REPEALING AND RE-ENACTING CHAPTER 16,56 OF THE CUPERTINO
MUNICIPAL CODE ADOPTING THE 1994 EDITION OF THE UNIFORM HOUSING
CODE
THE CITY COUNCIL OF THE CITY OF CUPERTINO HEREBY ORDAINS that Chapter 16,56 of
the Cupertino Municipal Code is repealed and re-enacted as contained in attached Exhibit A,
INTRODUCED at a rcgular mccting of thc City Council of thc City of Cupcrtino this 20th day of
November, 1995, and ENACTED at a regular meeting of the City Council of the City of Cupertino this
4th day of December, 1995, by the following vote:

Code, 1994,
The Housing Code for the City shall be the
1994 Edition of the Uniform Housing Code.
Chapters I to 16 inclusive, except Section 203,
as compiled and published by the International
Conference of Building Officials, one copy of
which has been filed for use and examination by
the public in the oftice of the Building
Department, is referred to, and except as to
omissions, amendments and additions hereinafter
noted, is adopted and made a part hereoC the
same as if fully set forth in this chapter. (Ord.

16,56,020 Organization and enforcement.
Section 203 of the Uniform Housing Code is
amended 10 read as 1(,lIows:
In order to provide for reasonable
interpretation of the provisions of this code, to
mitigate specific provisions of this code whi~h
create practical difficulties in their enforcement
and to hear appeals provided for hereunder, there
is hereby established a Housing Advisory and
Appeals Board consisting of live mcmbers who
are qualified by experience and training to pass
upon matters pertaining to construction and who
are not employees of the jurisdiction. The
building ofticial shall be an ex ofticio member of
and shall act as secretary to said board. The
board may be appointed by the governing body
and shall hold oftice at its pleasure. The board
shall adopt rules of procedure for conducting its
business and shall render all decisions and
findings in wriling to the appellant with a copy

shall be processed in accordance wilh the
provisions contained in Section 1201 of this
code. Copies of all rules of procedure adopted by
the board sball be delivered to the building
official, who shall make them accessible 10 the
public. The same personnel of the Board
appointed under this Code may act as Ihe Board
of Appeals under [he olher building conslruc[ion
uniform codes. In the event, a Housing Advisory
and Appeals Board is not appointed by the
legislative body, the Council shall serve as said
appeals board.

16,56,030 Violations--Penalty,
Any person, firm, corporation, partnership or
copartnership who willfully violates any of the
provisions or "Iils 10 comply with any of the
mandatory requirements of this chapter is guilty
of an infraction excepl when the violation of any
such provision is specifically declared by the
Uniform Housing Code to be a misdemeanor,
and upon conviction thereof, shall be punishable
as provided in Chapter 1.12 of the Cupertino
Municipal Code, except that nothing contained
in this chapter shall be deemed to bar any legal,
equitable, or summary remedy to which the City
of Cupertino or other political subdivision, or
any person, firm, corporation or partnership may
be otherwise entitled, and Ihe City of Cupertino
or any other political subdivision, or person,
tirm. corporation or parlnership may lilc a suit in
the Superior Court of the County of Santa Clara,
or reslrain or enjoin any attempted or proposed
subdivision or acls in violation of the chapter.
