Oral Communication Exhibits CC 3/ì/Ob ~ ~~è.tti~s. March 3, 2006 To the City Council of Cupertino, (I hope you read this!) I regretfully couldn't attend this evening but the following letter is for your consideration. I've been woken up numerous times by the slamming of steel at the Vallco Shopping Mall construction project. I've complained 7 times and it hasn't done any good to alleviate the problem. Please, don't read me wrong, I'm not against the Valko remodel project but at the expense of loosing my sleep at night is~. Mike Rohde of Vallco Fashion Park said that the hanging of steel would go on through the end of May. I understand that the City set a decibel reading of 60 to stay under, which really doesn't mean much to me because I'm still woken up when that loud slamming occurs. Where are my rights as a 23-year citizen of this city? I thought the City was to protect the rights of its residents. How can you, the City Council allow "disturbing the peace" of the residents of this city? What if it kept waking you up? Have you ever-heard how loud slamming steel is and then try it on a quite night. Once woken up, try going back to sleep with the continued banging. Recently, I was contacted by Mike Rohde, telling me that they've done everything they could to mitigate the noise level on his end and he was wondering what I could do on my end. I asked him to explain what he meant by that. He said that he lives next to a couple of barking dogs and when it becomes a problem; he turns on his stereo at a low volume to deaden the noise. He said Vallco was willing to buy me a stereo. I felt like I was being bought off. I don't need their money, I do need my sleep. For him to bribe me was totally wrong. Like I have to change my lifestyle to accommodate Valko's decision to work at night. Excuse Me! Why didn't Valko move the few tenants it has in that area, to do this major remodel during normal construction working hours. This is how it's normally done. Do I have to accommodate they're pocketbook here? Here you recently had a mishap, the crane falling through the building while people were inside. How can this City Council accept that and then still allow it? This area should have never had active stores underneath while a construction project was going on overhead, whether or not they working at the time. It didn't even take active construction work to risk people's lives. There should be no question in the minds of you, our responsible City Council Members. What if someone had gotten hurt, would your minds be changed then? Do we as a community have to wait till someone gets hurt, before you say that's enough? Where does each of you draw your line? I emphatically urge you to stand up for what is right and quit bending over to accommodate the contractor or landowner. You've already done that, by allowing them to build the theaters without other guaranteed concessions that you wanted. You, the City Council should re-evaluate your decision to allow the construction to continue as is, for two reasons. 1.) You are definitely disturbing the peace of nearby residents with the erection of steel. 2.) It is hazardous to allow people underneath active or inactive construction activity.
