Effective January, 1, 2009, Assembly Bill 2335 amends California Health and Safety Code,
Section 19825, regarding disclosures and verifications required for all applicants seeking Owner -
Builder construction permits. These new application requirements provide an enhanced level of
consumer awareness and protection for property owners accepting the risks associated with
Owner -Builder construction permits.
"The Legislature hereby finds and declares that there is an urgent and statewide public interest in
assuring that building contractors comply with the Contractors License Law ... and provisions of
law relating to Workers' Compensation Insurance for building construction, that property owners
are informed about, and protected from, fraudulent representations, liability for worker's injuries,
liability for material and labor costs unpaid by contractors, licensing requirements, and
employer's tax liabilities when improving their property as owner -builders" .
Important information you need to know BEFORE pulling your permit!
The term "Owner -Builder" can mean three different things:
"Owner as Worker", "Owner as Contractor" or "Owner as Employer"
Understand each has Benefits or Risk, and it is possible to combine them!
Hiring a California Licensed Contractor means you do not personally perform any of the construction work, the
permit is not taken out in your name, you are not personally responsible for the construction and you are not an
Owner -Builder. Instead, you become a "Customer" and California law provides you the benefit of protection from
poor workmanship, failure to finish the job and financial risk due to worker injury.
Benefit/Risk: Hishest Benefits and the Least amount of Risk
Owner -as -Worker is a type of Owner -Builder where you personally perform the construction work, the permit is
taken out in your name and you are personally responsible for the construction management, knowledge,
workmanship, and completion of the job. You benefit by not paying others to perform this work for you and your
risk depends on your own ability to complete the job successfully.
Benefit/Risk: 7 with Lois Financial Risk
Owner -as -Contractor is a type of Owner -Builder where you personally act as your own General Contractor, the
permit is taken out in your name and you hire California licensed sub -contractors to perform portions of the
construction work. WARNING: The benefit of protection provided by law when you hire only California licensed
sub -contractors can turn to serious financial risk if you hire unlicensed contractors to perform any of the work.

Owner -as -Employer is a type of Owner -Builder where you pay any individual to perform any construction work
valued at more than $500.00, the permit is taken out in your name and you are personally responsible for their

savings benefit can turn to serious financial risk if you fail to deduct payroll taxes or provide workers compensation
insurance for each worker.

Over 20,000 consumer complaints are filed each year. Many complaints relate to
owner/builder projects and include workmanship and workers' compensation issues

Following are alarming examples of what has occurred with Owner -Builder permits:
Example 1: Homeowner received insurance money to rebuild burned -down home.
■ Owner/Builder permit pulled to rebuild structure.
■ Unlicensed contractor built substandard structure — must be torn down and replaced.
■ Estimated financial injury is $225,000.
■ Additional financial injury - IRS threatened to tax insurance payout if house not
completed by the end of the year.
Example 2: Brother-in-law had active license but filed an exemption from Workers Comp.
■ Owner -Builder hires brother-in-law to install a new roof.
■ Employee falls and sustains multiple spinal and extremity fractures as well as a head
injury and remains in a coma to this day.
■ The Owner -Builder, who has sold the home, is now a defendant in a lawsuit for
reimbursement for benefits paid to the injured worker.
Example 3: Employee of contractor without Workers Comp is hired by Owner -Builder to
install septic system and suffers injury that results in permanent disability.
■ The Owner -Builder did not have a homeowner's insurance policy on the house against
which to submit a claim.
■ The Owner -Builder is now a defendant in a lawsuit for reimbursement for benefits paid to
the injured worker.
Did you know — unlicensed persons frequently have the property owner obtain an "Owner -
Builder" building permit which erroneously implies that the property owner is providing his or
her own labor and material personally?
Did you know — your homeowner's insurance may not provide coverage for injuries

Dear Albert:
Thank you once again for your vigilance in helping us find an Alternative Materials and
Methods for the non -rated roof construction at St Joseph of Cupertino School.
At our meeting in your office on Wednesday June 2, 2010, we agreed upon a fire
retardant roof coating product call Firefree SS that has a tested equivalency of 60
minutes as an acceptable alternative materials and methods. All underside of roof 2x6
framing and plywood sheathing will be exposed and coated with this intumescent
product. The rated suspended ceiling will be installed but no other rated penetration
protection will be required of the ceiling and soffit areas.
On a related matter, but not part of the application for alternative means of construction,
the exterior 4 x 4 steel column will be exposed and coated with Safecoat TFI, a fire
retardant coating for steel with up to a 2-1/2 hour rating or individually wrapped 5/8"
type X gypsum board. This will be determined when the plywood is removed. The
interior column is non-structural, as confirmed in the letter and detail provided by the
structural engineer and attached. As such, it is not required to be protected.

