At their regular meeting of Novatlber 18, 1991, the Q3pertim City Council
granted a Negative Declaration and approved your application per Planning
Caim(ission Resolution No. 4381 amended with the following o=z bans:
The approval is based on the Site Plan and Floor Plan dated August 12,
1991 of Application 10-U-91, except as may be amended by the
canditions contained herein.
in the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of ConEmmity Development. If
the Director makes a finding that the changes are mirior and do not
result in a material effect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld„ the applicant may appeal to the
Planning Ccmnission.
If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Conmisson for approval. If
the changes are denied by the Planning Commission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Oamtissicn, an appeal may
be made to the City Council by any interested party. Further. any
Member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said changes by the
Planning Commission.
Land Use intensity shall be limited to an intensity that will not
generate more than sixteen (16) one way trips Per acre wing the peak
traffic hour. For purposes of ensuring ccmpliance with the Traffic
Intensity Performance Standard, the following accounting of trips is
hereby incorporated into the project approval:

In the event that a development does not utilize the full 16 trips per
acre allotted by the trip end performance standard, the owner of
record shall have the ability to retain, sell or transfer trips with
other property owners within the Traffic intensity Performance
standard Area. All sales or transfers of trips shall be filed with
the Director of Planning and Development and the City Clerk. 1b sale
or transfer shall be considered finally consummated until a use permit
has been approved for the property to whizh the trips are to be
applied. The developer shall provide proof that a covenant was
recorded describing the trip acre constraint and the total nunber of
trips allocated to the particular development prior to occupation.

The applicant is required to obtain a BAAHW permit regarding the
regulation and use of chemicals into the atmosphere prior to
occupation. Particular attention shall be applied to the use of
perchlorethylene.

Concurrently with review of building permits, the applicant- shall
downstrate compliance with fire safety eTupneat requirements related
to the hazardous materials as specified by the city in concurrence
With Central Fire Protection District.
8. NOISE —
Any machinery, blowers or other externally mounted equipment shall not
create a decibel level exceeding those outlined in Section 10.48.040
of the Cupertino Municipal code.
9. The stacks on the roof shall have a maximum height of four (4) feet.

SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 1 of this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support said
application; and
WHEREAS, the Planning Ccmanission finds that the application meets the
following requirements:
- Zhe project site is in conformance with the Traffic Intensity
Performance Standard.
- The proposed use is in conformance with the General Plan and Zoning
designation for this site.
- Zhe use of perchlorethylene will only be allowed if the Chranioal is
used within a "closed loop,' machine and if the Bay Air Quality
Management District issues a permit based upon air omissions not
exceeding cancer causing levels.
NOW, TEMIEEM, BE IT RESOLVED:
That after careful consideration of snaps, facts, exhibits, testimony and ether
evidence submitted in this matter, the application for Use Permit is hereby
reccamended for approval, subject to the conditions which are emmietated in
this Resolution beginnim on Page 2 thereof; and
That the subconclusionhs upon which the findings and eonditioms specified in
this Resolution are based and contained in the Public hearing record concerning
Application 10-U-91 as set forth in the Minutes of the Planning Commission

The approval is based on the Site Plan and Floor Plan dated 8/12/91 of
Application 10-U-91 except as may be amercled by the conditions ocntained
herein.
In the event that the applicant or subsequent property owner shall desire
to make any minor changes, alterations or amendment of the approved
development plan, a written request or revised development plan shall be
submitted to the Director of community Development. If the Director makes
a finding that the changes are mince' and do not result in a material
affect upcnn the appearance or funiction of the project, said changes may be
certified on the revised plan. If approval of said changes is withheld,
the applicant may appeal to the Planning Commission. .
If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Cannission for appoval. If the
changes are denied by the Planning Cession, the applicant may appeal to
the City Ocuncil as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may be
made to the City Council by any interested party. Further, any Member of
the City Council may request a hearing before the City Council regaxdi rg

At their meeting of November 18, 1991, the City Council cff a ltq of. ino
considered an application for a use permit filed by Holiday Cleaners o W
Realty Fund III Holding Co., property owners).
The project is described as use permit for an on -premises laundry and dry cleaning
business. The project is located on Stevens Creek Boulevard at Portal Avenue.
The decision of the City Council was to approve said project. The Planning
Commission by filing a Negative Declaration on this project on December 14, 1992 has
determined that the project will not have a significant impact upon the environment and
therefore, no Environmental Impact Report has been prepared. The Negative
Declaration has been prepared pursuant to the provisions of State and City guidelines.
A copy of said Negative Declaration is available in the Office of the City Clerk, 10300
Torre Avenue, Cupertino, California.
