Item 6.A.:
Field Use Policv Update
The Commission recommended revisions to the field use policy that were ultimately approved by
the full Council. Our current, adopted policy is in the packet for your information. You
requested that we place this matter on an agenda after the policy was in effect for a while to
review its effectiveness.
Effective fall, 2004, fees of $11 per player were charged to all participants in nonprofit youth
sports organizations that use City of Cupertino fields.
Effective January 1, 2005, for the spring 2005 season, higher nonresident fees were charged to
nonprofit youth groups, and the field use priority system was put into place. Staff worked closely
with groups to implement this policy with a minimum of disruption to the players. User groups
haye been cooperative and supportive of a revenue stream for field maintenance.
The one outstanding issue, as evidenced by the attached email, is the issue of Sunday play. Our
current field policy restricts regular Sunday play for reasons of neighborhood tranquility and turf
longevity. We do not recommend changing this aspect of the policy but respectfully invite the
groups we serve to present their needs for your consideration.
[fthis is something the Commission believes they would like to revisit (with the intent of making
a recommendation to Council for another field use policy revision), the Commission should so
indicate at the meeting. At this point, staff does not see sufficient reason to change the Sunday
play policy.
NEW BUSINESS
Item 7.A.:
Review Toll Bros. Inc. park dedication proposal for Calabazas Place and
recommendation to City Council
The Calabazas Place development is located at Stevens Creek Blvd. and Finch as is noted on the
attached map. Planning staff has been working with the developer for over a year to secure an
acreage dedication and park configuration acceptable to the department and consistent with the

General Plan. I believe we are there. The total dedication is 3.5 acres, configured in a useful
block of open space approx. 350' x 350' (2.81 acres) plus a passive area (the pork chop on the
plan) of 0.69 acres. We believe that this configuration best meets the community needs.
Contained within the packet are the copies of the rejected designs.
There has been no specific park public process yet. This project is new development and the
permit hearings will be fodder for the Planning Commission. However, the Parks and Recreation
Commission will be tasked with recommending the design for the public areas. The park design
will precede the arrival of the new neighbors.
A representative of the development group will be in attendance. As of my last meeting with
them, they had not precisely identified the target group for the residential units they are planning
to build - we will get an update on that. Assuming this plan is approved, we will begin working
on a design for the park.
MISCELLANEOUS
Item 8.B.a.: Veterans Memorial Proiect
This project will be coming your way in the next two months. There are two very low profile
memorials in Cupertino now (photos included in the packet). The Council is interested in a
higher profile marker for Memorial Park and would like the P&R and Fine Arts Commissions to
take on the project. Council specifically asked that we identify individuals that have given their
lives in all branches of the armed forces and public safety personal. The research to identify
these individuals is now underway.
Item 8.B.b.: Cupertino's 50th Anniversary plans
Two chances to have a really good time: mark your calendars for September 24th and 25th at City
Hall and surrounds and October 15th for Blackberry Farm. It's not too late to volunteer!

A. Stevens Creek Corridor Park - patrol and operations relative to parking and
neighborhood impacts: Via a PowerPoint presentation, Director Smith reviewed
the Commission's May 5, 2005, recommendations to provide pedestrian access to
Stevens Creek Corridor Park at San Fernando and Scenic Circle after the trail and
other park improvements are installed.
At the May 5 meeting, the Commission asked staff to prepare a plan to address
security concerns before forwarding their recommendations to the City Council.
Director Smith reported that a complete operation plan for the park would be
written over the next two years as the project is fully developed, and that the
meeting was to address current resident concerns for after-hour access. She also
stated that for at least the first two years of operation, all barbeque use on
weekends would be by reservation only; this is to tightly control parking
overflow. Other measures to be taken will be that customers in Blackberry Farm's
database will be notified of the change in weekend operation, a reservation will
entitle a user to a limited amount of parking; marketing will emphasize the

