BACKGROUND On February 17, 2004, Council authorized the City Manager to execute an agreement with the California Department of Transportation (Ca/trans) that allowed the City to receive $600,000.00 in 2003-2004 State Bicycle Transportation Account (BTA) grant funds to comprise a portion of the local funds required to finance the Mary Avenue Bicycle Footbridge project. At that time, Staff had projected that construction ofthe bridge would be completed by early 2006. The expiration ofthe 2003-2004 BT A funds, set by the agreement to occur on June 30, 2006, appeared to be compatible with the project schedule. With the completion of the 35% level of design in September 2004, however, the estimated cost of the project increased significantly above the original estimate. Due primarily to extreme and continuing increases in concrete and steel construction materials and diesel fuel, and an increase in the required depth of the bridge foundation, the higher estimated cost of the project made it necessary for the City to seek additional funds to complete the project. Based upon Council's February 1, 2005, authorization, Staff sought and received a commitment from the Santa Clara Valley Transportation Authority (VT A) for an additional $1,560,000.00 for the project. On that date, Council also committed an additional $75,000,00 in City funds to the project and authorized Staff to pursue up to $500,000.00 more in future cost escalation contingency funds for the project. The impact ofthe higher estimated costs increased the original project budget of $7,115,000.00 by 30% to the current $9,250,000.00, including cost escalation contingency. Obtaining an independent verification of the new cost estimate and seeking the additional funds required, in turn, entailed significant delay in the progress of the project design and review, so that the current schedule projects completion of the project in 2007. The extended schedule makes it necessary to extend the life of the 2003-2004 BTA funds beyond their current June 30, 2006, expiration. In order to do this, the City must enter into a Cooperative Work Agreement Printed on Recycled Paper (3-1 (CW A) with the California Department of Transportation. While not a formal signed agreement, the CW A is a vehicle employed by the California Department of Finance to extend funds that would otherwise lapse, through commitments from the funded agency and Ca/trans to complete the funded work on a new agreed-upon schedule. FISCAL IMPACT Authorizing the Director of Public Works to enter into a CWA for the 2003-2004 BTA funds will allow the life of the funds to be extended, thereby allowing the funds to remain available for the City's Mary Avenue Bicycle Footbridge Project. STAFF RECOMMENDATION Staff recommends that City Council adopt Resolution No. 06- ù/Á. ,authorizing the Director of Public Works to enter into a Cooperative Work Agreement (CW A) with the California Department of Transportation to extend the life of2003-04 Bicycle Transportation Account (BT A) grant funds in the amount of $600,000.00 for the Mary A venue Bicycle Footbridge Project. ~bY~ ~ - ,AUf. Knapp City Manager r 3- d- RESOLUTION NO. 06-012 DRAFT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ENTER INTO A COOPERATIVE WORK AGREEMENT WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION TO EXTEND THE LIFE OF 2003-2004 BICYCLE TRANSPORTATION ACCOUNT GRANT FUNDS FOR THE MARY AVENUE BICYCLE FOOTBRIDGE WHEREAS, fiscal year 2003-2004 Bicycle Transportation Account grant funds in the amount of $600,000.00 approved by the California Department of Transportation for the Mary Avenue Bicycle Footbridge Project are set to expire on June 30,2006; and WHEREAS, due to the impact of higher estimated project costs and the ensuing delays entailed in securing addition funds necessary to complete the project, the schedule for the Mary A venue Bicycle Footbridge now projects a project completion date in 2007; and WHEREAS, in order to extend the life of the 2003-2004 Bicycle Transportation Account grant funds the City must enter into Cooperative Work Agreement with the California Department of Transportation; NOW, THEREFORE, LET IT BE RESOLVED that the City Council of the City of Cupertino hereby authorizes Director of Public Works to enter into a Cooperative Work Agreement with the California Department of Transportation to extend the life of the 2003-2004 Bicycle Transportation Account grant funds in the amount of $600,000.00 for the Mary Avenue Pedestrian Footbridge Project.
