RECOMMENDING A MASONRY WALL ON THE PERIMETER OF THE FORGE
HOMESTEAD APARTMENTS
The Planning Commission finds that a masonry wall on the perimeter of the Forge
Homestead Apartments will provide greater noise and safety protection for the adjacent
properties in the long term. The testimony from the community regarding the need for a
masonry wall was taken into consideration in this finding. The Commission recommends
that the wall be aesthetically pleasing.
The subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning this recommendation are
set forth in the Minutes of the Planning Commission Meeting of September 9, 1996. and
are incorporated by reference as though fully set forth herein.

August 14, 1995, approving a use permit according to the enclosed copy of Planning
Commission Resolution No. 4633.

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A MINOR MODIFICATION OF A USE PERMIT
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for
modification of a Use Permit, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
has satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in
this matter, the application for Use Permit modification is recommended for approval subject to
the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and

Dear Ciddy:
This letter is a follow-up to our recent discussion regarding the above subject. As
you may be aware, the above referenced buildings have been completed and are signed off
for occupancy by the Fire District and Building Department. As we discussed, the
Planning requirements have also been met, with the exception that we have been unable to
complete the landscaping around the subject buildings, due to weather conditions. We are
currently working on the landscaping and weather permitting, we will complete it for the
subject building by February 15, 1997.
By way of information, our goal is to complete the entire project by April 1, 1997.

CITY COUNCIL ACTION - REVIEW OF ARCHITECTURAL AND DESIGN
MODIFICATION OF WOODEN SOUND BARRIER FOR FORCE-VIDOVICH
APARTMENT PROJECT LOCATED AT 20691 HOMESTEAD ROAD.
At the regular meeting of October 14. 1996, the Cupertino City Council approved the architectural and
design modification with the following amendments:
• The applicant shall be allowed to construct either a standard 8 ft. high masonry pre -cast wall with a
"Mediterranean style" imprint or the combination wood/concrete design. This wall shall be
uniform around the development.
• The combination of concrete and wood wall is approved as depicted on the Exhibits A and B. The
double i'x 6' vertical redwood lapped boards shall be a heartgrade redwood with tight knots. The
4' x 6' wood posts and the section between concrete may be constructed of brown -stained pressure -
treated Douglas fir.
• The kickboard is eliminated.
• Staff and the applicant shall work with Oddfellows representatives regarding the height of the wall
between the properties.

At the regular meeting of September 16, 1996, the Cupertino City Council directed that the perimeter
sound wall shall have concrete a minimum of 2 feet above the plane of the of the parking lot and the
remainder shall be redwood fence. The redwood portion of the fence shall be a minimum of 8 feet
above the parking lot.