redevelopment of Blackberry Farm as an environmental center; carpooling will be
encouraged; shuttled will be provided and a fee will be charged. Also stated was
that the Scenic entry point is intended for bicycle and pedestrian access and will
not be advertised.
Commission Comments
Commissioner Brown asked if there would be a discussion on the safety data provided in
the Commission's packet. Director Smith stated there was no plan to discuss the data
unless the Commission had questions. She had provided the data because Commissioner
Chien had heard from the residents that there was a lot of crime in the area and he wanted
to see statistics. She asked the Sheriff s Office to provide a surnrnary of crime reports for
the Scenic neighborhood. Commissioner Brown said that he believes the data supports
the Commission's position. He asked for some clarity on the breakdown of providing 84
hours per week in security for the park. Director Smith answered that there are a couple
of ways to provide coverage. One alternative would be, if the union concurs, for the City
to use contract rangers with a group such as California Land Management that would
give us flexibility. The other way would be that the City would look having two
positions and staggering work shifts to cover seven days a week, with some duties
(opening gates) being performed by management staff.
Commissioner Peng stated that he has no concerns over the security or public safety of
the parkland, but asked Sheriff John Hirokawa about the accuracy of the data he
provided. Sheriff Hirokawa gave a brief report on what is involved in a call that becomes
a reportable crime and stated that the data represents a 90-95 percent accuracy rate.
Public Comment
Max Bokelman, Scenic Circle, acknowledged that the presented security plan provides
for closing of the Scenic gate at night once the trail is open. He believes the crime
statistics do not give an accurate picture of the problems in the area. He believes that
when the access from/to Blackberry Farm is closed off, crime decreases.
Ari Strod, Scenic Circle, disputed the accuracy of the reportable crime data and asked the
Sheriffto explain. In response, Sheriffs Hirokawa explained how the crime statistics
were collected. He also stated that not all of the reportable crime in the Scenic area was
park related. Mr. Strod stated that the neighborhood's complaint about parking was not
appropriately addressed in the director's report.
Don Bautista, Scenic Court, stated that he does not agree with the crime data. In his 27
years as a resident, he has seen a lot of park-related crime. Much of the crime was when
the gate was open. He stated that he and the neighbors do not want a Scenic access
because it will invite intruders into the area. He also stated there was a concern over
increased parking in the area

Director Smith reviewed the Commission's recommendations:
Staffing is seven days a week with a ranger position that affords both light
maintenance work and enforcement capability; 84 hours a week on average
Back-up from the Sheriffs Office
Gates at both pedestrian accesses; open at 7 a.m., closed by 8 p.m. or dusk, whichever
is earlier
Close operations in 2007; reopen in 2008 by reservation only on weekends with
controlled parking
Shuttled parking during those times when we expect overflow parking problems
For the first two years of operation, reservation only
All customers will be notified of the change in park operation
Parking spaces will be controlled
Marketing of the facility will be an environmental center
Strictly a non-motorized access at Scenic
Should summer weekends be a problem, the gate can be closed during that time
Chairman J elinch asked if opening the gate did not work out and crime statistics proved
otherwise during a certain period of time, could they review it again. Director Smith said
this stipulation could be added in. She asked the Commission if they would like to pick a
trial period length. Commissioner Brown also stated that this would include the
stipulation that the gate be closed at night and include the security patrol as presented,
and at the end of a one-year period, data would be presented to the Commission and then
forwarded to the City Council as appropriate.
ACTION:
A motion was made, seconded and unanimously moved to have the gate
access open (as stated above) on a one-year probation period and that the
Commission will receive a report at the end of that time.
7. NEW BUSINESS
A. Meeting schedule for August: Director Smith reported that she would be at a
strategic planning session with other city management on August 4. Since there is
no pressing business for August, she asked for their consideration to cancel the
August meeting and reconvene in September.
ACTION:
With a full consensus of the Commission, the August meeting was cancelled.
8. MISCELLANEOUS - NO ACTION REQUIRED
A. Written Communications: None.
B. Staff Reports: Director Smith reported on the success of the 2005 4th of July
fireworks event; Don McCarthy did an outstanding job. It was estimated that
8,000 people attended. In the morning event, 500 pieces of the City's Golden
Jubilee birthday cake was served.

event for Much Ado About Nothing, at Memorial Park, July 16-31, Saturdays

Moon Festival at Memorial Park on September 17.

