V.REPORT FROM THE:SHERIFF'S OFFICE:
Captain Wilson reported that there were two bank robberies from the Bank of America in Cupertino within
a one week period.It was reported that at the Bank of America at Stevens Creek Blvd.and Finch Ave.
there was an estimated two-hundred thousand dollar loss.
Captain Wilson also advised that there were two separate m idems of persons banicadmg themselves in
their homes in the Monta Vista area of Cupertino.One of the individuals was d sfi m*W over recent fob
loss and the other had a history of mental illness.Both individuals surrendered with out inideat der
Sheriffs Department SWAT Team and hostage negotiators were silted out.
The Captain announced that Dep.Don Ray was humored as the 1994 Cupertino Deputy of the (ear by the
CL mber of Commerce.Dep.Bob Schiller who had been previously wo*Wg swing shift palvil in
Cupertino has been reassigned to the S.A.F.E.program and will work with a task force to truck sexual
predators.
Lt.Huber demonstraoed two new crime fighting tools now in use by the Cupertino Deputies.The Lt
demonstrated the PAS machine which is used to check b.a c.levels of drivers in DUI investigations.Lt.
Huber also demonstrated the"starlight"scope which aides the deputy in night time surveillance operations.
Both of these devices will readily accessible to the deputies according to Lt.Huber.
Captain Wilson explained that there recently was a study on the response time to calls for service for the
Sheriffs Office.He advised that the response time was very good for all levels and priorities of calls.

upcoming projects!torn Public Works that will affect ttatffic flows in the City such as the bridge widening
on De Anna Blvd.at Hwy 28t1.
X.NEW BUSINESS:
The Commission conducted nominations for tie 1995 year.The Commission nominated Vice-Chair
McAuliffe to the chair,and Commissioner Corr as the Vice-Chair.

Sgt.Grifffin advised that there was a recent cull of a possible cape in pro8ess at McM01*11 Pad.The rape was
unfounded, it actually was a group of juveniles playNg m the park slier dark. no Sheriffs Dept. has
continued to receive disturbance ells f,,gm sg the same in&vidud lira barricaded himself in his residence
in January.Sgt.Griffm reported that they are working with the individual to try and remedy the sitaatien.
There were recently a number of arrests fa burglary made in moo.There were two subjects wasted at
Minton's Lumber,locate on Smatopa-SuwWvale Rd.for burglary.Two stolen va Wles wren also recovered
at the scene.There were also three separate arrests at De Awa Collage for auto bu ry.According to Sgt.
Griffin,sine the mass at De Area College,auto burglaries have s"crely dead. '
Sgt.Griffm reported that the suspect m SunnyvaWs recent homicide may be in the Cupertino High School
area.There has been an extra large uniform presence in and around the high school.At this time no arrests
have been wade,but extra patrols are in the area.

The Chair attended the Mayor's Breakfast where Mayor Dean requested won from.the commissiom
regarding recommendations for response to citizen complains on various issues.

Commissioner Checkman attended a meeting in which the Jndersheriff was a featured.speaker.One of the
issues she explained was the number of deputes on disability and light-duty assignmeift and some of the
issues surrounding it.Commissioner Checlm im stated it was an informative meeting at various other
Shefiffs Department issues.

the accomplishments and goats of the SAC. Commissioner Corr shared fora he retrieved
from City Net regarding the rot earthquake drill.

Marie Moore aVended die meeting to discuss the City Merge"Plan. Marie discussed the
recent seminars she has beets attending related to the Emergency Pin. Commissioner Molloy
expressed three main concerns in the event of a disaster, water,depth of Fersonnal,and heavy
equipment mobeilhadon. Marie discussed her progress in revamping the City Emergency Plan.
she will tentatively return to another meeting in September to further advise the commission.
X.NEW BUSDIIRSS:
The Bicycle Advisory Committee will attend the next Public Safety Commission meeting. The
commission discussed various traffic problems throughout the city. The commission
recommends that the Tone/Rodrigues intersection island be removed to allow standard 4-way
traffic. The commission took a vote and there was unanimous approval for this issue. The
commission will oblige any requests to examine and make recommendations on a case-by-case
basis. Commissioner Corr would like to discuss the traffic portion of the General Plan, and
move the discussion to the June meeting.

TO: ALL LAW ENFORCEMENT AGENCIES AND CRIMINAL JUSTICE AGENCIES
The California Depaiment of Just (DOJ)is in the process of impletaenting a"90V fee-
based telephone service to provide infommuon on CahfornWs registered sex ofrmdas who have
victimized children. The service is the result of Assenbly Dill 2500(Alby),,known as the Child
Protective Act of 1994 (ems 94-867). The act provides the public with greater access to
information regarding persons who have been convicted of specified registered sex offenses.
Beginning July 3, 1995,the public will be able to obtain this information by calling the DOJ
"900"telephone service. The"900"telephone number is scheduled to be announced by the Attorney
General on Friday, June 30, 1995. In addition to the telephone service, a DOJ subdirectory of
specified registered sea offenders will be published and distributed to sheriff's and police
departments. This suix irectbry will include only sexual habitual offmdees as defined in Penal Code
(PC) §13885.4, Sexual Habitual Offender description. The subdirectory will be made available
January 1996 and will include photographs along with names,physical descriptions,ages,and any
distinctive tattoos,ems,or birdnnarks.
The telephone line will be tenninated on January 1, 1998,unless a later enacted statute
deletes or extends this date. The offenses disclosable through the DOJ "900" telephone service
include these penal code violations:

