Reso 2788 - 1 V-86 RESOLUTION NO. 2788 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE DENIAL OF A VARIANCE FROM CONDITION 7 OF ORDINANCE NO. 1223 WHEREAS, the Planning Commission of the City of Cupertino received an application for a Variance, as described on Page 2 of this resolution; and WHEPEAS, the applicant has not met the burden of proof required to support the said application; and WHEREAS, the Planning Commission finds that the application does not meet the following requirements: 1. The granting of the application is not necPgsary for the preservation and enjoyment of substantial property rights. 2. There are not any special conditions or exceptional characteristics applicable to the property. In addition, the property's location and surroundings do not create practical difficulties or unnecessary hardships as outlined in the staff report dated April 14, 1986. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for the Variance is hereby recommended for denial; and BE IT FURTHER RESOLVED: That the subconclusions upon which the findings and conditions specified in this resolution are based are contained in the Public Hearing record concerning Application 1 V-86, as set forth in the Minutes of the Planning Commission Meeting of April 14, 1986, and are incorporated by reference as though fully set forth herein.
