%NMEAS, the Planning C aWalssion of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution; and
WHMEhS, the applicant has met the burden of proof required to support said
application.; and
MmAS, the Planning Ccami.ssion finds that the application meets the
following requirements:
a) 4hat the use or uses are in confarmanoe with the General Plan of the City
of Cupertino, and the Specific Plan for D6orrta Vista, and are not detrimental to
existing uses or to uses specifically permitted in the zone in which the
proposed use is to be located.
b) That the property involved is adequate in size and shape to aaocmmodate the
proposed use, subject to satisfactory c%mpletion of those steps necessary to
secure off street parking and appropriate ingress/egress easement and
maintenance agreement.
c) That the proposed use is otherwise not detrimental to the health, morals
and general welfare of persons residing or working in the neighborhood of such
proposed uses, nor injurious to property and improve ants in the neighborhood.
That after careful consideration of maps, facts, exhibits, testimony and other
evidence submitted in this matter, the application for Use Permit is hereby
reca mien ded for approval, subject to the conditions which are enumerated in
this Resolution beginning on Page 2 thereof; and
That the suubconclusions upon which the findings and conditions specified in
this Resolution are based and contained in the Public Hearing record concerning
Application 14-U-91 as set forth in the Minutes of the Planning Commission
Meeting of February 10, 1992, and are incorporated by reference as though fully
set forth herein.

The developer shall supply a comprehensive improvement plan to the City
Engineer which would encompass parking and aisleway layout dimensions,
traffic control signs, street trees, drainage, appropriate lighting and
installation of landscaping.
4. UNDEPEROUND U1ZLTITES
The applicant shall be responsible for complying with the requirements of
the Underground Utility Ordinance No. 331 and other related ordinances and
regulations of the City of Cupertino, and shall make the necessary
arrangements with the utility companies involved for the installation of
said facilities. The applicant shall subuit a detailed plan showing
utility underground provisions. (This plan must have prior approval of the
utility companies and the City Engineer.)

The recommendation of approval is based on the Sheets A (dated 12/6/91), 2
(6113/91), 3 (dated 4/30/91), respectively, of Application 14-U-91, except
as may be amended by the Conditions contained in this Resolution.

In the event that the applicant or subsequent property owner shall desire
to make any mirror c3-angess, alterations or amendment of the approved
development plan, a written request or revised development plan shall be
submitted to the Director of Community Development. If the Director makes
a finding that the changes are minor and do not result in a material
affect upon the appearance or function of the project, said changes may be
certified on the revised plan. If approval of said changes is withheld,
the applicant may appeal to the Planning commission.
If the Direct -.or finds that the requested changes are material, such
changes shall be referred to the Planning Commission far approval. If the
changes are denied by the Planning Commission, the applicant may appeal to
the City Camail as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may be
made to the City Council by any interested party. Further, any Member of
the city Council may request a hearing before the City Council regarding
said approved changes. Said request shall be made within ten (10) days
from the date of approval of said changes by the Planning Commission.
7. PROPERTY USE C3NSiRAINIS
The subject use permit authorizes operation of a financial services office
use within an 2,190 sq. ft. area of the building. 675 sq.ft. of the rear
portion of the building shall be removed prior to occupying the building.
No more than two office spaces are permitted in an 852 sq. ft. area.
storage is permitted in the remaining 1,338 sq. ft. area. Electricity to
storage areas shall be for lights only, no wall outlets are permitted.
Storage areas shall not have carpeting. All existing interior walls and
partitions other than far offices shall be removed. The storage area may
not be partitioned into separate rocas.
Business operations involving frequent delivery truck trips to and from
the site are prohibited.
The interior stairs leading to the loft shall be removed. The loft area
shall not be used for storage.
The maximum number of on -site employees is two.
Intensifying the office use may be considered if reciprocal ingress/egress
easement is granted by the owners of the Monta Vista Inn to the rear
portion of the lot and additional parking spaces are provided.

