THE PROPERTY IS LOCATED AT 22620 STEVENS CREED BOULEVARD At their regular meeting of April 3, 1995, the Cupertino City Council granted negative declarations; approved Application 2-Z-95 per Planning Commission Resolution 4594, conducted the first reading of Ordinance No.1685, and approved Application 4-U-95 per Planning Commission Resolution 4593 with the following conditions: SECTION III• CONDITIONS ADMINISTERED BY TIDE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBIT The recommendation of approval is based on Exhibits dated February 15, 1995, Revised (6 sheets), except as may be amended by the conditions contained in this resolution. MODIFICATION OF APPROVED DEVELOPMENT PLAN In the event that the applicant or subsequent property owner shall desire to make any minor changes, alterations or amendment of the approved development plan, a written request for revised development plan shall be submitted to the Director of Community Development.. Utilize Best Management Practices (BMPs)as required by the State Water Resources Control Board for construction activity which disturbs soil. Street lighting shall be installed and shall be as approved the City Engineer. Lighting fixtures shall be positioned so as to preclude glare and other forms of visual interference to adjoining properties, and shall be no higher than the maximum height permitted by the zone in which the site is located. Curbs and gutters, sidewalks and related structures shall be installed in accordance with grades and standards as specified by the City Engineer. a . TRAFFIC LIGHT AND SIGNS Traffic -light modifications shall be required and placed at locations specified by the City Engineer. 12. STREET TREES Street trees shall be planted within the public right-of-way and shall be of a type approved by the city in accordance with Ordinance 125. �c �1`t10 Grading shall be as approved and required by the City Engineer in accordance with Chapter #" 16.08 of the Cupertino Municipal Code. t 14. DRAINAGE Drainage shall be provided to the satisfaction- of -the City Engineer. Surface flow across public sidewalks may be allowed in the Rm1 .' R-2, and R-3 zones unless storm drain facilities are deemed necessary by the City Engineer. Development 'in all other zonmi districts shall be seared by on -site storm drainage facilities connected to the city storm drainage system. _If city storm drains are not available, drainage facilities shall be installed to the satisfaction of the City Engineer. 15. UNDERGROUND UTILITIES The developer shall comply with the requirements of the Underground Utility Ordinance No. 331 and other related ordinances and regulations of the City. of Cupertino, and shall coordinated with affected utility providers for installation of underground utility devices. The developer shall submit detailed plans showing utility underground provisions. Said plans shall be subject to prior approval of the affected utility provider and the City Engineer. 16.,, IMPROVEMENT AGREEMENT The project developer shall enter into a development agreement with the City. of Cupertino providing the payment of fees, including but no, limited to checking and inspection fees, storm drain fees, park dedication fees and fees for ,undergrounding of utilities. Please refer t6 the applicant's. description of and reasons for the changes and accompanying plans. 1. Different location for underground; fuel tank. The approved location is in the center ol'the parking lot (see page '1); the proposed location is under three parking spaces next to Stevens Creek Boulevard (see page 2). 2. Transformer located west of station (see page 2). No transformer was identified on the approved plans This is an electrical transformer with no noise generation. 3. South elevation height. The approved plati for the single story element was 13' (see page 3), the proposed plan is l 6' due to the increased'heght of the roof ridge (see page 4). 4. Floor plan revisions. Floor plans in the apparatus room section of the building have changed slightly, as shown the separate sheet titled "Comparison of Floor Plans." There are no problems with these changes, but are submitted for the record. 5. Different window/glass treatments on north and south elevations. north elevation openings (into the patio area) were proposed on the right side of the single story building (see page 3). vs. the left side (see "clouded" windows, page 4). They are removed, and the wall is softened with scoring and landscaping. Windows on the upper portion of the apparatus room have 01 changed slightly. one over the apparatus roll -up doors was removed and another over an entrance door was designed; window cleaning is done by the fire fighters, and the original windows were difficult to reach. 6. Louver screen on south elevation. A louver screen was approved at the rear of the apparatus room for air intake (see page 3). When the roof pitch was changed, air intake was achieved from above and louvers were not needed (see "clouded" area, page 4). 7. Trumpet vine on east wall. The approved plan shows trumpet vine on the east wal l and on both sides of the perimeter wall (see page 1). No wall plantings are proposed on the building permit plan, and are proposed for only the district's property on the perimeter wall. The wal I has been softened with scoring and downspouts that will have the appearance of supporting the roof (see page 3). 8. Approved tree at front property line. The approved plan indicates that a tree would be planted between the front walk and driveway on Stevens Creek ]boulevard (see page 1). The building permit plan proposes no tree. 9. The project is located at 22620 Stevens Creek Boulevard. The project is described as a;use permit to replace and expand an existing fire station, and rezoning of a .4 acre parcel from R1 (Residential Single-family) zone to BA (Public Building) zone. The decision of the City Council was to approve said project. The Planning Commission by filing a Negative Declaration on this project on. May 4, 1995 has determinedthat , the project will not have a significant impact upon the environment ,and therefore, ` no Environmental Impact Report has been prepared.
