14, 1994, approving a use permit according to the enclosed copy of the Planning Commission
Resolution No. 4515.

RESOLUTION NO. 4515
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT FOR A 3,000 SQ. FT. ADDITION TO AN EXISTING CHURCH
SECTION 1: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit,
as described on Page 1 of this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
WHEREAS, the Planning Commission finds that the application meets the following requirements:
That the use or uses are in conformance with the General Plan of the City of Cupertino, and are not
detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is
to be located.
That the property involved is adequate in size and shape to accommodate the proposed use.
That the proposed use will not generate a level of traffic over and above that of the capacity of the
existing street system.
That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general
welfare of persons residing or working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the neighborhood.
That the property holds a long tens parking agreement with Cupertino Union School District which
compensates for the 30 space parking deficit.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Use Permit is hereby approved contingent upon the approval and effective
date of the rezoning and subject to the conditions which are enumerated in this Resolution beginning on
Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the Public Hearing record concerning Application I-U-94 as set forth in the Minutes of
the Planning Commission Meeting of March 14, 1994, and are incorporated by reference though fully set
forth herein.

2. LANDSCAPING
The property owner shall complete a landscape plan in order to refurbish the planting in the parking
lot adjacent to Miller Avenue. The plan shall attempt to accomplish the following objectives:
Provide screen of the bus parking from visibility from Miller Avenue.
Preserve the large tree located behind the existing administration building.
Incorporate trees into the center aisle of the parking area, and along the north
and east property lines to provide screen of the parking lot from adjoining residents and
the junior high school play area.
No palm trees.
The landscape plan shall be approved by staff. The landscaping shall be planted in conjunction with
the construction of the addition. As shown on P2, approval is given for the removal of three
Melaleuca Linadifolia, Flaxleaf Paperbark and four g" Cypress trees. Replacement shall be nine, 24"
box trees of any type consistent with the Xeriscape Guidelines drought tolerant goals.
LIGHTING
Obtain approval within 45 days, for existing lighting, serving the play yard, both from the Building

USE LIMITATIONS
This use permit grants the construction of a 3,000 square foot classroom, office, library addition to
an existing parish hall. The classrooms shall be used in conjunction with the existing church
activities and activities listed on the West Valley Presbyterian Church letter dated January 22, 1994.
No other private use is approved.

Regarding Condition No. 3 of 1-U-94 (West Valley Presbyterian).
According to member Dr. Ken Wallace the attached building permit was issued by the Building
Department for the lighting. There was no plans issued with permit, it was an over the counter replacement
permit.
Because the lights are not significantly visually obtrusive and because the church is under the impression
that the permit they received was for the lights and because they subsequently purchase and installed the
lights under this premise, no further action is required.

At their meeting of March 14, 1994, the Planning Commission of the City of Cupertino
conducted a public hearing to consider a use permit filed by Nehemiah Architects, Inc.
The project is described as a use permit for a 3,000 sq. ft. addition to an existing
church located at 6191 Bollinger Road.
The decision of the Planning Commission was to approve said project. The Planning
Commission by filing a Negative Declaration on this project on March 21, 1994 has
determined that the project will not have a significant impact upon the environment and
therefore, no Environmental Impact Report has been prepared. The Negative
Declaration has been prepared pursuant to the provisions of State and City guidelines.
A copy of said Negative Declaration is available in the Office of the City Clerk, 10300
Torre Avenue, Cupertino, California.
