This letter confirms the decision of the Cupertino Planning Csmnission, given
at its regular meeting of June 24, 1991 denying the subject application to
allow exemption fran the requirements of the Underground Utility chapter of the
Cupertino municipal code, according to the findings and conditions specified in
the enclosed copy of the Planning Commission Resolution No. 4347. Please
contact our office if you have questions about this matter.
Please be aware that an appeal of this decision can be made by any person
within five working days of the decision. If this occurs, you will be notified
and a subsequent public hearing shall be scheduled before the city council.

RDOCKYUIdDING DENIAL OF A USE PERMIT TO ALLOW
EXFS'UMON FROM THE REQUIRII+EM OF HE UNDERUND

SECTION I• FINDINGS
WHEREAS, the Planning Commission of the City of OAxwtino has received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the necessary notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and the Planning Commission
has held one or more Public Hearings on this matter; and
VMWAS, the applicant has failed to meet the burden of proof required to
support this application, and has not satisfied the following
requirements:

1) Undergraunding utilities cmzLmity wide is required to help
create a visually attractive, undivided, and natural setting
within the City.
2) The view from Fremont -older Park should be preserved without man
made obstructions. Implementation of undergrounding can help to
obtain this goal.
3) The placement of utilities below grade protectes them from harsh
climatic elements and therefore, adds years of life to these
lines.
4) Property owner must omplete their fair share of undergrounding
of overhead wiring as will be required on subsequent tentative
parcel map of adjoining property owners.
NOW, ZSMUTORE, BE IT RESOLVED
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for denial by the City Council of the City of
Cupertino; and

That the subconclusions upon which the findings specified in this
Resolution are based are contained in the Public Hearing record concerning
Application 4-U-91 as set forth in the Minutes of the Planning Commission
meeting of June 24, 1991 and are incorporated by reference as though fully