Project Pre-K and Homework Room Remodel
2,800 sq. ft. remodel to existing building areas. The total school is
13,251 sq. ft.
Existing Conditions • The building is one story with CMU classroom separation/bearing
walls, each classrooms with two means of egress directly to outside.
• The entire building, not just the project area has non -rated roof
ceiling assemblies.
• There is no new roof structure or building area being added.
-The primary structural system is heavy timber construction,
equivalent to one -hour construction bearing on CMU walls.
• Substantial new construction is already in place creating a hardship
to the School to deconstruct and replace building systems.
Code Issue: Existing building/ceiling assembly was built using Type V-B
construction as it would be classified in the 2007 California Building
Code.
Requested Request for consideration of an alternate means of construction for

CBC Table 601 - Fire Resistance Rating of Building Elements
Code Intent: Building construction shall be Type VA which requires 1-hour fire -
resistance roof/ceiling assembly. The fire -resistance rated roof/ceiling
assembly is required to assure containment of a fire during a fire
event and to reduce exposure to the remainder of the building and
any close adjacent buildings.
Alternate Materials and Methods:
The existing roof construction includes: tar/gravel built-up roof covering; '/2" plywood deck;
2 x 6 rafters @ 16" o.c. and 6 x 15 main glu-lam girders. We have been unable to find a
listed 1-hour fire resistive assembly where 2 x 6 roof rafters were utilized as part of the
assembly.
The proposed alternate means of construction is to provide protection to the non-
complying roof/ceiling assembly is: as follows:
1. Current void space between the 2 x 6 rafters has been filled with thermal insulation,
R-30 over the entire project area (Pre-K and Homework Room). It is proposed that all
ceiling insulation will be carefully removed, stored and reinstalled.
2. The entire 2 x 6 roof rafters and plywood sheathing will be coated with an approved
Intumescent, white emulsion coating for the one -hour fire protection of all rafters and
Sheathing. Enclosed soffits shall be opened so that all concealed wood framing will receive
a fire resistant coating in accordance with the manufacturer's written instructions.
3. The ceiling below the rafters will be a suspended fire resistance rated lay -in system
where the weight of the ceiling tiles will comply with CBC Section 711.3.1 or clips will be
provided to prevent vertical displacement
4. Current design provides a new fire alarm system that for the first time will provide
central station monitoring for the entire school for early notification of the fire department
both during school as well as after school hours.
5. Area of building remodel is separated from the remainder of the existing building by
an 8" thick grouted concrete block wall system.
6. Reinstalling insulation within the roof rafters, providing the fire -resistance rated lay -
in ceiling system and intumescent paint within the entire remodel area
does, in our opinion, provide for an equivalent means of 1-hour roof/ceiling
assembly for this building.

PRODUCT INFORMATION
Description
FIREFREE 880 ("FF889") is a premium quality water
based, nontoxic, thin film intumescent fire retardant, fire
resistant product formulated to provide a fire retardant,
resistant barrier on a variety of interior substrates, including
gypsum board, oriented strand board and other wood
products, composite architectural panels, class A
polyurethane foam, Icynene® Style Foam, masonry,
concrete, thin gauge metals, fiberglass, as well as many other
substrates. It is suitable for residential, multifamily,
commercial and industrial projects, for both new and
reconstruction projects. Color: Standard off-white, but may
be custom tinted. FF880 is approved for interior use on
certain assemblies only and is not designed for use on
structural steel. Please refer to "FIRE SAFETY" below.

