De Anza Boulevard Dear Gian: ENVIRONMENTAL COLLABORATIVE is pleased to submit this proposal to provide a peer review of the Biologist Report (BR) by ESA (dated April 25, 2024) on the Alternative Compliance Method for Bird-Safe Design on the CC05 Project at 10200 S. De Anza Boulevard. The future occupant of the existing office building, Apple, intends to make major tenant improvements, including replacing all of the windows. The office building is located in an area of Cupertino that requires compliance with Cupertino Municipal Code Chapter 19.102.030, Bird-safe Development Requirements. Property owners/applicants may propose an alternate compliance method recommended by a qualified biologist to meet the requirements and intent of Chapter 19.102.030, which is to then be peer-reviewed by a third-party consultant. As described in the BR, Apple intends to comply with Section 19.102.030(C), Non-residential Indoor Lighting Requirements, and Section 19.102.030 (D), Bird-safe design Requirements. However, no additional bird-safe glass treatments are proposed as part of replacing the existing fenestration on the building, which is proposed as an alternative compliance method for Section 19.102.30 (B), Glass and Fenestration. The justification in the BR for not providing bird-safe glass or other fenestration treatments is their conclusion that there are no location-related or feature-related bird collision hazards associated with the proposed upgrades to fenestration, and no appreciable change in the amount of fenestration on the existing building. However, no details on the replacement window glass are provided in the BR, other than that highly reflective glass or highly transparent glass will not be used. SCOPE ENVIRONMENTAL COLLABORATIVE will provide a peer review of the BA by ESA. The peer review will focus on the conclusion in the BR related to compliance with Section 19.102.030 and whether any additional treatments are warranted. Conclusions in the BR regarding the location or feature-related risk of bird collisions will be reviewed, and the need for use of standard compliance treatments evaluated further. This will be based on the proposed window glass treatment and whether some modification is needed based on the assumed risk of collision. As part of the peer review, staff from ESA will be consulted on the proposed glass to be used in EXHIBIT - A EXHIBIT - C EXHIBIT B Schedule of Performance • Peer review due August 2, 2024. • Internal review, revision and finalized by staff. • Additional meetings will be held to discuss the findings after peer review is issued. 07/30/2024 Cook, Disharoon & Greathouse, Inc. 16 Bryson Drive Sutter Creek CA 95685 Lynda Reynolds-Brown (510) 437-1900 (510) 437-1979 lbrown@cdginsurance.com James A.