The effective date for this policy is 1/1/05
It is the policy ofthe City of Cupertino to support and encourage flexible and inclusive
use of athletic fields in a manner that preserves neighborhood quality of life and protects
the park resource. The City supports and encourages volunteerism and the sense of
community created when individuals with common goals work together. The City values
the healthy benefits of recreational pursuits and supports the development of young
athletes.
Purpose:
· To strive to provide all Cupertino residents with an opportunity to participate in their
activity of choice.
· To establish procedures governing the exclusive use of City of Cupertino and
Cupertino Union School District playing fields managed by the City of Cupertino.
· To ensure that Cupertino residents have priority access to the fields they have paid
for.
· To provide for a variety of activities reflecting the athletic preferences of Cupertino
residents.
· To contribute a proportionate amount of field time to regional organizations that
Cupertino residents participate in.
· To collect reasonable fees for the use of the fields, in support of their ongoing
maintenance.
· To adopt a fee schedule that rewards volunteerism and community involvement.
Permit Required: Field Use Permits are required for exclusive field use or for any
repeated, organized use of athletic fields maintained by the City of Cupertino. The
Cupertino Parks and Recreation Department (CPRD) issues field use permits.

Two Sunday permit dates/year/organization/site may be granted by staff to accommodate
special tournaments or events (not regularly scheduled league play). Sunday permits are
exclusive to those organizations already in possession of Monday-Saturday Permits who
use fields regularly over the course of the Fall or Spring Use Period. Sunday access to
fields will be granted no earlier than 9 a.m., with games beginning no earlier than 10 a.m.
Fields will be permitted for the activities that the field(s) are intended for, designed
for, classified as, or for activities conducted in a manner that does not compromise
public safety or field quality and integrity.
Field Hotline:
Fields may be closed to avoid turf damage due to inclement weather or field saturation.
Fields may be closed for field maintenance. Call the field hotline at 408-777-3566 to
determine whether or not the fields are playable.

Eligibility is based on an assessment of each organization's prior season eligibility status.
It is the Permit Organization's responsibility to notify CPRD, upon permit application
submittal, of a change in Eligibility Status for the upcoming season. Permit approval for
new organizations will be based on current registration information. Permits may be
revoked if it is found that an organization's Eligibility Status has changed without
notifying CPRD prior to permit application submittal.
An organization providing a unique recreational opportunity, such as one serving special
needs youth, may be assigned a special priority status following review of their offering
by the Parks and Recreation Commission and approval by the City Council, including use
of fields on Sunday.
Definitions:
Priority 1 - Cupertino Parks and Recreation Programming: Programs offered by the
City of Cupertino will have first priority for scheduling.
Priority 2 - Cupertino resident, youth, volunteer non-profit organization: An
organization that maintains participation of at least 51 % Cupertino residents and has a
board of directors made up of at least 51 % Cupertino residents. The organization must be
all-volunteer with no paid coaching or training, to be in this priority group.
Priority 3 - Cupertino resident, youth, commercial non-profit organization: An
organization that maintains participation of at least 51 % Cupertino residents and has a
board of directors made up of at least 51 % Cupertino residents. Organizations in this
category can hire paid staff.
Priority 4 -Cupertino resident, adult, volunteer non-profit organization: An
organization that maintains participation of at least 51 % Cupertino residents and has a
board of directors made up of at least 51 % Cupertino residents. The organization must be
all-volunteer with no paid coaching or training, to be in this priority group.
Priority 5 - Cupertino resident, adult, commercial non-profit organization: An
organization that maintains participation of at least 51 % Cupertino residents and has a
board of directors made up of at least 51 % Cupertino residents. Organizations in this
category can hire paid staff.

