Street widening, hTpr=ements and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.

Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards as specified by the City
Engineer.
3. STREET LIGREMr, IWBkLIATION
Street lighting shall be installed and shall be as approved by the
City Engineer. Lighting fixtures shall be positioned so as to
preclude glare and other forms of visual interference to adjoining
properties, and shall be no higher than the maximum height permitted
by the zone in which the site is located.
4. FIRE
Fire hydrants shall be located as required by the City.
5. TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the
City.
6. STREET TREES
Street trees shall be planted within the Public Right of Way and shall
be of a type approved by the City in accordance with ordinance 125.
The applicant should work with the City Flxgineer in order to design
the sidewalk and right-of-way inprovements around the specimen sized
Pine tree. The applicant should consult an arborist to determine the
adequate amount of area dedicated to future trek growth and continued
good health of the tree.

In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment: of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the changes are minor and do not
result in a material effect upon the appearance or Ruction of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld„ the applicant may appeal to the
Planning oamissJon.
If the Director finis that the requested changes are material, such
changesshall be referrdd to the Planning Commission for approval. If
changes are denied by the Planning Oomnissicn, the applicant may
appeal to the City Om=il as provided in city Ordinance No. 652.

A tree protection plan shall be required prior to issuance of building
permits. Said plan shall include graphic depiction of protection
devices to be installed along the dripline perimeter of each tree for
the duration of construction activities for the multi -trunk
Eucalyptus, one oak and one Pine in the public right-of-way. Prior to
first resale, a deed restriction shall be recorded notifying future
homeowners of the requirement to retain the oak tree.

If the developer requests building permits based on the approved
exhibits described in condition 11 above, the total floor area shall
be reduced to comply with the FAR stated in Section 8.2 of Ordinance
1449, and the setbacks shall be revised to comply with Sections S.4
through 8.4.2(A) of ordinance No. 1449 for all portions of the
building exceeding 20 feet in height as calculated aoo0rditx3 to
section 4.24 of ordinance 1453.
Alternately, the developer may revise the ceiling height of the lower
level to a ceiling height below 7 1/2 ft. without adjusting the FAR,
and may adjust the roof pitch to reduce all portions of the building
below 20 ft. in height, thus requiring compliance with first floor
setbacks described in Section 8.3 through 8.3.1 of ordinance 1449.
Prior to issuance of the building permits, the developer shall obtain
ASAC approval of the color palette, building materials and landscaping
materials to screen lower level exterior surfaces.

SECTION I• FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the applicant has met the burden of proof required to support
said application.; and
WHEREAS, the Planning commission finds that the application meets the
following requirements:
a) That the use or uses are in conformance with the General Plan of
the City of Cupertino, and are not detrimental to existing uses
or to uses specifically permitted in the zone in which the
proposed use is to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
a) That the proposed use will not generate a level of traffic over
and above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious
to property and improvements in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 28-U-90 as set forth in the Minutes of the Planning
Commission Meeting of February 11, 1991, and are incorporated by reference
as though fully set forth herein.

If the developer requests building permits based on the approved
exhibits described in Condition 11 above, the total floor area shall
