property line
and the new service stalls. Phase II improvements are approved in
concept only and are subject to future architectural review by the
Architectural Cmmmittee, Planning Cm mission and city Council. The
service stalls shall incorporate design features, such as a solid
north wall, to minimize noise impacts on nearby residents.
Prior to issuance of building permits, the applicant shall submit a
definitive landscaping/irrigation plan for the site, an elevation
drawing describing the main showroom addition and customer drop-off
canopy, and a oonprehensive materials/color palette for informal
review and approval by the Architectural and Site Approval Committee.
The building design shall also be reviewed by ASAC.
The definitive landscape plan shall demonstrate compliance with the
minimum 15 foot landscape setback standard measured fran curb line, as
required by the Stevens Creek Boulevard Conceptual Zoning Plan. The
landscaping along Stevens Creek Boulevard shall be maximized and the
sidewalk minimized to the extent feasible. The landscape plan shall
also indicate plants selected for the planters on the roof of the
parking garage.

The applicant shall provide 15 customer and 60 employee parking spaces
in conjunction with Phase I improvements. 40 additional employee
parking spaces shall be provided in conjunction with Phase II. These
parking requirements are based on the as=rption that approximately
half the employees drive fleet vehicles. Spaces shall be located as
described in Exhibit A 1st Pevision, except the additional customs
spaces shall be located at the south end of the truck display area.
The Planning Commission reserves the option to require additional
parking spaces in the future should it be deemed necessary.
All employee and customs parking spaces shall o mply with City
Standard dimensional specifications.
18. NOISE STL7DY
The applicant shall provide a noise study for Planning Commission's
review prior to issuance of building permits. The study shall include
an assessment of the noise impacts on Alves Drive residents of the
burglar alarm, public address system, vehicle repair activities,
"polish and get ready" activities, and roof equipment and identify
possible mitigation measures. The applicant shall ornply with those
measures determined necessary by the Planning Commission. In no case
shall the public address system or the intrusion alarm system be
audible beyond the property line. All other noise shall be regulated
by the City's Noise ordinance. If noise from the roof equipment
beoones a problem the equipment shall be screened.
19. FIRE SAF=f MUIUtFSEM'S
Concurrently with review of building permits, the applicant shall
demonstrate compliance with fire safety equipment requirements as
specified by the City.

Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping
or located utrierground such that said equipment is not visible from
public street areas.
Sign program information appearing on Exhibits A 1st Revision and F
are not approved. A separate sign program application shall be
presented to the Architectural and Site Approval Committee.
22. VEEIICT E DISPLAY RESTRICTIONS
All vehicles displayed for sale and visible to any public street shall
be placed with all tires in contact with ground. Use of two elevating
racks (one car, one truck) shall be allowed for display of
undercarriage.
The total number of vehicles displayed in the new car outdoor display
space facing Stevens Creek Boulevard and the new truck display space
facing Stelling Road shall not exceed the number of vehicles indicated
by conceptual symbols on Exhibit A 1st Revision.
Use of bollards for outdoor display area security is prohibited. All
existing bollards on the site shall be removed concurrently with
implementation of this Use Permit. Alternative security measures
shall be provided, subject to staff approval, along the Stevens Creek
Boulevard frontage of the used car lot. 'These measures may include a
high curb at the rear of the landscape planter.

The developer shall present a solution for screening of roof mounted
mechanical equipment to the Architectural and Site Approval Committee
prior to issuance of building permits.

The applicant shall consolidate all existing parcels into a single
lot.
25. LIGHTING ODNL'RDI6
Prior to issuance of building permits, the applicant shall submit for
staff approval a photometric study concerning existing and proposed
area lighting and security fixtures. Said study shall describe the
fixtures by type of illumination device, and shall contain
specifications for shielding devices to be fitted as necessary to
preclude off -site light intrusion impacts to nearby residential
properties. Lights shall be shielded so there is no view of the
source and the illumination shall be contained within the property.
Circulation in the vicinity of the customer drop-off canopy shall be
modified to permit customers to exit directly onto Stevens Creek
Boulevard, subject to staff approval. Compliance with this condition
may necessitate moving the carx py approximately 10 ft. east and/or
eliminating obstructions, such as curbs, in the westermmoet portion of
the canopy.

The structure in the northeast corner of the property identified for
removal in Exhibit A 1st Revision shall be removed in conjunction with
Phase #1.
28. MASONRY WALL
The masonry wall debris along the north property line shall be removed
and the existing wall repaired as necessary.

In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the changes are minor and do not
result in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the
Planning Commission.
If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Commission for approval. If
the changes are denied by the Planning Cammission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may
be made to the City Council by any interested party. Farther, any
Member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said changes by the
Planning Commission.

