At their regular meeting of July 17, 1995, the Cupertino City Council granted a negative declaration
and approved this application per Planning Commission Resolution No. 4614 with the following
conditions:
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. Clean up trash and debris in -the east side parking area.
2. Provide building signage in the east elevation in accordance with the city sign ordinance.
SECTION ICI: CONDITIONS ADMTMST'ERED BY THE PUBLIC WQRKS DEPARTMENT
1. Patch and re -pave east side parking area as needed. Re -stripe parking lot, providing at least 36
parking stalls.
Please review conditions carefully. If you have any questions regarding the conditions of
approval, please contact the Department of Community Development staff members for
clarification. Failure to incorporate conditions into your plan set will result in delays at the plan
checking stage. If development conditions require tree preservations, do not clear the site until
required tree protection devices are installed.
The expiration date for the use permit is July 17, 1997. (Section 6.4 of Ordinance No. 652 as revised
by Ordinance No. 1136).

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO ALLOW A
SCHOOL, IN AN EXISTING SHOPPING CENTER
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use
Permit, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1) The proposed use, at the proposed location; will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public. health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Use Permit is hereby recommended for approval, subject to the conditions
which are enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application No. 6-U-95 as set forth in the
Minutes of the Planning Commission Meeting of July 10, 1995, and are incorporated by reference
though fully set forth herein.

At their meeting of July 17, 1995, the City Council of the City of Cupertino consider an
application for a use permit submitted by Target Homestead. The project is located at
20956 #E Homestead load.
The project is described as a use permit to operate a school in an existing shopping
center.
The decision of the City Council was to approve said project. The Planning Commission
by filing a Negative Declaration on this pr®,ject on August 1, 1995 has determined that
the project will not have'a significant impact upon the' environment and therefore, no
Environmental Impact Report has been prepared. The Negative Declaration has been
prepared pursuant to the provisions of State and City guidelines. A copy of said Negative
Declaration is available in the Office of the City Clerk, 10300 Torre Avenue, Cupertino,
California.
