Corporation is required to complete the abandonment of the existing septic
system serving the residence of Ms. Ann McElroy. Further, Debcor Corporation
is required to connect this residence to sanitary sewer provided in Stelling Road
under the jurisdiction of Cupertino Sanitary District. This work has been
reviewed and approved by both the City of Cupertino Public Works Department

Dear Joe:
I am writing to you in regard to the improvements being installed at 1358 South
• Stelling Road in Cupertino as part of the Subdivision and Improvement
Agreement approved by the City of Cupertino in February of this year. As part
of the Subdivision, Ms. Ann McElroy the owner of the subject parcel was left with
a remainder parcel fronting on Stelling Road, while Aster 2, a California Limited
Partnership, took ownership of two parcels to the rear of the lot fronting on Aster
Lane. Subdivision level improvements, required that the remainder parcel on
which Ms. McElroy lives was to have an existing septic tank abandoned and the
residence connected to Cupertino Sanitary District's sewer main in Stelling
Road. Debcor Corporation is handling this operation as a courtesy to Ms.
McElroy.
During our exploration for the operation we noted that the septic lines could not
be redirected so as to run from the front of her residence to the street but rather
required that the sewer lateral run around her home and to one of two sewer
mains in Stelling Road. This added considerable length, approximately 100' to
the lateral. The first main is 8' below Stelling's pavement section and is
approximately 3' from the centerline of Stelling in favor of the McElroy residence.
but would not allow for the required 1/4" fall per foot as required by UPC 708.0.
However, in reviewing the UPC, as we discussed the other day, the City Building
Department has discretion to permit 1/8" fall per foot with a 4" lateral with a
written request for same. The basis for the request is one of financial hardship
• on Ms. McElroy. The current cost of the new lateral is $6,825, using the first
sewer main in the Stelling. However, if we can not utilize a 1/8" per foot slope,

• we will be forced to utilize the second main in the street on the farside of Stelling
at a depth of 14' below Stellings pavement section and would require us to go
under the first sewer main at Wand a storm main which we have not exposed._
This would push the cost of the main up considerably and we estimate the
increase to be approximately$5,000 or approximately a 75% cost increase. The
sewer lateral we are proposing would fall 1/4" per foot to the clean out at the
property line. In the future when Ms. McElroy's remainder parcel is developed,
the lateral beyond the P.L. could be abandoned and the lateral to a new
residence installed at 1/4" fall per foot.
I would greatly appreciate your approval of this request allowing 1/8" per foot fall
for a 4" sewer lateral from the property line to the rear of Ms. McElroy's existing
residence. Please let me know your decision as soon as possible. Again, your
approval of this request would alleviate substantial financial hardship on Ms.
McElroy and allow us to proceed with the connection of her residence to City
sewer. If you require further information, please do not hesitate to contact me or
you can discuss the matter with Jerry Brager who has discussed same with
Precision Pipeline, the underground contractor performing the work as he may
have additional insight into the matter.
