Application No. 2-U-94 was approved per Planning Commission Resolution No. 4513 with the following conditions: The recommendation of approval is based on the Site Development Plan set dated February 18, 1994, labeled Sheets At through A7. The Conceptual Landscape Plan dated February 17, 1994, labeled LI through L4, site sections dated March 9, 1994, lighting details, and I'vlonta Vista color scheme dated March 7, 1994, except as may be amended by the conditions contained herein. Page '_ 2. SITE LAYOUT FOR UNIT 24 Unit 24 shall be moved northerly so that the north side yard setback is at least 15 feet from the southerly edge of the adjacent parking bay. [t�ttiTalai�ti�w •. The four specimen oak trees shall be protected during all construction activities pursuant to the requirements of the Heritage and Specimen Trees Ordinance contained in Chapter 14.18 of the Cupertino Municipal Code. Two of the 24 units shall be made affordable to median and moderate income families. The developer shall enter into an agreement with the City and the units shall be deed restricted for a period of 30 years pursuant to the requirements contained in the Housing Mitigation Manual. • Signs shall be posted along all streets within the project stating that parking is restricted to marked spaces only. 6. FIRE SPRINKLERS Houses on Lots 9, 10, 15, 16, 21 and 22 shall be equipped with an approved fire sprinkler system subject to the approval of the Central Fire Protection District. 7. TREE SCIRFFNENG Staff shall work with the developer and the adjoining property owners on Oakleaf Place to develop a tree screening plan. The trees shall be oak or native evergreen species. Application No. I-TM-94 was approved per Planning Commission Resolution No. 4514 with the following conditions: The recommendation of approval is based on the Tentative Map dated February 23, 1994, (2 Sheets) of Application I-TM-94, except as may be amended by the conditions contained herein. INGRESS/EGRESS EASENIENTS The Applicant shall record an appropriate deed restriction and covenant running will) Ilse land subject to approval of the City Attorney, for all parcels which share a common private drive or private roadway with one or more other parcels. ROAD MAINTENANCE AGREEMENT A reciprocal maintenance agreement shall be required for all parcels which share a common private driveway with one or more other parcels within the tract. Said agreement shall be recorded in conjunction with recordation of the final map, and shall be subject to prior approval as to form and content by the City Attorney. The Homeowners Association documents and enabling declaration shall be approved by the Department of Planning and Development and by the City Attorney prior to recordation. These documents shall specify that the garages may be used for parking of vehicles only. Further, the documents shall specify that the City will employ applicable code enforcement actions necessary to ensure garages are kept clear for the parking of two vehicles. 6. STREET WID .NING Street widening, improvements and dedications shall be provided in accordance with City Standards and specifications and as required by the City Engineer. ) t4 CIRIVIa Ixelfill■ 6 301.41 M 1 t • Curbs and gutters, sidewalks and related structures shall be installed in accordance with grades and standards as specified by the City Engineer. Lighting fixtures shall be positioned so as to preclude glare and other forms of visual interference to adjoining properties, and shall be no higher than the maximum height permitted by the zone in which the site is located. ). FIRE HYDRANT Fire hydrants shall be located as required by the City. 10. TRAFFIC SIGNS Traffic control signs shall be placed at locations specified by the City. Street trees shall be planted within the Public Right of Way and shall be of a type approved by the City in accordance with Ordinance 125. 12. GRADING Grading shall be as approved and required by the City Engineer in accordance with Ordinance No. 1143. 13. STORM DRAINAGE Storm drainage shall be provided to the satisfaction of the City Engineer. The developer shall comply with the requirements of the Underground Utilities Ordinance No. 331 and other regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility devices. The developer shall submit detailed plans showing utility underground provisions. Said plans shall be subject to prior approval of the affected utility provider and the City Engineer. 15. IMPROVEMENT AGREEMENT The project developer shall enter into a development agreement with the City of Cupertino providing for payment of fees, including but not limited to checking and inspection fees, storm drain fees, park dedication fees and fees for undergrounding of utilities. Said agreement shall be executed prior to approval of the final map by City Council. PARK DEDICATION FEF. Park dedication fee shall be due at the time of the Improvement Agreement. The amount of the park dedication fee shall be determined based on the latest acreage fee adopted by City Council. 13. FIRE ACCESS LANES Emergency fire access lanes shall be recorded as fire land easements on the final map and shall meet Central Fire District standards. 19. DEDICATION OF WATER LINES The developer shall dedicate to the City all water lines and appurtenances installed to City standards and shall reach an agreement with San Jose Water Works for water service to the subject development. 20. PUBLIC UTI .ITV EASEMENTS The developer shall dedicate all public utility easements in accordance with the standards as specified by the City Engineer. The final location of the driveway on Stevens Creek Boulevard shall be subject to the approval of the City Traffic Engineer. Please review conditions carefully. If you have any questions regarding the conditions of approval, please contact the Department of Community Development staff members for clarification. Failure to incorporate conditions into your plan set will result in delays at the plan checking stage. If development conditions require tree preservations, do not clear the site until required tree protection devices are installed. The expiration date for the use permit is March 21, 1996. (Section 6.4 of Ordinance No. 652 as revised by Ordinance No. 1136). The expiration date for the tentative map is March 21, 1997. (Section 66452.6 of the Subdivision Map Act).
