DECLARATION OF RESTRICTIONS
This DECLARATION OF RESTRICTIONS made this /7 day of , uc.e.-Abe ,-

WHEREAS, Declarant is the owner of certain real property located in the City of
Cupertino, County of Santa Clara, California, more particularly described as follows:
APN _ 3.53 - O 24- 03.E (Legal description attached as Exhibit A.)
WHEREAS, Declarant and/or persons acting on behalf of Declarant propose to construct a
second dwelling unit on an existing single-family lot.
WHEREAS, Chapter 19.84, an Ordinance of the City of Cupertino regulates the
construction and maintenance of second dwelling units in single family (RI)zones as
follows:
1. The owner must reside on the premises in the principal or second dwelling
unit.
2. A deed restriction setting forth the above -described occupancy
requirement must be recorded prior to granting a building permit for a new
dwelling unit or granting an occupancy permit for an existing second unit
constructed prior to the adoption of the second unit regulations.
3. The owner of a property which contains a second dwelling must sign an
affidavit on each yearly anniversary date of the approval of said second unit
declaring under perjury that he/she is living on the premises.
4. In the event the owner is unable to reside on the premises for any reason,
continued occupancy of two units on the property is invalid and illegal. Only
one of the units may be non -owner occupied and the other second unit must
be rendered unoccupiable, except as an accessory building as permitted by
the R1, residential single family, zoning district of the City of Cupertino.
5. In that event, the second unit must be modified to conform with the
accessory building provisions of the R1 Ordinance by elimination of the food
preparation capability within the kitchen area including the removal of
cooking units including range and ovens and disconnection of special
electrical wiring and/or gas lines to service said kitchen area.
6. In lieu of eliminating the food preparation facilities, the owner of the
property has the option of leaving one of the two units vacant.
7. Certification of removal of the functional food preparation facilities must
be made by inspection by the City of Cupertino Building Department prior to
non -owner occupancy of the property. An inspection fee will be charged to
certify that the modifications have been completed.
8. If the owner elects to leave one of the units vacant, the owner must
prepare a letter describing the unit and the length of time it will remain
vacant. The unit must be subject to periodic inspections by the City to
confirm that it is not occupied.
NOW, THEREFORE, in consideration of, and subject to, the terms and conditions set
forth above, Declarant agrees as follows:
Declarant agrees to comply with the above referenced conditions and restrictions and
hereby notices all future property buyers of said conditions.
Declarant agrees that this declaration is intended to be a covenant running with the land and
will bind and inure to the benefit of the heirs, personal representatives, successors and
assigns of each present and future owner of the real property described herein.

Introduction
Ken R. Sanford (TreeWorld) was requested by Charles Tang to inspect,
evaluate and report on trees located at 10231 Mira Vista Road, Cupertino,
Calif. This report is intended to provide evidence of compliance for
ordinance No. 1799 of the City Council of the City of Cupertino (privacy
protection requirements) Pictures provided correspond with site map (See
"Exhibit A"). The following is our findings and recommendations.
Method of Evaluation
1. Record location of each tree on site map.
2. Identity each tree as to species.
3. Measure trunk diameter at point 48" above grade.
4. Evaluate tree health of the tree on a 0 - 5 scale, where 0 = poor
and 5 = excellent condition.
5. Note any areas of structural weakness such as decay, cracks, poor crown
conformation, history of failure, etc.

Introduction
Ken R. Sanford (TreeWorld) was requested by Charles Tang to inspect,
evaluate and report on trees located at 10231 Mira Vista Road, Cupertino,
Calif. This report is intended to provide evidence of compliance for
ordinance No. 1799 of the City Council of the City of Cupertino (privacy
protection requirements) Pictures provided correspond with site map (See
"Exhibit A"). The following is our findings and recommendations.
Method of Evaluation
1. Record location of each tree on site map.
2. Identity each tree as to species.
3. Measure trunk diameter at point 48" above grade.
4. Evaluate tree health of the tree on a 0 - 5 scale, where 0 = poor
and 5 = excellent condition.
5. Note any areas of structural weakness such as decay, cracks, poor crown
conformation, history of failure, etc.

It is the opinion of this arborist that the trees planted and described and evaluated in this
report fully comply with the ordinance No. 1799 of the City of Cupertino. It is also
recommended that no further plantings be required in this area as long as regular
maintenance and yearly health inspection are made by a certified arborist.
The information contained in this report is true and correct to the best of my knowledge.
Changes to the plans and to the site may necessitate the revision to the information
contained herein.
