At their regular meeting of October 19, 1992, the Cupertino City Council
granted a Negative Declaration and approved your application per Planning
Commission Resolution No. 4419 with the following conditions:

Awrzmd Uses
The subject Use Permit approves a retail dry cleaning facility occupying a
space of 1,800 square feet. The hours of operation and deliveries shall
conform to the City of Cupsrtino Municipal Cade. Only a "closed loop" dry
cleaning machine is allowed.

The property owner shall apply and receive a approval for a center -wide
sign program. The tenant must conform to this program prior to
occupation.

visible), as depicted in the elevation plan dated August 26, 1992.

Prior to issuance of a building permit for interior improvements, an
acoustical report from a staff approved noise consultant shall be
generated. The report shall confirm that the equipment will not generate
a noise level exceeding the Municipal code for all adjoining land uses.
If it is shown that the noise level exceeds the Municipal Code maximums,
then the equipment shall be placed within a staff approved enclosure to
bring the noise level into conformance. This enclosure may not be Visible
frtm adjoining properties and shall not protrude above the roof line as
reflected in the elevation plan. If these objectives of Visibility cannot
be achieved, the equipment shall be located within the interior of the
structure.
The following must be provided prior to issuance of the building permit
and prior to occupancy:
1. Valid permit from Bay Area Air Quality Management District (WAGM).
2. Central Fire Protection District permits for all fire safety and
hazardous materials containment.
3. Valid permit fiat the State Department of Ztxics for the mobile
company transporting the filter from the closed loop machine.
In addition to the above listed conditions, the applicant shall be
required to have Venting on the roof and to limit the height of the stacks
so that they are below the roof line.

WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the applicant has met the burden of proof required to support
said application.; and
RMUAS, the Planning commission finds that the application meets the
following requirements:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrimental to existing uses or to
uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
Property and improvements in the neighborhood.
NOW, TEE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon whidi the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 7-U-92 as set forth in the Minutes of the Planning
Comsmdssion Meeting of September 14, 1992, and are incorporated by
reference as though fully set forth herein.

Project Description:
This Use Permit application is to allow an 1,800 square foot on premise dry cleaning business in
an existing retail building.
Findings of Exemption (attached required findings):
The proposed dry cleaning business is located in an existing shopping center in an urbanized and
developed area. It is not located near any streams or water course, or near any hillside or open
space areas. The use will not have any potential for adverse effect on fish and wildlife resources
or the habitat upon which the wildlife depends.
Certification:
I hereby certify that the lead agency has made the above findings of fact and that based upon the
initial study and hearing record the project will not individually or cumulatively have an adverse
effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code.