FF888 is not designed for use on structural steel. FF888
is approved for interior use (for exterior use, please
contact the company). FIREFREE Coatings, Inc. has
tested its FF880 product, as a component, in various fire
resistant rated assemblies. Contact manufacturer for more
information. FIREFREE Coatings, Inc. recommends that
the application be performed by a licensed painter
experienced in performing the work on projects of similar
scope and scale. FIREFREE Coatings, Inc. will provide
proper application instructions to the licensed painter
contractor selected by the General Contractor or Owner.
Building Codes
Installation must comply with the requirements of applicable
local, state and national building codes.

When Time and Safety Matter
APPLICATION
Surface Preparation
All surfaces to be coated must be clean, cured, firm, dry
and free of dust, dirt, oil, wax, grease, mildew, loose
flaking paint, efflorescence or any other contamination or
condition that would adversely affect the performance of
the coating. Etch or prime (with a latex primer or fast dry
oil base primer/sealer) glossy, glazed or dense surfaces.
Always prime oil based finish coatings with an oil based
fast dry primer/sealer. Fill holes and surface irregularities
with a suitable patching compound to match surface
profile. Spot prime all patched areas with appropriate
primer. Metal surfaces must be free of rust.
Application Conditions & Procedures
Do not apply if temperature is below 50°F. All surfaces to
which FF888 have been applied should be inspected by a
third party special inspection agency, or an ICC certified
professional, or a Firefree Coatings QA/QC qualified
inspector to verify that FF880 has been properly applied
in the required uniform thickness.
Do not thin or strain FF888. Apply at can consistency.
Use of airless sprayer is recommended (use of a dedicated
spray line is required), but FF880 may be applied by
brush or roller. For brush application, a fully loaded brush
should be used. A laying on technique will reduce the
brush marking. A short nap roller can be used but this
may result in a slight textured finish.
Enamel finish coats: Apply one (1) coat of a latex primer
or fast dry oil base primer/sealer over FF88® before
applying a latex enamel or oil base enamel finish coat.
Wall covering applications: Apply one (1) coat of wall
primer over product before applying wall covering.
FF88 ® has a flat finish but may be top coated with most
paints to achieve the desired texture and finish.
For information on approved compatible primers and
finish paints, contact manufacturer. Apply additional
finish coats only after previously applied coats are
thoroughly dry. Precautions: Do not apply any materials
that have been frozen or have come into contact with
contaminants prior to use.

Spread Rate
Application at a rate of 14 mils wet, 10 mils dry has a
theoretical spread rate of 114 sq.ft/gal per I coat. Confirm
wet film thickness with a wet film thickness gauge. Any
consideration for quantity and waste or overspray is the sole
responsibility of the end user. Waste factor will depend on
the method of application (brush, roll or spray), job site
conditions and other factors and should be based on the
applicators experience.
Thickness
During application, the wet film thickness should be checked
using a wet film thickness gauge. To use the gauge, insert the
teeth into the wet basecoat. The last tooth to be coated
indicates the thickness achieved. It is important to ensure that
the wet film applied is of sufficient thickness to give the
required dry film thickness. During the drying process,
FIREFREE 88® will shrink due to evaporation.
All surfaces to which FF880 have been applied should be
inspected by a third party special inspection agency, or an
ICC certified professional, or a Firefree Coatings QA/QC
qualified inspector to verify that FF888 has been properly
applied in the required uniform thickness.
If an independent testing agency is retained, it should
ensure that preparation of substrate is in accordance with
manufacturer's recommendations. It should randomly
obtain and test samples during application to verify that
wet film thickness of the intumescent coating complies
with manufacturer's requirements.
Dry Film Thickness
The final dry film thickness of the Firefree 888 will vary
according to specific construction assemblies. The dry film
thickness required will depend on the specific fire rating and
substrates to be protected. Please contact Firefree Coatings
Technical Service to assist in determining the appropriate dry
film thickness of the coating.
Drying
Dry time is when the surface is thoroughly dry to the touch.
Drying times are dependent upon a number of factors:
Temperature - Air movement - Humidity - Thickness of
product - Method of application. If unsure, please contact
manufacturer.
If multiple coats of FF880 are required; FF880 must be
thoroughly dry to the touch prior to the application of
additional coats. The final dry film thickness required
will vary according to specific assemblies. Please
contact FIREFREE Coatings for more information.