organizations do not meet the 51 % residency requirement for participants or board of
directors. They are non-profit and volunteer in nature.
Priority 7 - Nonresident youth, commercial non-profit organizations: These
organizations do not meet the 51 % residency requirement for participants and/or board of
directors.
Priority 8 - Nonresident, adult, volunteer non-profit organizations: These
organizations do not meet the 51 % residency requirement for participants and/or board of
directors. They are non-profit, volunteer in nature.
Priority 9 - Nonresident adult, commercial non-profit organizations: These
organizations do not meet the 51 % residency requirement for participants and/or board of
directors. Organizations in this category can hire paid staff.
Priority 10 - For-profit youth sports events: In this category would be field rental for
businesses that run special clinics and camps for youth.
Priority 11 - For-profit adult sports events: In this category would be field rental for
businesses that run special clinics and camps for adults.
Organizations that have violated the terms of the field use policy: Beginning 1/1/05,
any group found violating any term of the field use policy or providing misleading or
false information to CPRD will have last priority for scheduling field time.
Seasonal Use Dates Defined:
Fall Use Period: 7/1-12/31
Spring Use Period: 1/1-6/30
Seasonal Use Date Priority:
. Cupertino Resident Youth Non-Profit Soccer Organizations have field priority on
Soccer/Baseball Joint Use Fields, during the Fall Use Period, and annual field
priority on exclusive soccer fields.
. Cupertino Resident Youth Non-Profit Baseball and Softball Organizations have
field priority on the Baseball-SoftballlSoccer Joint Use Fields, during the Spring
Use Period, and annual field priority on exclusive Baseball or Softball Fields.
Exceptions to Seasonal Priority:
Little League Baseball has annual priority at the Hyde Middle School 90 ft. Diamond
Baseball/Soccer Joint Use Field.
Memorial Park Softball Field is exclusive to CPRD Adult Softball Leagues.
Cupertino Parks and Recreation Department programs have annual priority on all
fields.
The City Council may assign a special priority status to a group offering a unique
program to Cupertino residents that would be otherwise unavailable.

Two or More EQuallv Elil!ible Groups ReQuestinl! the Same Field:
In the event that two or more field requests with equivalent eligibility overlap, the groups
shall first work together to resolve the issue through compromise. If the issue cannot be
resolved by the groups, the City's Field Coordinator will use good judgment in
determining the field allocation for the season. In these cases, priority consideration shall
be given in the order stated below:
A. The organization with a history of past field use on specific fields will have first
priority
B. A program providing a service that does not currently exist (does not duplicate a
program already available)
C. Timely receipt of field use request and required accompanying materials.
D. Other Elements
How Cupertino residencv is calculated: Because leagues are regional in nature, city
staff will calculate the residency percentage by reviewing the rosters for players
scheduled on Cupertino fields, and not the league as a whole. This calculation is
intended to encourage league field schedulers to secure playing time in all cities from
which they draw participation.
Definition of a Cupertino Resident: A person who lives in the City of Cupertino.
How Field Use Policv compliance is verified: CPRD requires a Master League Roster
complete with player first and last names alphabetized, address, and phone number, and
all Team Rosters of participants. This information will be presented to CPRD Staff
immediately after registration for the organization closes. Coaches will be required to
have team rosters and permits on site during each field use, available for inspection.
CPRD will make spot field checks, and any organization found to be misrepresenting its
residency status will have its permit revoked for the season and will be last priority for
field scheduling for the next season.
Orl!anization within an orl!anization, or "under the umbrella of an orl!anization":
Any organization found to be scheduling field time for use by another organization (that
would otherwise have a lower priority for field scheduling) will have its permit revoked
for the season and will be last priority for field scheduling for the next season.

To be determined on a case-by-case basis, considering the type of organization
and the nature of the violation.
Fee Pavment Protocol for Youth Non-Profit Orl!anizations: Once the Volunteer or
Commercial Youth, Non-profit Organization's primary player registration has closed for
their upcoming season, an accurate, computer-generated master league roster that
includes names, addresses and phone numbers of only the players using Cupertino fields,
will be required. The City of Cupertino will use the 'per player fee' formula (see Fee
Section) to invoice the league. For any additional registrations during the course of the
year, the same protocol will apply. The City may require, at any time, to review certified
league registration forms for all participants. The permit will be revoked ifthe fees are
not submitted on time (see 'Fee Payment Deadlines').
The City Council has levied lower fees for Cupertino residents, and staff will check
to ensure that the registration amounts paid by Cupertino residents is accurate.
Fee Pavment Protocol for Groups OTHER THAN Youth Non-Profit Orl!anizations:
Organizations OTHER THAN Youth Non-Profits will submit, attached to their Athletic
Field Use Permit Application(s), an accurate assessment of: # of individual fields
requested, multiplied by # of hours requested using each field, multiplied by the hourly
rate for your Eligibility Status (see'Fee' section). CPRD will then invoice the
organization based on the approved amount of fixed field use hours. In the event of field

