Staff member Chao explained that this lot is irregularly shaped, but it was being treated
for development purposes as a corner lot. The neighboring lots have varying front
setbacks from 20 feet on the north to 12 feet on the east. The existing house on the site
has only an 8-foot setback at the closest point to the street. Staff supports this
application as proposed. The 15-foot setback is consistent with the neighboring houses
to the southeast and accommodates a good visual transition from one yard to the next.
Commissioner Giefer asked for clarification on the driveway length and for where on
the site the exception was being asked for. Commissioner Miller asked for clarification
on the ordinance setback requirements for a corner lot. The owner and applicant
explained that they were working hard with staff to design a home on the site. The
owner and his family will be occupying the house. A neighbor, Mr. Robert Hoose,
inquired about potential traffic concerns. He felt that the driveway might be too close to
the corner. A concerned resident, Jennifer Griffin, expressed a concern for the tree in the
front yard. She wanted to make sure it wasn't going to be taken down and also shared
the same traffic concern. Commissioner Giefer stated that she is also concerned about
the driveway placement in relation to the corner and wants additional clarification that
using it won't pose a safety hazard. Commissioner Miller supports the project since the
proposed setbacks are greater than the existing thereby increasing the visual "line of
site".
MOTION:
Commissioner Giefer moved to approve application R-2005-48 with the
condition that the front yard tree be identified to ensure it is not a heritage
oak. If is an oak tree, the application will need to be heard by the Planning
Commission. Also that the driveway placement be reviewed by the Public
Works Department to address the safety concerns
