At their regular meeting of September 16, 1991, the Cupertino City Council
approved your application per Planning Commissim Resolution No. 4372 with
the following conditions:

The recomnandaticin. of approval is based on the Tait letter of July 31,
1991, Floor and Elevation plans of August 8, 1991, and Site Plan dated
August 29, 1991, except as may be amended by the conditions stated in
this Resolution.
she Site Plan shall be modified to pmovide parking along the south
property line, as shown in the approved Plan Irl of 4-U-87 (Mobil
oil), exclept only one parking space shall be designated along the east
side of the building, and it shall be handicap designated. The exact
location shall be approved by staff. A udnin mt of 10 parking spaces
shall be provided on -Bite. Two of the parking stalls shall be pave
labeled or signed for "cwnvenienoe mart visitors only". Vehicles
being serviced or awaiting servicing must be placed in striped stalls
only.
3. USE
The Use Permit grants the conversion of 154 sq. ft. of existing office
area into a convenience mart for sales of pa —packaged food items in
disposable containers intended primarily for consumption off premises.
No food items, except coffee, can be prepared an premises.
4. OUTDOOR SERVICING
The servicing of autamob les outside of the service bays, other than
the dispensing of gasoline and oil, is prohibited.

The property owner shall provide a copy of the building permit
obtained for the installation of the pass -through window. if one was
not obtained, one mast be issued from the Building Department, prior
to conversion of the convenience mart.

The applicant/property owner shall bpla security plan to reduce
the potential for theft and robbery for a 24 hour operation, which
shall consist of the following minimum requirements:
1) The applicant shall implement the pass -through window payment
system for gasoline and food purchases made after 11 P.M.
2) The entrance doors to the office area shall be closed after 11
p.m.
3) Instal a security safe to which the attendant has no access.
4) Provide adequate site lighting, including areas away from the
street frontage accessible by vehicles. location arid type of
fixtures shall be subject to approval by staff prior to
installation and prior to conversion. Of the office.
5) Avoid obscuring windrow area with signs or merchandise to ensure
visibility of cashier area.
6) Avoid use of tinted window glass.

guidelines.

the satisfaction of the District prior to implementation of the

SECTION I• FINDINGS
FIIiEum, the Planning mission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
4URFAS, the applicant bas met the burden of proof required to support
said application.; and
4MERFAS, the Planning Zvi=ion finds that the application meets the
following requirements:
a) That the use or uses are in confarmmanee with the General Plan,
Zoning and Stevens Creek Conceptual Plan of the City of
Cupertino.
b) Mmt the parking is in conformance with Ordinance No. 1277,
Parking Ordinance.
c) That the proposed use is considered secondary tb the primary use
of issuing gasoline and will not generate a level of traffic over
and above that of the capacity of site and existing street
system.
that after careful consideration of maps, facts, exhibits, testimony and
other evidence sutmitted in this matter, the application for Use Permit is
hereby reo=ended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 9-U-91 as set forth in the Minutes of the Planning
Ccmmission Meeting of September 9, 1991, and are incorporated by reference
as though fully set forth herein.

FINDINGS:
The Architectural and Site Approval Committee finds as follows with regard
to this application:
1) That the landscaping plan conforms to the Cupertino Xeriscape
Guidelines.
2) That the proposed landscaping satisfies the conditions of approval for
9-U-91.
CONDITIONS:
1-8) Standard Architectural and Site Approval Committee conditions to the
extent that they do not conflict with the special conditions listed
herein. In the event of conflict, the specific conditions listed
herein shall prevail.
9) The approval is based upon Xeriscape certification dated October 25,
1991 with addendum, Planting Plan and Irrigation Plan dated October
25, 1991, except as may be amended by conditions enumerated herein.
10) The applicant shall replace the proposed junipers around the sign at
the northeast corner with a lush, drought tolerant shrub such as
India Hawthorne.