CONCERNING A NUISANCE AT KEY CHEVROLET,

WHEREAS, it has been brought to the attention of the City Council that
a situation exists on that property located at 20995 Stevens Creek Boulevard
(Key Chevrolet) in the City of Cupertino which may be a nuisance as defined
by Section 1.09.030 of the Cupertino Municipal Code; and
WHEREAS, said possible nuisance consists of light fixtures whose light
is said to intrude upon the property of residents, thereby obstructing their
free use of property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino
that a public hearing shall be conducted to determine if a situation exists
that constitutes a public nuisance and if the lights are determined to be
a public nuisance, and if not abated, the same shall be abated by the City of
Cupertino, in which case, the cos[ of such abatement will be assessed upon
and against the land on which said lights are located and that the cost
thereof will be constituted a lien upon such land until paid. This public

WHEREAS, the owners of the Key Chevrolet auto sales facility have made
a good faith effort to comply with conditions imposed under Application

WHEREAS, said owners intend to pursue redevelopment of the auto sales
facility as approved by Application 1-U-87;
THE C 1Y. COUNCIL DOES HEREBY MODIFY Application 31-U-67 (Revised) to
approve an interim use of the vacant parcel subject to the following
conditions:
1. All other conditions of approval for Application 31-U-67 (Revised)
shall remain in full force and effect except as modified by the
conditions stated herein.
2. Approval is granted to use the .9 acre vacant lot located west of the
Key Chevrolet facility for parking of a maxim:= of 70 vehicles for a
maximum period of one year (expires on August 3, 1988).
3. The property owner shall post a security suitable to the City Attorney
in the amount of $50,000 guaranteeing that substantial and continuous
construction will begin in order to implement Application 31-U-67
(Revised) or Application 1-U-87, within the one year period.
4. The property owner shall post the security and sign and agreement,
within two weeks (August 17, 1987) which defines the obligations of
the property owners and stipulates that the security will be forfeited
if the agreement is not adhered to. If construction is not begun, the
city reserves the right to pursue any other means to ensure compliance
with local laws including revocation of the use permit.

APPLYING TO EXTRAORDINARY USES
FINDINGS:
1. The Floor Area Ratio was incorporated into the General Plan to
limit traffic intensity and control the intensity of building
forms throughout the occamniity.
2. Some extraordinary uses generate traffic irrespective of the
ratio of building area to land area. In some cases, the traffic
generation characteristics may be significantly aver estimated or
under estimated.
3. The C=rd scion specifically finis that a Floor Area Ratio Policy
is necessary to better implement the intent of the General Plan
toward minimizing and controlling overall traffic flow in the
areas regulated by the Floor Area Ratio Policy.
4. The Floor Area Ratio Transfer Manual is renamed Floor Area Ratio
Policy Manual.
FLOOR AREA RATIO POLICY:
1. EXTRAORDINARY USE DEFINED
Extraordinary uses are uses which do not exhibit a reasonable
relationship between the building area and the amount of traffic
generated during the peak traffic hour. A reasonable amount of
traffic expected to be generated by any use is approximately 16
one-way weekday/evening peak hour trips per acre consistent with
that policy applied under the City of Cupertino Traffic Intensity
Performance Standard. Typically, extraordinary uses include uses
with unusual site area requirements, or unusual building area
requirements. Use characteristics may include traffic levels
based upon other on -site facilities not related to the building
area such as service stations, amusement parks. Examples of
extraordinary uses include the following:
a. Auto sales lots.
b. Service stations.
C. Theaters.
d. Furniture Stores.
e. Fast Food Restaurants.
f. Amusement Parks.
g. Convenience Stores.

The Planning commission finds that it is not possible for the
documentor to anticipate all uses which may fall into the above
categories. Accordingly, the City shall require a separate
traffic analysis detailing the ADT and peak hour omeway trip
traffic generated by the use for all uses which have
extraordinary building area requirements relative to traffic
generation. In such cases, the total amount of traffic should
generally not exceed a ratio of 16 one-way trips per acre during
the peak traffic hour.
For uses which generate traffic based on other use
characteristics not related to the building area such as service
stations, auto lots with auxiliary uses, amusenent parks, etc. A
separate traffic analysis shall also be required to verify the
trip generation characteristics per acre. In general, the
traffic generated per acre should not exceed 16 one-way peak hour
trips. Trips which are diverted side trips from the major
roadways may be discounted where it can be demonstrated that said
diverted side trips are not generated anew as a result of the
specific use. The overall traffic generation net of diverted
side trips shall be reasonably close to 16 one-way peak hour
trips per acre.

7,000 SQ. FT. VEHICLE REPAIR AREA; AND NEW VEHICLE
DISPLAY AREAS.
SECTION I: FINDINGS
WHEREAS, the Planning c mnission of the City of Cupertino has received an
application for a Use Permit, as described above and on Page 2 of this
Resolution; and
WHEREAS, the applicant has failed to meet the burden of proof required to
support said application; and
WHEREAS, the Planning camnission finds the application does not meet the
required finding that the proposed uses are not detrimental to the health,
safety, peaoe, morals and general welfare of persons residing in the
neighborhood of such proposed uses, nor injurious to property and
inprovements in the neighborhood of the site affected by the application;
and
WHEREAS, the applicant has not provided solutions for mitigating noise
iqmcts and has indicated an unwillingness to conduct a noise analysis
prior to the granting of a use permit; and
WHEREAS, the applicant has not provided solutions for mitigating off -site
lighting impacts and has indicated an unwillingness to provide a lighting
study prior to the granting of a use permit; and
WHEREAS, the proposal will create traffic impacts which have not been
adequately mitigated; and
WHEREAS, the proposed landscaping is inadequate, particularly along the
north property line;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for denial to the City Council of the City of
Cupertino; and
