CC 09-07-2021 Item No. 10 Westport Plan Check Services Agreement - New Attachment - Aug 17 staff report for Westport Plan Check Services Agreement CITY COUNCIL STAFF REPORT Meeting: August 17, 2021 Subject Consideration of a Professional Services Agreement for Plan Check Services for the Westport Cupertino Project. Recommended Action That City Council consider authorizing the City Manager to sign a Professional Services Agreement with ICCI and NV5 to provide plan check services for the proposed Westport Cupertino project in the amount not -to-exceed $300,000 and, consider approving Budget Modification #2122-161 increasing appropriations by $300,000 and increasing revenues by $461,000 in the Community Development Department’s Building Division (100-73-714). Discussion The Enhanced Senior and Family Living Project is the redevelopment of a 71,254 square-foot shopping center on the 8.1- acre site (7.9 net acres) with a previously approved mixed-use urban village consisting of 294 residential units and 20,000 square feet of neighborhood retail/commercial space. The proposed project would result in the construction of two residential/commercial buildings; Building 1 is a six- story building with 158 State-licensed, senior, assisted living, residential units and 17,600 square-feet of ground-floor retail/commercial space, Building 2 is a six-story building with 48 below market rate (BMR) affordable, senior, independent living, residential units and 2,400 square feet of ground- floor retail/commercial. In addition, 70 single-family residential townhouses, 18 single-family residential rowhouses, and a one-level, below-ground garage with 111 residential parking spaces and 80 retail parking spaces are proposed. The townhouses and rowhouses have attached garages with on-site, surface, visitor parking. The senior housing and the retail uses would utilize surface parking and the below-grade parking garage. Given the size of the project and because of the limited resources available from City staff, Plan Review Services will be contracted out to one or more qualified firms, and is a typical practice for relatively large projects within California local jurisdictions. The plan review of the application package is required to ensure compliance with the provisions of all State and local laws and regulations including, but not limited to, those for Fire and Life-Safety, Accessibility, Structural, Plumbing, Mechanical, Electrical, and Energy associated with all the buildings proposed for the Westport Cupertino project. The use of a firm to provide professional plan check services is a cost effective means of providing this service where demands exceed the amount of resources currently available through City staff. For the purposes of this contract, the Fire and Life-Safety review shall cover the following: egress, allowable building areas, fire resistive construction, smoke control, use separations and opening protection. Plan review and inspection services for automatic fire suppression and fire alarm systems will be covered under a separate permit issued by the Santa Clara County Fire Department. Cupertino received Statements of Qualifications from seven separate companies. A supplemental questionnaire prepared by staff was sent out to all seven companies. The firm or firms awarded with the contract will be evaluated by staff by a merit point system based on each of the firms submitted cost proposal and responses to the supplemental questionnaire. The City Manager will review and approve the final recommended selection resulting from the RFP purchasing process. Sustainability Impact No sustainability impact. Fiscal Impact Section: This item will increase appropriations and revenues in the Community Development Department’s Building Division (100-73-714).