Storage & Temperature
FF880 cannot be exposed to freezing temperatures. It is
important to maintain storage temperatures above the
freezing point. FF88® should be stored at recommended
temperatures between 40° to 85°. Expected shelf life is one
(1) year from the date of purchase. Product must be kept at
recommended storage conditions and in original unopened
containers.
Maintenance
Surfaces which have been coated with FF889) should be
protected from abuse and abrasion. Damaged surfaces should
be repaired and FF88® should be reapplied to the original
specified dry film thickness to maintain specific rating.
Cleanup & Safety
Wash brushes, rollers, spray guns & pumps and other
painting tools in COLD clean water promptly after painting.
Clean and remove any dried product with the use of Goof
Off. Use all products completely or dispose of properly.
Local disposal requirements vary; consult your sanitation
department or state -designated agency for more information
on disposal options.
Use only with adequate ventilation. Do not breathe spray mist
or sanding dust. Avoid contact with eyes and prolonged or
repeated contact with skin. Wear eye protection and or gloves
during application or sanding. A dust/particulate respirator
approved by NIOSH should be wom when sanding or
spraying. Close container after each use. First Aid: If you
experience difficulty breathing, leave the area to obtain fresh
air. In Case of Spill: Absorb with inert material and dispose
of as specified under "CLEANUP".

WARRANTY
Warranty
FIREFREE Coatings, Inc. (FIREFREE) provides the
following limited warranty:
For a period of ten (10) years FF888 will not crack, peel, or
chip if properly applied to a properly prepared and approved
surface and if properly maintained under normal interior
conditions and not exposed to external weathering.
If FF889 fails to meet the terms set forth above, FIREFREE
will provide, at no charge, a quantity of FF888 sufficient to
repaint the surface affected. This is the exclusive remedy
for all warranty claims. In the event of a warranty claim,
the claimant must notify FIREFREE in writing of the defect
promptly following discovery and must submit proof of
purchase, including the date of purchase, and proof of the
defect, including the date of discovery. FIREFREE reserves
the right to inspect any painted surface to which the warranty
claim applies.
This warranty will be void if the surface is (a) treated by any
abrasive process or material (other than normal sanding
before application of FF889), (b) exposed to any biological
solvent or caustic chemical or agent, (c) altered or repaired,
(d) exposed to exterior weathering. The warranty will also be
void if; (i) FF888 is diluted or adulterated, (ii) mixed with
any other product, (iii) is not stored, applied, in the required
uniform thickness, and inspected in accordance with the
manufacturer's recommendations, instructions, and
specifications, or (iv) if used after one (1) year from the date
of purchase.
All surfaces to which FF880 have been applied should
be inspected by a third party special inspection agency,
or an ICC certified professional, or a Firefree Coatings
QA/QC qualified inspector to verify that FF880 has
been properly applied in the required uniform
thickness.
This warranty is made in lieu of any and all other warranties.
The manufacturer expressly disclaims any and all
warranties, express or implied, of merchantability or
fitness for any particular use. For further information,

Fire Safety
For various reasons, including (i) the very different
circumstances that may exist from one fire to another, (ii) the
differences between conditions in an actual fire and
laboratory conditions in which testing is conducted, and (iii)
the inherent variability of fire tests, passing a laboratory test
or certifying/labeling Firefree 889 ("FF889") for use in
specific assemblies/systems does not mean that the same
application of FF889 will necessarily provide an equivalent
protection or the same result in an actual fire or in a new
laboratory test. Furthermore, FF888 is to be used only as
component of complete fire retardation systems. It will only
contribute to slowing fire spread for the area where it has
been applied and will not, by itself, prevent a fire from
starting or continuing. The amount by which FF888 retards a
particular fire will depend, among other things, on (i) the
amount of FF889 applied, (ii) the conditions of the other
elements of the assembly incorporating FF888, and (iii) the
conditions of the actual fire itself. FF888 will not make a fire
any less dangerous to persons or property. FIREFREE
cannot guarantee that loss or injury will not be suffered by
persons or property. It is the sole responsibility of the
applicator to ensure that FF889 has been applied in
accordance with the application directions. It is the
responsibility of the occupier to ensure the paint is not
cracked, chipped or peeling.

