CC Resolution No. 05-206 RESOLUTION NO. 05-206 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO RECEIVING THE DECLARATION OF ELECTION RESULTS FOR THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2005 WHEREAS, the City of Cupertino conducted a general municipal election on November 8, 2005, to elect three members to the City Council; and WHEREAS, the City of Cupertino conducted a special municipal election, consolidated with the November 8 election, to consider three measures; and WHEREAS, the Registrar of Voters of the County of Santa Clara, State of California, has conducted the official canvass of the returns of said election in accordance with the appropriate provisions of the Election Code of the State of California; and WHEREAS, the Registrar of Voters has certified that the attached documents (Exhibits A and B) are full, true and correct statements ofthe votes cast at said election; and WHEREAS, the City Council declares that the candidates who received the most votes for the position of City Council member were Patrick Kwok, Dolly Sandoval, and Orrin Mahoney; and WHEREAS, the City Council declares that the three measures did not receive a majority of votes and thereby failed. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby receives the Certificate of Election Results of the General Municipal Election, November 8, 2005. A Uniform District Election Law election was consolidated with a Special Statewide Election held in the County of Santa Clara, in the CITY OF CUPERTINO, on November 8, 2005 for the purpose of electing three (3) Council Members to the Governing Board. 2. The official canvass of the returns of this election was conducted by the Office of the Registrar of Voters in accordance with the appropriate provisions of the Elections Code of the State of California. 3. The Statement of Votes Cast, now on file in my office, shows the number of votes for each candidate for the Governing Board of the CITY OF CUPERTINO and in each of the precincts and that the total shown for each candidate are true and correct. A Unifonn District Election Law election was consolidated with a Special Statewide Election held in the County of Santa Clara, in the CITY OF CUPERTINO, on November 8, 2005 for the purpose of submitting the following measures to the voters: A Shall the City of Cupertino adopt an amendment to the General Plan concerning housing density? B Shall the City of Cupertino adopt an amendment to the General Plan concerning building heights? C Shall the City of Cupertino adopt an amendment to the General Plan concerning building setbacks? 2. The official canvass of the retums of the election was conducted by the Office of the Registrar of Voters in accordance with the appropriate provisions of the Elections Code of the State of California. 3. The Statement of Votes Cast, now on file at my office, shows the whole number of yotes cast for Measure A, Band C in each of the precincts and the total shown is true and correct.
