OF THE PLANNING OOBaSSION OF THE CITY OF CUPERTINO
APPROVING A MINOR MODIFICATION TO A USE PERMIT
To SUBST nE METAL VIEW SCREENING IN PLACE OF LANDSCAPING
SECTION I• FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the applicant has met the burden of proof required to support
said application.; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a) That the proposed screening method will adequately hinder views
from the Substation Operation building to the adjoining
residential properties Fast.
b) the future use of metal screening shall be discouraged and a
natural (landscape) method applied.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, euhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby reconTended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconsciousness upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 25-U-90 Revised as set forth in the Minutes of the
Planning Ccnnission Meeting of May 13, 1991, and are incorporated by
reference as though fully set forth herein.

SECTION III• CONDITIONS
The recur mndation of approval is based on Exhibit Plans Al, dated
3/6/91, A4(s) detail 15, dated 3/27/91, material board dated 11/19/90,
except as may be amended by the Conditions contained in this
Resolution.
2. MODIFICATION OF OONDTIION
Oordition No. 10, of Use Permit 25-U-90, approved January 28, 1991, is
hereby amended as follows: "Now planting should be directed along the
east property line to prohibit views from the easterly residenoes into
the site. 'Ihe planting shall be located east of the substation
building in an area represented by a line drawn 45 degress from the
northeast and southeast corners of the substation operations building
to the east boundary line. The remainder of the condition shall
continue to remain in effect and unchanged.
3. IOADING
No loading of materials onto trailers shall occur along the South side
of the Substation Operations building.
PASSED AND ADOP= this 13th day of May, 1991 at a Regular Meeting of the
Planning Commission of the City of Cupertino by the following roll call
