AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
REPEALING AND RE-ENACTING CHAPTER 16,24 OF THE CUPERTINO
MUNICIPAL CODE ADOPTING THE 1994 EDITION OF THE UNIFORM
MECHANICAL CODE
THE CITY COUNCIL OF TIlE CITY OF CUPERTINO IIEREBY ORDAINS that Chapter 16,24 of
the Cupertino Municipal Code is rcpealed and re-enacted as contained in attached Exhibit A.
INTRODUCED at a regular meeting of the City Council of the City of Cupertino this 20th day of
November, 1995, and ENACTED at a regular meeting of the City Council of the City of Cupertino this
4th day of December, 1995, by the following vote:

and examination by the public, excepting those
provisions noted in this chapter, is adopted by

16,24,020 Name insertion,
The names "Cupertino" and/or "California"
shall be inserted in the appropriate places
provided threfor in each and every section of
said mechanical code wherein the name of the
City or Slate is left blank. (Ord. 1362 (part),
1986).
16,24,030 Condensate Wastes,
1994 UMC Section 310.1 is amended by
replacing it with the following:
Condensate from air cooling coils and comfort
cooling equipment not intended to be used for
the storage or holding of food or drinks shall be
collected and discharged to an approved point of
disposal acceptable to the Adminislralive
Authority.
Termination of such drains shall be made by
an air break. Condensate drain lines in sizes 1-
1/4" and larger shall be assembled using
approved drainage pipe and fittings. Condensate
waste water shall not drain over or upon a public
way, sidewalk, pedestrian ramp or the like.
Condensate drains with terminations within the
inlerior of a building shall not be connected to
the huilding roor drain or overnow piping
systems.
Findings
The waste water treatment facilities serving
many Silicon Valley cities are operating at or
near maximum capacity. The discharge of
trealed was]e water into San Francisco Bay is
detrimental to ils sensilive ecosyslem.
Cooling coil and comfort cooling equipment
condensate waste discharge does not contain
pollutants which require treatment before being
discharged into storm sewers or the ground.
] 6.24.040 Hearing,
The ordinance codified in this chapter shall,
aner lirsl reading. he scheduled ror puhlic
hearing as proviLicd in Section 50022.3 or Ihc
Government Code or the Slate or California.
Notice or hearing shall be published pursuant to
Section 6066 of the Government Code in the
Cupertino Courier. Copies of the Uniform
Mechanical Code, 1991 Edition, and this chapter
shall be on file with the City Building
Department and open for public inspection.
Notice of hearing shall generally describe
purpose and suhject matter of the ordinance.

phrase or this chapler is. Ii" any reason, held to
be unconstitutional. such decisions shall not
affect the validity of the remaining 1'01'1 ions of
this chapter. The City Council declares that it
would have enacted the ordinance codified in
this chapter and each section, subsection,
sentence, clause or phrase thereof, irrespective of
the fact that anyone or more sections

16,24,060 Board of appeals,
Section 110 or the Uniform Mechanical Code
is ameoded 10 read as follows:
In order to determine the suitability of
alternate materials and methods of construction
and to provide for reasonable interpretations of
the provisions of this Code. there shall be and is

hereby created a Board of Appeals, consisting of
tive members who are qualified by experience
and training to pass upon matters pertaining to
buitding conslrucl;on, mechanical design and
maintenance and the public heallh aspects of
mechanical systems. The Building Official shall
be an ex-officio member appointed by the
Mayor, subject to the approval of the Cily
Council, and shall hold office at his pleasure.
The 130ard shall adopt reasouable rules and
regulations for conducting its investigations and
shall render all decisions and Endings in writing
to the Building Official, with a duplicate copy to
Ihe applicanl, and may recommend to the City
Council such new legislation as is consistent
therewith. The same personnel of the Board of
Appeals under the other building construction
uniform codes. In the evenl an Appeals Board is
not appointed by the legislalive body, the
Council shall serve as said Appeals Board.
