At their regular meeting of September 21, 1992, the Cupertino City Council
approved your application per Planning Comni.ssion Resolution No. 4424 with
the following conditions:

The reoamtendation of approval is based on the plan consisting of one
sheet labeled site Plan of 6-U-92, except as may be amended by the
conditions stated in this Resolution.

The subject Use Permit grants the operation of a 4,990 sq. ft. pet
shop as outlined in the applicant's letter of June 29, 1992, except as
amended by the conditions herein.

RECOMMMMING APPROVAL OF A USE PERMIT TO OPERATE
A PEP SHOP IN AN EXISTING SHOPPIIJG CaiTER
SECPION I • FIIdpINGS
VAUMEAs, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 1 of this Resolution; and
WB RFAS, the applicant has met the burden of proof required to support said
application.; and
WHEREAS, the Planning Commission finds that the application meets the following
requirements:
a) That the proposed use and existing uses are in conformance with the
General Plan and with the Zoning designation for the site.
b) That the property and building area is of an adequate size and shape
to accommodate the proposed use.
c) Diat the proposed use is otherwise not detrimental to health, safety,
peace, and general welfare of Persons residing or working in the
neighborhood of such a proposed use.
d) The subject use requires the same Parking as the previous use and no
anticipated parking problems are expected.
NOW, THMEFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other
evidence submitted in this matter, the application for Use Permit is hereby
recommended for approval, subject to the conditions which are enumerated in
this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in
this Resolution are based and contained in the Public Hearing record concerning
Application 6-U-92 as set forth in the Minutes of the Planning Coum ssicn
Meeting of September 14, 1992, and are incorporated by reference as though
fully set forth herein.
