OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL TO REZONE 3.28 ACRES FROM
P (PLANNED DEVELOPMENT WITH COMMERCIAL, Orr'ICE AND
RECREATIONAL INTENT) AND OP (PLANNED OtrICE) TO
PD (PLANNED DEVELOPMENT WITH HOTEL INTENT)
SEcl'ION I: FINDINGS
WHEREAS, the attached application has been submitted to the City of
Cupertino requesting a change of zone in the zoning regulations of the
City, as stated on Page 2; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application on the date as noted on said application; and
WHEREAS, the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS, the nPcPssary public notices have given as required by the Zoning
Ordinance of the City of Cupertino:
NOW, THEREFORE, BE ITT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a. Encourages the most appropriate use of land.
b. Conserves and stabilizes the value of property.
c. Provides for adequate open spares for light and air.
d. Permits adequate control of fires.
e. Promotes the health, safety and public welfare.
f. Provides for the orderly development of the City.
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located.
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 6-Z-86 as set forth in the Minutes of the Planning
Commission Meeting of September 8, 1986, and are incorporated by reference
as though fully set forth herein.

1. APPROVED EXHIBITS
The recommendation for approval is based on Exhibit A of Application
6-Z-86, except as may be amended by the special conditions listed
below:
2. PERMITTED USES
A maximum 200-roan hotel is permitted, subject to submittal and
approval of a definitive development plan in conjunction with a use
permit application. Ancillary facilities will also be permitted to
the extent they complement and support the primary hotel function.
Ancillary facilities may include banquet space, conference rooms, and
commercial activities common to hotels, such as gift shops, flower
shops, bookstores, hairdressers, barbers, and restaurants.
3. DEVELOPMENT GUIDELINES
The definitive development plan for the subject property shall comply
with the following standards:
- The hotel shall be of a scale and form which insures a
harmonious transition between the residential neighborhood to
the west and existing and future commercial developments in
Vallco Park.
- An Pa merit from Pruneridge Avenue shall provide acrpss to the
subject property. Acss fRuu Wolfe Road and Linnet Lane is
prohibited except for possible emergency access to Wolfe Road.

4. BASE BUILDING AREA CREDIT TRANSFER
The Cupertino General Plan permits a base land use credit of .33 FAR
for industrial, .37 for office and .25 for commercial uz a and hotel
facilities consisting of 1,000 total rooms plus ancillary facilities.
The hasp land use credit for sites devoted exclusively to hotel and
ancillary activities may be transferred to other sites within the FAR
transfer area.