A masonry wall shall be provided on the project's nutural boundary with
residentially zoned or used property. Said wall shall be at least six
feet in height as measured from highest adjoining grade.
Tile final architectural and landscape plans shall be subject to informal
ASAC review prior to cawenoement of use Permit activity. The Conmmittee
shall evaluate the paint color and the possible addition of fenestration
detailing on the south elevation to reinforce the building's context with
the Monta Vista Design Guidelines.
The final landscape plan shall incorporate planking at the front of the
building, plants with a vertical growth habit along the east building
wall, adequate landscaping along the rear property line to screen the use
from adjoining residential properties, and provision of landscaping within
the corner planting strip between the Peninsula Boulevard abandonment
area. Said landscape improvements shall o:mply with the Xeriscape
Guidelines. The property warmer shall be responsible to obtain all
necessary encroachment permits from agencies with jurisdiction.
Parking shall be provided at a ratio of 1 space/285 sq. ft. gross office
floor area and 2,000 sq. ft. storage area.
A parking and circulation agreement among property owners of APN's
326-25-14, 37, 41, 43 and 60 shall be agreed upon and recorded prior to
commence ent of business activity. The agreement shall consist of the
following:
1) The applicant will provide a canlaehensive improvement plan.
2) The applicant will pay for inprovements in the right-of-way.
3) The applicant and adjacent property owners will enter into an
agreawnt whereby incgress and egress easements are granted.
4) All property owners will agree to equally divide future
landscaping surface maintenance costs.
Sixty days following city council approval of this use permit, the
property owners shall sign and record an agreement. If agreement is not
reached, a hearing to consider revocation of Use Permits 23-U-79 and
21-U-73 shall be scheduled at the next available Plarmlirxg C=nissiOn
Meeting.
11. FIRE/EMDIM CODE SAFETY
Prior to cmm encement of business activity under the subject use permit,
the property owner shall present to the Community Development Director
written evidence from the city of Cupertino Building Official and the
Central Fire Protection District, that all building life safety/health
violations and deficiencies have been corrected.
All doors and windows on the east elevation and the westerly door on the
north elevation shall be removed.

b) Only office spaces labeled 1 and 2 as depicted on sheet 3 dated April
30, 1991 of 14-U-91 are permitted to be used as offices.
c) Storage is permitted in the remaining 2,368 sq. ft. area.
d) Electricity to storage areas shall be for lights only, no wall outlets
are permitted.
e) Storage areas shall not have carpeting.
f) The rear 2,386 sq. ft. storage area may be partitioned with wire mesh
or other similar materials and supported with non-coanbustible
materials. Alternately, storage cells with a maximum width of 6 ft. may
be lined with sheetrock.
g) Business operations involving frequent delivery truck trips to and from
the site are prohibited.

If the Director finds that the requested changes are material, such
changes shall be referred to the Planning CQnmissiM for approval. If
the changes are denied by the Planning Commission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may
be made to the City Council by any interested ply- Further, any
Member of the city Council may request a hearing before the City

7. PROMM USE
The subject use permit authorizes operation of a financial services
office use subject to the following:

16, 1992, are permitted to be used as offices. storage is
permitted in the remaining area.
c) Electricity to storage areas shall be for lights only, no wall
outlets are permitted.

A nasonry wall shall be provided on the projects mutual boundary with
residentially zoned or used Property. said wall shall be at least six
feet in height as measured frtm highest adjoining grade. Tine
construction of this wall may be delayed until activity occurs at the
rear of the site.

The final architectural and landscape plans shall be subject to
informal. ASAC review prior to commencement of use permit activity.
Tine committee shall evaluate the paint color and the possible addition
of fenestration detailing on the south elevation to reinforce the
building's context with the Nionta Vista Design Guidelines.
The final landscape plan shall incorporate planting at the front of
the building, plants with a vertical growth habit along the east
building wall, adequate landscaping along the rear property line to
screen the use from adjoining residential properties, and provision of
landscaping within the corner planting strip between the Peninsula
Boulevard abandonment area. Said landscape iup ovarents shall amply
with the Xeriscape Guidelines. The property owner shall be
responsible to obtain all necessary encroachment permits from agencies
with jurisdiction.

Parking shall be provides at a ratio of 1 space/286 eq. ft. gross
office floor area, 1 space/2,000 sq. ft. storage -area, and 1 customer
space.
A parking and circulation agreement among property owners of M Ns
326-25-14, 326-25-37, 326-25-41, 326-25-43 and 326-60 (entire
page -office condaw um) shall be agreed upon and recorded prior to
co m enoemmt of business activity. The agreement shall consist of the
following:
1) The applicant will provide a comprehensive improvement plan.
2) The applicant will pay for improve ants for the entire
former Peninsula Avenue right-of-way.
3) The applicant and adjacent property owners wi.l1 enter into
an agreement whereby ingress and egress easements are
4) All property perty owners will agree to equally divide future
landscaping surface maintenance costs.
Sixty days following City Council approval of this use permit, the
property owners shall sign and record an agreement. if agreenmennt is
rot reached, a hearing to consider revocation of Use Permits 23-U-79
and 21-U-73 shall be scheduled at the next available Planning
Commission meeting.
If the City initiates the revocation process, the applicant shall be
released from the entire cost of any street inprovsnents; if one
adjamnt property owner enters into a reciprocal ingress/egress
agrewent with the applicant, the applicant's obligation exteaxis to
that property.
Prior to oanmenow ent of business activity under the subject use
permit,- the property owner shall present to the Community Development
Director written evidence %ran the City of Cupertino Building Official
and the Central Fire Protection District, that all building life
safety/health violations and deficiencies have been corrected.
All doors and windows on the east elevation and the westerly door an
the north elevation shall be removed.
