APPROVAL OF Tf� FUNDAMENTAL ARCHITECTURAL DESIGN CONCEPT FOR
A PARKING STRUCTURE LOCATED ON TI� SEARS PARKING LOT
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as
described on Page 1 of this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support said applications; and
WHEREAS, the Planning Commission finds that the application meets the following requirements:
a) That the use or uses are in conformance with the General Plan of the City of Cupertino, and are not
detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be
located.
b) That the property involved is adequate in size and shape to accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over and above that of the capacity of the existing
street system.
d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare
of persons residing or working in the neighborhood of such proposed uses, nor injurious to property and
improvements in the neighborhood.
NOW, TI-�REFORE, BE IT RESOLVED:
That after careful consideradon of maps, facts, exhibits, testimony and other evidence submitted in this matter, the
application for Use Permit is hereby recommended for approval, subject to the conditions which are enumerated on
Page 2 of this Resolution; and
That the subconclusions upon which the findings and conditions specif ed in this Resolution are based and
contained in the Public Hearing record concerning Applicadon 10-U-92 as set forth in the Minutes of the Planning
Commission Meeting of January 11, 1993, and are incorporated by reference as though fully set forth herein.

SECTION III: CONDITIONS ADNIINISTERED BY THE COMMiJIVITY DEVELOPMENT DEPARTMENT
1. The Commission recommends a design theme represented by a drawing labeled Altemative C subject to the
following modifications and design studies which will be reviewed in the context of a detailed architectural
review by the Planning Commission and City Council:
a. The openings between columns on the lower level of the south elevation (Stevens Creek Boulevard
frontage) shall be filled with height, colored, reflective materials. The intent of this condidon is to
emulate a retail building rather than conventional parking structure.
b. The final azchitectural presentadon should provide an alternadve design which includes an arch design
for the horizontal beams located between the lower level columns.
� c. The building materials shall be high quality. Finished concrete shall be used rather than stucco. The
' concrete should be a light color.
( d. The pedestrian access shall be incorporated into the tower elements. The tower elements should be shifted
to the east to facilitate a covered walkway connecting the two towers and thence to the Sears building and
Stevens Creek Boulevard bus stop. The design shall incorporate a bus stop and arched (elevated) roof
over the driveway isles. The bus shelter design must not disrupt existing street trees. The final walkway
design shall not give the impression that pedestrians must enter the garage other than the pedestrian
oriented tower elements.
e. The horizontal fascia and balustrades on the second and third levels shall include rectangulaz shaped
landscaping containers.
� f. Architectural detailing shall be used on all four sides of the structure.

APPROVAL OF TF� FINAL ARCHITECTURAL, LANDSCAPING AND SIGN PLANS FOR
T'HE "SEARS" PARKING STRUCTURE LOCATED ON STEVENS CREEK BOULEVARD

I WHEREAS, the City Council directed the Planning Commission to informally review the detailed drawing of the
� parking structure and submit a report to the City Council, and
� WHEREAS, the Planning Commission previously reviewed the parking structure concept and design concept and
determined both to be in conformance with the General Plan.
� NOW, TI�REFORE, BE IT RESOLVED:
� That after careful consideradon of exhibits and public discussion, that the Planning Commission recommends
approval of the final design plan pursuant to the conditions enumerated below:
1. APPROVED EXI-IIBITS
The recommended approval is based upon the elevation exhibit describing the east and south elevations dated
I January 25, 1993, site and landscaping drawing dated January 25, 1993, covered walkway dated January 25,
1993, cross section dated January 25, 1993 and perspective drawing of southeast comer dated January 25,
1993. The approval of said plans are modified by addidonal conditions contained herein.

� 2. LATTICE DESIGN
1 The lattice installed between the column openings shall be a light color. The plant materials which grow on
� the lattice shall consist of light colored leaves. The plant materials may include flowers to add color to the
building. Staff shall approve the plant materials.
� 3. ORNAMENTATION
1
The final design describing detailed omamentation of columns, planter boxes, connecting bridges, and other
architectural detailing shall be approved by staff.
4. LIGHTING
�
The lighdng plan shall be approved by staff. The structure shall be well lighted to provide comfort and
security to patrons.
� 5. BUS STOP
I The final design for the bus stop shall be approved by staff following consultation with the Santa Clara County
� Transit District. The design of the bus stop may include a different roof shape than described on the approved
exhibit. A rounded or "umbrella" shape which emulates the tree canopy will be considered. Said design shall
not cause significant removal of existing tree canopy.

6. SIGN PROGRAM
( The sign program for the parking structure shall substantially match the size and locadon of signs as shown on
the architectural elevadon exhibit dated January 25, 1993, with final approval by the Department of
Community Development.
Additional display cases may be added with final approval from the Director of Community Development.

L The Sign Program for the parking structure shall be additional to the sign program as contained in
Application ASAC 51,908.2.
� 7. WALKWAY ROOF
! The walkway roof should be constructed with solid material to provide protection during inclement weather.
` ff a metal roof is the only practical solution, various materials should be explored and presented to City
Council for final approval.
� 8. SOUTH AND WEST ELEVATIONS
The proposed planters located on the east elevation shall be repeated on the south and west elevations.