closures due to inclement weather, rainouts, field over-saturation, or field maintenance,
the organization will have an opportunity to schedule 'make-up dates' with CPRD or
have the option of being refunded all applicable fees. The permit will be revoked if the
fees are not submitted on time. (see 'Fee Payment Deadlines')
Permit and Insurance Certificate Submittal Deadlines to Remember:
For Spring Seasonal Use Dates (1/1-6/30):
Permit Applications may be submitted to CPRD between 1111-12/1.
For Fall Seasonal Use Dates (7/1-12/31):
Permit Applications may be submitted to CPRD between 5/1-6/1.
Organizations that miss the above deadline(s) will be subject to the 'first come, first
serve' priority system.
Rosters Submittal Deadlines to Remember:
For Spring Seasonal Use Dates and Fall Seasonal Use Dates: Team and Organizational
Rosters must be submitted to CPRD no later than 14 days after the Permit Organization's
primary registration period(s) closes. For any additional registrations during the course
of the year, the same protocol will apply.
Fee Pavment Deadlines to Remember:
Cupertino Youth Non-Profits: 14 days after receiving CPRD Invoice.
Groups OTHER THAN Cupertino Youth Non-Profits: 7 days prior to first permitted
date.
Cancellations:
For groups other than Cupertino Youth Non-Profits, cancellations will be accepted with
full refund up to three 3 working days prior to scheduled use. The recreation coordinator
responsible for field scheduling must be notified.
Permit applications for organizations offering new programs will be reviewed by staff
and, if necessary, forwarded on to the Parks and Recreation Commission and City
Council. Staff will endeavor, to the extent possible, to facilitate new program offerings.
General Rel!:ulations For Field Use:
· A copy of the approved permit must be available for inspection when an
organization is using the field
· Field users are required to observe all City of Cupertino park regulations.
· Field use is limited to the times and dates indicated on the permit, and any changes
are subject to availability and approval by the department.
· Fields must not be used when wet; permits are invalid on rainy days or after rain if
the ground is considered too saturated for play:
- Call the field hotline at 408-777-3566 to determine whether or not the fields are
playable.

· No alcoholic beverages are allowed; violation will result in forfeiture of the permit
and no fees will be returned.
· No group shall litter, soil, or defile the field, rest rooms or other park areas.
· No group or persons shall use any system to amplify sound whether for speech or
mustc.
· No group or person having control or care of a dog shall enter or remain in the park
unless posted for such use, and then only if it is led by a leash of suitable strength.
· No group or person shall make or kindle a fire for any purpose, except at places so
designated.
· No group shall enter an area posted as "closed to the public" or "field closed". No
persons shall remove such po stings.
· No group or persons shall indulge in riotous, boisterous, threatening or indecent
conduct.
· All permit organizations or groups must show proof of liability insurance with the
City of Cupertino named as additional insured. Liability insurance must be for a
minimum of $1 million.
· It is the responsibility of the permitted organization to notify the Cupertino Parks
and Recreation Department ASAP if it is determined by the permit organization that
an approved permit date(s) is no longer needed.
This policy constitutes the exclusive Field Use Policy surrounding field use for City of
Cupertino owned fields and Cupertino Union School District (CUSD) fields specified in
the Joint Powers agreement.
This policy was approved at the City Council meeting of October 18, 2004.

Per the October 18, 2004 City Council Meeting, the field use policy was put into effect. The policy clearly states
that there be no regularly scheduled league play on Sundays. The point of the permit is to give two Sunday
permits to accommodate special tournaments or events.
Staff does not have the authority to override the Field Use Policy.