The DOJ "900"telephone service will be available to the public,Monday through Friday,
between 9:30 a.m. and 6:00 p.m. The projected cost for using the DOJ"900"telephone service is
a flat rate fee of$10 for information on two subjects. The information disclosed is designed to
protect children at risk. However,pursuant to Penal Code §290A(f)(I)A,this information can be
used for employment or volunteer positron appointments with supervisory or disciplinary power over
a minor or any person under his or her care.

(G) A statement that the number is not a crime hotline and that any suspected criminal
activity should be reported to local authorities;
(H) A statement that the caller must have reasonable suspicion that a child is at risk.
Following the preamble,the caller will be asked to provide some information. Information
used by DOJ to determine identification will be:

Lt.Huber distrilaWd and discussed hrglary Musts for the months of May and Jum Lt.Huber
commented that both residential and commercial burglaries were average for a two month period,but that
auto burglaries were higher that normal. The Lt.stated that auto burglaries are histancally more
abundant than commercial and residential burglaries.
There were two large scale arms for na=uc violations made m the city recently. One was a vehicle N
stop that resulted in the recovery of a stolen car and approximately ten-thousand dollais worth of
narcotics. In another instance,a pedestrian stop resulted in the seizure of four bindles of
methamphetamine.
Lt.Huber advised that there was a bomb threat received via the Interns at the Apple CoffiputeY buildings
located at Stevens Creek Blvd.and De Am Blvd. A thorough search of the bmbii4g was
however no bomb was located.
The Sheriff's Department and the California Highway Patrol are conducting an officer

The council has requested, as part of its goal setting, a review of street cdosureshutarictions
within the city.
BACKGROUND
Submitted is Exhibit A that identifies the diffift8t locations within the ditty that have some
form of tic flow restriction. In most eases dim were-ateeted for the sole purpose of
protecting neighborhoods from traffic intrimon and yvventing the use of neighborhood
streets as a bypass andtor for shortcut in Lieu of utilizing moor arterials.
CATEGORIES OF CLOSURES
The closurestrestm lions have been divined into four categories to d&& a Abe how the closures
were approved.
NEIGHBOR ISOD REQUESTS
The restrictions in this category are ditectly due to requests from the affected neighborhood
The city received petitions from the residents and conducted public hearings. The residents
expressed their needs and considerable evaluation was conducted to determine traffic flow,
volume,siveds,etc.
It is strongly suggested that these not be reevaluated unless the neighborhood expresses a
desire to do so. The residents on these issues tend to find themselves divided with emotional
energy that makes it difficult to deal on a technieal basis.
DEVELOPMENT CONDITION
Diveaters within this category were initiated because development was going to impact
residential neighborhoods. In these cases, protection plans were developed and approved
through the public hearing process alowing input from the residents who would be affected
most. The PacificaProrre and the Torre/Rodrigues restrictions took several months of
testimonies,resolution of neighborhood conflicts,and f nally the establishment of protection
devices that would preclude the city center traffic from utilizing Blaney Avenue, Pacifica,
and the neighborho,%d streets thereby forcing commuters to use De A,nz Boulevard and
® Stevens Creek Boulevard.

It is assumed that the mWn reason for the city council to request the evaluation of he closu ms
is due to the opening of route 85. Information from►Caltraus in6cates that Route

at capaci4, and any additional traffic will only congest the roadway. Parallel-shuts my

changes would occur.

Commissioner Molloy moved for resolution to recommend the mstalhmon'of bike lames on Stevens Creek

The commission discussed the recent develconents made on the Arian sidewalk issue on Phil Ln.
Mr.Armstrong was in attendance to provide farther information and a progress report to the commission.
He requested the City continue its'efforts iin trying to persuade the property owners to-P.io ar the county to
install a sidewalk to ease transit for students attending Irby Sedgwick School.
The commission moved to pass a resolution to the City Council to endorse the sidewalk issue at Sedgwick
School.

Element Policies in the Cupertitto General Plat.

