OF THE PLANNING COMMISSION OF THE CITY OF CUPERrTINO
RECOMMENDING APPROVAL TO REZONE 1.1 ACRES FROM P (CG)
AND R2-4.25 to P (PLANNED DEVELOPMENT)
SEcia0N I: FINDINGS
WHEREAS, the attached application has been submitted to the City of
Cupertino requesting a change of zone in the zoning regulations of the
City, as stated on Page 2; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application on the date as noted on said application; and
WHEREAS, the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS, the necessary public notices have given as required by the Zoning
Ordinance of the City of Cupertino:
NOW, THEREFORE, HE IT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a. Encourages the most appropriate use of land.
b. Conserves and stabilizes the value of property.
c. Provides for adequate open spaces for light and air.
d. Permits adequate control of fires.
e. Promotes the health, safety and public welfare.
f. Provides for the orderly development of the City.
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located.
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 4-Z-86 as set forth in the Minutes of the Planning
Commission Meeting of September 8, 1986, and are incorporated by reference
as though fully set forth herein.

Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event that a conflict
does exist, the special conditions as enumerated herein shall apply.
2. APPROVED EXHIBITS
The recommendation for approval is based on Exhibit A 1st Revision of
Application 4-Z-86, except as may be amended by the special conditions
enumerated herein.
3. USES PERMITTED
The approval permits construction of a maximum of 5-10 dwelling units
per gross acre and related site improvements to be constructed in a
single phase. Said construction may proceed only upon approval by the
City Council of a Use Permit which shall include the adoption therein
of a Definitive Development Plan as defined in Section 4b of Ordinance
No. 618.
PASSED AND ADOPTED this 8th day of September, 1986, at a regular meeting
of the Planning Commission of the City of Cupertino, State of California,
