Director's :Minor Modifications (DIR-2005-28, DIR-2009-10) for an
existing personal wireless facility that consists of nine panel antennas
affixed to the top of a PG&E lattice tower at 10110 California Oak Way.
Chapter 19.132 of the Cupertino Municipal Code allows for
administrative approval of minor changes in a project. The
Director reports his decision to the City Council, Planning
Commission and property owners within 1,000 feet of the project
site in time to allow:an appeal of the decision within fourteen
calendar days.
BACKGROUND:
The applicant,Tawni Parr of.Conr� fete Wireless Consulting, Inc.,representing
Verizon kVireless, is renewing expiring Director's Minor Modifications (DIR-
2005-28, DIR-2009-10) for an existing personal wireless facility, consisting of nine
panel antennas mounted on a vertical extension of a lattice tower located at the
PG&E Monta Vista electrical substation. The antennas are a collocation on a
tower that currently hosts two other wireless carriers: Sprint PCS and Cingular
Wireless. The tower is centrally located in the substation and is surrounded by
residential uses to the north,east and south at the distances indicated on the
aerial photograph. Rancho San Antonio Park and the Gate of Heaven Cemetery
are located to the west.

DISCUSSION:
A 6-antenna Verizon facility was approved by the Planning Commission five
years ago in conjunction with a Height Exception application (Attachment A),
Last year a 3-antenna expansion leas approved by the Director of Community
Development (Attachment B) Nvith both approvals set to expire in Iate 2010.
Permit renewal presents an opportunity for the City and Nvireless carrier to

SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received a referral of a
Director's Minor Modification, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more
public hearings on this matter; and
WI-IEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity,and will not be detrimental to the public health,
safety, general welfare,or convenience;
2) The proposed use will be located and conducted in a manner in accord with the
Cupertino Comprehensive General Plan and Cupertino Wireless Facilities Master Plan
and the purpose of this title.

DISCUSSION:
Both Sprint-Nextel and Verizon Wireless have collocated antennas on this PG&E lattice
tower witl,, -�r:int occupying the towe legs below the conductors and Verizon above
the conductors. Verizon Wifireless is moving to 4",generation technology with vastly
increased d.ta speeds for wireless handsets and computers (Attachment :\ . The faster
communication speeds require additional antennas.
The three additional antennas ivill be mounted on the top hat rack at the same height as
the existing antennas. Visually it will look very similar to what is present today, which
is already r-tinimally risible to residences and public street views that are over 570 Feet
away Attaclunent B).
ACTION:
In accordance with CMC Section 19.108.090(B)(1), The Director of Community
Development finds the facility is minimally visible to residenral properties and public
rights-of-way, deems the antenna additions minor and approves the change as
described in the plan set titled: "Foothill & McClellan/1011.0 California Oak Way,
Cupertino, CA 95014/APN 342-63-001"prepared by MST Architects and consisting of
four sheets labeled T1.1, C-1,ALL and A1.2 dated 5/20/09 (Attachment C), except as
may be modified by the conditions enumerated below:
1) ANTENNA CAMOUFLAGE
The new antennas, supporting brackets and all existing and new tower cables
shall be painted a flat gray color that matches the tower.
2) ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a
continuous period of 18 months, said antennas and associated facilities shall be
removed. The applicant shall bear the entire cost of demolition, removal and
land restoration to its former condition.
3) PERM II F FXPIRATION
The Director's approval is valid until November 22, 2010, in order to coincide
this hermit with the expiration date of the approvals for the personal wireless
service facility.
This approval of the modification is effective June 15, 2009. The fourteen calendar day
aepeal period will expire on June 29, 2009.

Background
Since approximately 2005, Verizon has maintained a communications facility at the PG&E tower located
in at 10110 California Oak Way in Cupertino per Use Permit DIR-2005-28; as modified via Director's
Minor Modification DIR—2009-10 dated June 22, 2009.
Verizon's facility presently consists of nine (9) antennas affixed t
to the top of the PG&E lattice tower. The equipment is located
in a separate ground level equipment shelter. The antennas
are connected by cabling that runs up the leg of the tower. g ,
Other carriers have also co-located at this site below the '

electrical conductors.
This site is located in an area designed to give residents ander
public service personnel subscribers the best connectivity and
signal strength possible and bring 4`h Generation, high speed u
technology to the coverage area.
Compliance with City Development
This facl:ity remains in compliance with the applicable standards set fort: in the City's Municipal Code
and Use Permit conditions.
The number (9), size and location of antennas and related ground equipment are necessary to providing
coverage and high speed service in the City of Cupertino. Verizon's antennas are all mounted at the
same height on the top of a PG&E tower are uniform in size and appearance. The continued co-location
on an existing tower satisfies the City's requirement that existing towers and masts be utilized to reduce
'visual cutter" anc to avoid concentration of telecommunications facifties. (§ 19.108.070 (A.,E-G).)
Verizon's antennas, hardware, extension and cabling are painted a flat gray color to match the match the
PG&E :ower thereby satisfying the requirement that colors, materials and textures integrate with the
surrounding ouilding and environment. (§19.108.070(6).)

In sum, Verizon's facility continues to balance the City's aesthetic concerns with its need to provide a
functional communications system. Therefore, applicant respectfully requests that the City find that the
facility's visual impact is minimal and grant renewal of the Use Permit.
