A RESOLUTION OF THE CUPERTINO CITY COUNCIL ALLOWING
PLANNING PERMIT FEES TO BE WAIVED FOR CLIMATE VICTORY
GARDEN PILOT PROJECTS AND SANTA CLARA VALLEY WATER
DISTRICT LANDSCAPE REBATE PROGRAM PROJECTS
WHEREAS, in June 2021 the Santa Clara Valley Water District Board of
Directors declared a water shortage emergency condition, calling on water
retailers to achieve a 15% reduction in water usage from 2019 levels; and
WHEREAS, on August 17, 2021 the City Council issued a proclamation in
support of Local Water Conservation Efforts; and
WHEREAS, the City provides cost sharing funds to support the Santa
Clara Valley Water District's Landscape Rebate Program to promote efficient use
of water resources in Cupertino properties; and
WHEREAS, as part of the FY 2018-2019 and FY 2019-2020 City Work
Programs, the City Council launched a pilot program to streamline water
conservation projects by reducing barriers that property owners face to convert
their water -intensive grass to a drought -tolerant garden (Climate Victory
Gardens Pilot); and
WHEREAS, many large parcels in Cupertino were originally entitled with
a significant amount of irrigated turf that would require a modification to that
entitlement to convert the landscape, and most larger projects (i.e. projects not
located within an R1, RHS, or R2 zoning district) seeking to conserve water by
converting irrigated turf to drought -tolerant plantings would be subject to
planning permits and associated fees pursuant to Municipal Code Sections
14.15.020, 19.12.030, and 19.168.020 and the fee schedule (currently between
$4,710 and $13,223) for review processes; and
WHEREAS, City Council desires to reduce barriers for property owners to
participate in City -funded water conservation programs and improve cost
effectiveness of water conservation projects;

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino hereby authorizes the City Manager to waive planning permit fees for
Climate Victory Garden Pilot projects and Santa Clara Valley Water District
Landscape Rebate Program projects.
