SUBJECT: PLANNING COMMISSION ACTION LETTER - Application 13-U-94 (Mod.)
This letter confirms the decision of the Planning Commission, given at the meeting of August 14,
1996, approving a use permit modification, according to the enclosed copy of the Planning
Commission Resolution No. 4735.
Please note these conditions carefully. Subsequent submittal of materials for building permits
or other entitlements will be checked for compliance with the conditions listed in the
Resolution; discrepancies may result in processing delays. Please contact our office if you
have questions about this matter.
Please be aware that an appeal of this decision can be made within fourteen calendar days of
the decision. If this occurs, you %vill be notified of a public hearing which will be scheduled
before the Planning Commission.

RESOLUTION NO. 4735
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT FOR AN APPROXIMATELY 1,830 SQ. FT. FAST FOOD
RESTAURANT IN AN EXISTING RETAIL CENTER
SECTION is FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit,
as described in Section I1. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of
the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter;
and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That alter careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Use Permit is hereby recommended for approval, subject to the conditions which
are enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based and
contained in the public hearing record concerning Application No. 13-U-94 (Mod.) as set forth in the
Minutes of the Planning Commission Meeting of August 14, 1996, and are incorporated by reference
though fully set forth herein.

APPROVED EXHIBITS
The recommendation of approval is based on the site plan, floor plan and interior elevations dated
May 24, 1996 and numbered sheets A-1, A-2 and A-5.
2. APPROVED USE
The subject use permit grants the operation of a 1,830 square foot fast food establishment with a
maximum of thirty two seats and three peak hour employees.
3. ROOF MOUNTED EQUIPMENT
All roof mounted equipment shall not be visible from any public right of way. Further more, the
equipment shall not be produce a noise level in excess of that allowed by the Noise Ordinance
contained in the Cupertino Municipal Code.