Rachelle and Don,
Your rejection of my request for Sunday league play has put me in a real bind. I've got outside
playing leagues asking us to host our share of Sunday matches but you're not giving me a single
field. I know that CPRD approved all our requests last season, even though many of those permits
were for AFTER the field use policy went into effect. So, I was counting on a small number of
fields to cover our games this year too.
I'm trying to be fair also by leasing non CPRD fields for more than 50% of my Sunday game
requests. Ijust need Creekside and Jollyman (out of9 fields) on Sundays during the fall. We'll
figure out something else in the spring. I understand that the email thread below was pre Field Use
Agreement, but given that we had permits last year I'm sure you have the power to grant our
permits.
As the new DYSL President I've been trying to be a great Cupertino citizen (I am a 95014
resident) by putting the load on fields outside of Cupertino. This is especially true during the
winter, spring and summer seasons. We just have a heavier load during the fall and I would
REALL Y appreciate your help.
Please get back to me soon as we've got Sunday games starting on 9/11.

Therese, I beg to differ. This was specifically about league play on
Sundays, and not about the 2 special tournament Sundays. The 2
Sundays for tournaments was already in place. The youth groups had
worked with CPRD to come up with this policy. I would ask of you, if you
have the time, to review the meeting webcast from November 6th., 2003,
specifically item 5, Sunday Sports Field Usage. It is archived on the city
of Cupertino website. During this commission meeting, the fact that
Sunday soccer play would most likely go on every Sunday for the Fall
period that this new policy would cover. This new policy was approved.
So, the current policy allows you to approve all the requests that we have
submitted. CPRD may decide not to approve them, and that is at CPRD's
discretion. Please let me know by Friday end-of-day (or before) whether
the permits will be approved or not. The league needs to figure out
different options if the permits are not approved.

I took this issue to the Parks and Recreation Commission and City
Council specifically regarding Sunday use for tournament play,
and the decision was made for two special permits per year at
Creekside and Joilyman Parks. The Sunday exception was never

Michael,
thanks for talking to me yesterday about Sunday permits. I have
to admit that I got very confused because we were all under the
assumption we were going to be able to secure Sunday permits
for regular league schedule Sunday games during our main
soccer season. That's is why I told you I needed to do some
research on the subject.
At the November 2003 Parks & Rec Commission meeting, you
presented a plan to the commission to deal with the Sunday play
needs of the youth sports group. In this plan (the meeting minutes
is attached here), your points were:
· Sunday permits will be accepted at the discretion of CPRD for
Creekside and Jollyman Parks.
· Sunday permits will only be granted during the respective
organization's primary season.
· Soccer has priority on the fields in the fall (9/1-11 II 5).
· Baseball has priority in the spring (2/15-7-31).
* Any exceptions will be negotiated on a case-by-case basis.
· Two (2) Sunday Special Permits per organization per year will
be authorized by Parks and Recreation Staff to accommodate
tournaments.
· Fields will be closed for restoration and re-seeding from
November 15 to February 15 of each year.
. Any exceptions will be negotiated on a case-by-case basis.
. Sunday access to the fields will be granted no earlier than 9
a.m., with games beginning no earlier than 10 a.m.
· This policy will go into effect March I, 2004.
In the following paragraph it is stated "It was noted that
Creekside is only for soccer, so that the site would have Sunday
permitted use September to November."
Action was taken in the meeting. Commissioner lelinch made a
motion to adopt the recommendations of the staff. Commissioner
Peng seconded the motion, and the motion passed 4-0.
The Sunday permit applications I submitted are to support our
District, playing league responsibilities, and our new recreational
program effort (which was also mentioned in that meeting in
November, to attract the local Asian community which attended
school on Saturday, we had to be able to offer a viable Sunday
option for them).
Our current commitments for Sundays are:
I) District Cup Toumament for older teams (Ul4 and above)-

- our league is hosting the U15 and U16 girls age group <at this
age girls don't wear the fields as much as boys do)