Steel Protection
PRODUCT DESCRIPTION
SafeCoat TFI is a single component latex, intumescent
fire retardant coating ideally suited for exposed Interior
structural steel where 2-1/2 hour fire resistance rating
is required. It is ideal for interior steel columns, tubes,
trusses and other exposed structural members. It limits
thermal penetration by expanding to many times the
original dry film thickness when exposed to heat. This
expanded material forms a char which insulates the
substrate against heat, and reduces available oxygen
to the surface. It provides a 2-1/2 hour fire rating as
tested under ASTM E-119-07A "Floor/Ceiling", NFPA
251 "Small Scale Test" and CAN 4-S101, "No Load".

INSTRUCTIONS FOR USE
Surface Preparation:
All surface preparation should be carried out in accord-
ance with good painting practices. Remove all loose,
peeling or powdery paint from the surface. All dirt,
grease, oil, wax and other foreign material must
be removed with a suitable cleaner and allowed to
thoroughly dry.
ARplication:
SafeCoat TFI Coating can be best applied with an
airless spray. Airless equipment is most desirable. Use
Graco TexSpray Model Mark V or similar units. Use a
17-21 thousand aperture with a 12" fan. SafeCoat TFI
Coating Is a heavier body paint requiring reliable and
consistent pumping equipment to achieve optimal
results. Apply uniformly to entire surface. If thinning is
required use clean water only and do not exceed 200
mL per gallon. Surface and ambient temperature must
be maintained at greater than 50' F (10° C) during
application and must remain so for at least 48 hours
following the application. SafeCoat TFI Coating is
intended for interior use only. If the coated substrate
will be subject to repeated washing or prolonged
contact with moisture a finish coat of PRECIDIUM
Aqua 90A or suitable latex paint is recommended.
More than one additional finishing coat may adversely I
affect the flame spread rating and smoke developed
classification. Before applying any finishing coat
consult the manufacturer or their representative. A wet
film thickness gauge can be used at the start of the
application to check that sufficient SafeCoat TFI
Coating has been applied. At an application rate of 16
sq. ft. per gallon or wet film thickness should be 100
mils and will yield a dry film thickness of 60 mils.
Clean UR:
All application tools can be easily cleaned with water.
If product has dried on, use hot soapy water to soften
and remove it.
Precautions:
SafeCoat TFI Coating is not "WHMIS" regulated nor is
it subject to the "Transportation of Dangerous Goods
Act and Regulations". See MSDS for detailed
precautions.

Mr. Squarcia,
I am writing this letter per your request to address an issue, which arose during construction
at Saint Joseph of Cupertino Restroom and Rectory Ramp Modernization. The question
was brought up by the contractor while laying out the stair to the lowest level. This "alley"
is a small walkway existing between the Rectory Offices and the Gymnasium. The Parish
Priest told me that on occasion the students at the school sometimes use this alley to get to
the church. This is not the recommended accessible path of travel since the existing paving
is uneven and there is equipment and other oddly stored items placed in this space. Please
refer to the attached site plan showing the accessible path of travel from the school to the
church. The recommended accessible path of travel route is equivalent in distance to the
alternate route, which is currently under construction. With this in mind, we are providing
an accessible stair with a 5-foot level landing. After the landing the paving will be sloped to
the existing grades. We cannot make this alternate path accessible and hope we have
shown that the recommended path of travel is more than adequate to fulfill accessibility
requirements.

Notes:
1. Hole size through the flooring system and Gypsum wallboard ceiling is to be a
maximum 1/2" larger than outside diameter of metal pipe/conduit.
2. The metal pipe/conduit should be centered in circular openings such that a maximum
1/2 annular space is present around its perimeter at each through location.
3. Use CP 25S/L (self leveling) Caulk on horizontal sufaceswhen filling gaps from
above the penetration. Use CP 25 WS (No Sag) Caulk on vertical surfaces and on
horizontal surfaceswhen filling gaps from below.
4. The 3m Fire Barrier CP25 Caulk is to be forced into the annular space to the maximum
extent possible, flush with the exterior of the penetration surface.
5. Finish caulking with a 1/4" minimum bead of CP 25 Caulk applied to the perimeter of
the pipe at its egress from the floor and ceiling.