States: The Fire District currently has an Emerge"Y Prga ed"ess
Coordinator assigned to the City of Cupertino to provide public
education relative to earthquake preparedness.
• 6.3-En=urage County im bore of firehamdPOU 'C&Mty

Status: The County General Plan Fire Hazard Policies Wmft wl k
address the issues of access, water supply, building materials, and
vegetation removal. Currently the Santa Clara County Fire
14arshai"s office reviews all new building developments and
condition prgects to have adequate access and water supplies as
required by the County Fire Code. The County Fire Code requires a
minimum Class-A roof covering for all buildings in the Hazardous
Fire Area in the unincorporated areas. Other Werior building
materials are not speciftCally regulated in the County areas. With
regard to vegetation abatement, the County is currently evaluating
the possibility of implementing a mandatory brush abatement
program for homes located in the unincorporated Hazardous Fire
Area.
• 6-4-Encourage outside agencies to pursue fuel mmagement practices.
Status: in 1996, the Fire District will propose that Cupertino
implement a mandatory combustible vegetation abatement program
in the Hazardous Fire Area. In 1997, the Fire District with propose
that the County of Santa Clara implement the same type of program
for the unincorporated areas of the County within the Central Fire
District.

Status: Access roads to all new hillside development projects are
evaluated by the Fire District to ensure that primary and, if deemed
necessary, secondary access roadways are adequate. Linder current
practice, existing roads world only be required to be upgraded to new
standards if the existing roads were considered to be severely
inadequate. The Fire District may at alternatives to upgrading
existing roads such as the provision of periodic turnouts along the
road and/or automatic fire sprinkler protection for the structures.

Status: Tdw Fire District is currently included in the architectural
and site review/approval process of the City. This allows early
conditioning of projects for fire and tife-safety concerns.

working relationship with the various water purveyors that service
the City of Cupertino.

water purveyors, the needs of the Fire District are typically addressed
whenever system upgrades occur.

District employees facilitate the delivery of these programs which
also include presentations of fire safety educationdisp&ays and
materials at many of the community events and festivals,

Status: The Fire District employs a full-time Amcidte Fire
Protection Engineer who reviews all new building and remodel
plans that are submitted to the City for building permit approval. In
addition, Deputy Fire Marshal personnel are assigned to perform
periodic and final inspections of all commercial construction
projects. These processes ensure that the minimum fire protection
standards of the Building and Fire Codes are met for all buildings
including multi-story.
• 6.15-Consider wiring five sprinklers in all reddenem
Status:
In the City of Cupertino only now residences with
inadequate access or water supplies are required to be equipped with
fire sprinklers. Currently, the residential sprinkler ordinances of
several other cities are being challenged in the courts by the building
industry. Although the Fire District acknowledges the effectiveness
of residential fire sprinklers and would support a residential fare
sprinkler ordinance, the District's current recommendation is to not
actively pursue the implementation of such an ordinance until the
existing ordinances have been upheld in the courts.
• 6-16•Consider new guidelines for protection in commercial and
industrial uses.
Status: The State of California adopts the Uniform Building Code
and the Uniform Fire Code and, through an amendment process,
creates the State Building and Fire Codes. These Codes are the
minimum building standards required throughout the State. The
Fire District believes that these State Codes provide for adequate fire

WHEREAS,the property owners and the sdml district have not been able to reach an
agreements and
WHEREAS,the subject property comprises a landlocked unincorporated area of
Clara County within the Ilmits of the City of Cupertino; and
WHEREAS, representatives of the City of Cupertino and the Cupertino Union School
District have appealed to both the property owners and the County of Santa Clara;and
WHEREAS,the process of seeking resolution has continued for more than a year;and
WHEREAS,the school community has requested assistance in appealing for a safe way to
ANIL school for the children.
Ip NOW,THEREFORE,BE IT RESOLVED that the Public Safety Commission of the City of
Cupertino supports the request of the D.J.Sedgwidc School community;and
BE IT FURTHER RESOLVED that the Cupertino City Council Is requested to also support
the community's request for safe way for children to walk and to bicycle to and from D.J.
Sedgwick Elementary School, including appropriate financial participation by the city; and
BE IT FURTHER RESOLVED that the City Count Is requested to adopt,and forward to the
office of County Supervisor Diane McKenna, a resolution requesting her Intervention and
support for safe waikirfg and bicycling access to D.J. 5edgwiok Elementary School Including
appropriate financial participation by the county.

As community members and parents, we are writing this letter on behalf of the
children and neighbors of Sedgwick Elementary School in Cupertino.The reason
for directing this letter to your attention is that the safety hazard we will address
is on p;,Roperty within County Jurisdiction.
Yn Mwch Of:!995, we wrote to you regarding a fence erected in August 1994,just
before the open'ng of our new schooL'TNS fence was on the property adjacent to
Sedgwiclk School, creating an extremely da-fermu traffic condition. The danger -►
stems from the absence of an OPPrOPrOte 8ide and t9k lane for the children
traveling to and from school on Phil Lane.'The result is that many of the 800
students attending Sedgwick are fob to waltz and ride their bicycles m a traffic
lane exposing them to severe danger.
While common sense alone would dictate a state of alarm to any reasonable
Per-son viewing the conditions at the site, the families in the area have an even
stronger reason for their concerns The Se�dgwkck School
. community has an
acute awareness of these dangers, hieing already experienced several traffic-
related bicycle accidents. These accidents involved a former student and a
current student of our schooL The first of these accidents resulted in severe
disability,brain damage and the eventual death of the student;the other caused
the injured child to be immobilized for months in a body cast and to start the
1994 school year in a wheelchair.