- our league is hosting U12 Boys and Girls
3) Playing league commitments for Sunday League schedule
games (we don't make this schedule, it is handed down to us by
the 2 playing leagues, Abronzino-c\ass I, and Delgado-class 3).
Sept. 12th - 8 games
Sept. 19th - 6 games
Sept. 26th - up to 4 games (games possibly moved from Oct. 3rd
due to the District Cup tournament)
Oct. 10th - 4 or 6 games (2 games possibly moved from Oct 3rd
due to the District Cup tournament)
Oct. 17th· 8 games
Oct. 24th - 6 games
Nov. 7th - 3 games
Nov. 14th - 1 game
So I only requested Jollyman Park on the Sundays where we have
8 games schedule. For less than 8, we can use Creekside only, but
we need to provide some flexibility to accommodate schedules.
4) Recreational Program Sundays dates - the time is always 2pm
at Creekside, on the Sundays below.
Sept 12th, 19th, 26th
Oct 10th, 17th, 24th, 31 st
N ov 7th, 14th
I hope you can see why I was confused yesterday on the phone
when you told me that we only had the 2 special events Sundays.
That has been in place even before this November meeting. I
have a memo from Colleen Manning from June 2003, stating the
2 special event Sundays policy. So why was this plan presented
in the November meeting if it was not to support the youth league
Sunday needs?
I understand that it is still at the discretion of CPRD to accept or
deny the Sunday permits. You made it sound that nothing had
changed from last year, but this is new policy that went into
effect March I, 2004, so things are different.
Please let us now right away if you can (by end of day this Friday
8/27/04), if these permits are going to be approved or not. The
league needs to make arrangements right away if we are not
going to be able to use these fields on Sundays as planned. If you
feel that the permit applications I submitted are to broad, and you
want more specifically when the fields are going to be used, I can
resubmit them with specific game times and locations for those
days, but game times consistently change, and I would just have
to keep resubmitting them.

A 34-year-old Peninsula soccer
coach faces disciplinary action and
misdemeanor criminal charges after
he allegedly provided alcohol to four 18- year-old players and had
sexual intercourse with three of them.
The allegations have led Jeff van Gastel to resign as president of
the De Anza Force, a Cupertino soccer club that he founded, and
he has been suspended by the California Youth Soccer
Association and Menlo College, where he had recently started a
job as the assistant women's soccer coach. He had been the girls'
soccer coach at Palo Alto High School for eight years before
shifting to Menlo, but all the allegations involve players from the
Force.
A San Jose police report alleges that van Gastel had an end-of-
season party at his parents' San Jose home June 7, giving beer
and margaritas to four players, then having sex with three of them.
After two of the women went with their parents to police about a
week later, an investigation determined that the sexual conduct
was not illegal because they were adults, and it apparently was
consensual, but van Gastel has been charged with four
misdemeanor counts of providing alcohol to people under 21.
He was arrested Aug. 10 and is due for arraignment Sept. 12 in
Santa Clara County Superior Court. He has been released on
$15,000 bail.
His attorney, Phil Schnayerson, said he hadn't seen the alcohol
charges and couldn't comment, but he did stress that "there is no
allegation of any improper sexual conduct whatsoever."
Witnesses have told San Jose police that at the party, team
members played strip poker and card games where the loser had
to drink beer. They also said van Gastel plied them with beer and
margaritas while two of the victims said they "admitted to streaking
through the neighborhood naked," but also felt their judgment was
impaired due to drinking.

The police report said two of the women accuse van Gastel of
taking advantage of them "because they were intoxicated." The third
woman said the sex was consensual.
According to the police report, one of the women called van Gastei,
who told her, as police listened in, "that he did not plan for it to
happen, because he was married and also knew that both of the
victims had boyfriends."
Van Gastel told investigators he had provided alcohol at his parents'
house and "admitted to having consensual sex" with the three
women, according to police.
The report to the district attorney's office concludes that "there is no
evidence to suggest that force, threats or drugs were involved. The
victims and witnesses were conscious and willing participants.
However, the victims felt their judgment was impaired due to the
alcohol, which they drank voluntarily."
Even if he is acquitted, van Gastel may still be disciplined. Menlo
COllege Athletic Director Caitlin Collier said that van Gastel has
been suspended indefinitely without pay, and that any disciplinary
action will probably depend more on the college's investigation than
on what happens in court.
John Murphy, chairman of the California Youth Soccer Association,
said Van Gastel could be banned if his conduct is found to be
inappropriate, regardless of whether he is convicted. "We would
only have to determine that we don't want this person around,"
Murphy said.

Peninsula girls soccer coach accused of providing alcohol in wild party with players
Jeff van Gastel, a well-known Peninsula girls soccer coach from San Jose, faces misdemeanor
charges of providing alcohol to four 18-year-old female players.
San Jose police officer Gina Tepoorten said Gastel was arrested Aug. 5 on four counts of provi,
a minor under 21. Tepoorten did not elaborate on the details.
Neither van Gastel, 33, nor his attorney returned phone calls Thursday night.
According to police and investigato~s reports filed in court, the charges stem from an end-of-thE
June 7 at which van Gasel admitted to police he served beer and margaritas to four 18-year-olc

"That's some serious stuff. I am pretty shocked," said Ja'net Lawrence, a 22-year-old Menlo C,
piayer who trained with van Gastellast week. "We knew he was having family problems."

New San Quentin death row to cost additional $45 million
Even before the SchwalZenegger administration has begun construction of a new death row at
Prison, the estimated cost of the Marin County lockup has ballooned 20 percent to $265 million.
In a letter to lawmakers disclosed Thursday, the Department of Finance said estimated costs ju
million because of inflation in the construction industry. As a consequence, the state plans to se
project and build 768 cells instead of 1,024.
Assemblyman Joe Nation, D-San Rafael, and Sen. Jeff Denham, R-Modesto, critics of the deat

Salesman's sentence 11 years for beating elderly woman
A door-to-door salesman was sentenced Thursday to 11 years in prison for beating and trying t,
elderly woman in her Menlo Park home last fall.
D'Angelo Langford, 19, of Georgia had pleaded no contest in June to beating the woman so vic

A neighbor ran to help after hearing the then-80-year-old woman scream, scaring off Langford.

Veterans' memorials in Cupertino
are few

The removal of six markers honoring veterans at the Gate of
Heaven Cemetery has raised questions about how Cupertino,
home to more than 3,000 military veterans, commemorates its
members of the military services.
There are at least two veterans' memorials in Cupertino, one a
general remembrance and one more personal and specific.
The main memorial is in Memorial Park on Anton Way. There, a
small plaque donated in 1980 by the Cupertino Kiwanis Club
reads: "This flag pole is in honor of all Cupertino veterans who
served on behalf of our country in past wars."
A second, more personal memorial exists at Cupertino High
School on Finch Avenue. On the back part of the campus, a
granite marker sits on a small, landscaped circle with the names
of 10 students from the school killed during the Vietnam War.
The marker is a gift from the Cupertino High School Class of
1967, which lost three members of their class to the war.
Although some think the Memorial Grove, a grove of redwoods
behind the new library, is dedicated to veterans, that is not the
case. "It's a bicentennial grove, not explicitly a veterans' grove,"
said Rick Kitson, a spokesman for Cupertino.

Ralph Otte, a World War II veteran and longtime resident, said he
was uncertain if there were markers other than the one in
Memorial Park. Otte chooses to honor his fellow veterans by
attending events at the Gate of Heaven cemetery, where many
veterans are buried. "I have gone to numerous veterans services
there on Memorial Day," he says.
On Memorial Day one month ago, the cemetery had installed six
markers honoring veterans, with a memorial for each branch of
the military and one for prisoners of war and those missing in
action. Gate of Heaven had to remove the markers after Memorial
Day since it had not received city approval to install them.
Jim Wheeler, who served in the military in Korea in the 1960s,
said the best local example of a veterans' memorial is in Santa
Clara's Central Park. "Santa Clara has a complete set of
monuments and a memorial with 5,000 bricks paid for by people
who may choose names they want on the bricks," he said.
He would like to see something similar in Cupertino. "It helps
people recognize the military," he said, "and having the military
recognized and respected is a critical thing for our future."
