CITY COUNCIL ACTION - 24-U-90 - USE PERMIT TO ADD A 540 SQ. FT. STORAGE
ROCM TO AN EXISTING FREESTANDING RESTAURANT; LOCATED ON THE NORTH SIDE OF
ALVES ERIVE BETWEEN BMMLEY AVENUE AND NORTH DFANZA BOULEVARD
At their regular meeting of January 22, 3.991, the Cupertino City Council
approved your application per Planning Camni.ssion Resolution No. 4318 with
the follow conditions:
The rec=nendation of approval is based on Sheets 1 through 4, dated
November 5, 1990 of Use Permit 24-U-90, except as may be amended by
the conditions stated in this Resolution.
2. TRIP CONSTRAINM
Land use intensity shall be limited to an intensity that will not
generate more than 16 one-way trips per acre during the peak traffic
hour. For the purposes of c=pliance with the traffic intensity
performance standard, the following accounting of trips is hereby
incorporated into the project approval:
Trips credited to project area:
Gross lot area 1.47 acre
Assigned trips at 16 trips per gross acre 23.60
Trips generated by the project:
Assigned to existing restaurant under 10-U-79 12.10
Assigned to APN 326-34-68 under 10-U-79 6.20
Total trips used under 10-U-79 18.30
Surplus trips remaining to restaurant site
(Per Conn. 17 of Plrg. Comm. Res. 1946) 5.30
Assigned to proposed storage building
(540 sq. ft. @ 3.5 trips/1000 sq. ft.) 1.89

In the event that a development does not utilize the full 16 trips per
acre allotted by the trip end performance standard, the owner of
record shall have the ability to retain, sell, or transfer trips with
other property owners within the Traffic Intensity Performance
standard Area. All sales or transfers of trips shall be filed with
the Director of Planning and Development and the City Clerk. No sale
or transfer shall be considered finally consummated until a Use Permit
has been approved for the property to which the trips are to be
applied.
The developer shall record a covenant to describe the trip acre
constraint and the total number of trips allocated to the particular
development at the time of development approval. The covenant shall
be worded in a manner to suggest that future purchasers of the
property consult the individual Use Permit file to obtain an updated
status report of the total number of trips allocated to each
particular property.
3. PARKING
The applicant shall restripe the parking lot to obtain a total of 59
parking spaces, of which total no more than 33% may be compact. Two
spaces shall be handicapped designated and configured in conformance
with the most current adopted Uniform Building Code. The restriping
plan shall be approved by staff prior to issuance of building permits.
4. TRASH FNCLOSIJR£
The applicant shall install a trash enclosure on the site. The
enclosure shall be designed to integrate with the existing building.
The location and design shall be approved by staff prior to issuance
of building permits.
5. STREET Il4pRCVEtgNIS
The applicant shall record an agreement to install required street
improvements at such time when the cumulative floor area of
applications submitted after February 1, 1986, and current
applications exceeds twenty-five percent of the total floor area of
structures on the property. The agreement shall be approved by the
City Attorney prior to recordation.
6. USE CDNSTRAIRM
The subject use permit authorizes installation and use of a 540 sq.
ft. addition to the main restaurant building for storage of goods and
food products only. Said 540 sq. ft. space may not be used for diniig
area seating, kitchen space or other active uses without prior use
permit approval from the City.
Please review conditions carefully. If you have anyquestions regarding
the coiditions of approval please contact the Department of Ctmmnnity
Development staff members for clarification. Failure to incorporate
conditions into your plan set will result in delays at the plan checking
stage. If development ornditicns require tree preservations, do not clear
the site until required tree protection devices are installed.
The expiration date for the use permit is January 22, 1992 (Section 6.4 of
Ordinance No. 652 as revised by Ordinance No. 1136) .

At their regular meeting of August 6, 1990, the Cupertino City
Council approved the tonporary use of two shipping storage containers
for a period of three (3) months. If plans for permanent storage are
submitted and construction has begun within those three months, the
Building Department of the City may extend the use of the tenporary
trailers for a reasonable amount of time.
The City Council also added the provision that alcohol may not be
stored in the shipping storage containers.

SECTION I• FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support said
application; and
WHEREAS, the Planning Cormmission finds that the application meets the following
requirements:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed use is to be
located.
b) That the property involved is adequate in size and shape to
aocorm cdate the proposed use.
c) That the proposed use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other
evidence submitted in this matter, the application for Use Permit is hereby
recommended for approval, subject to the conditions which are enumerated in
this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in
this Resolution are based are contained in the Public Hearing record concerning
Application 24-U-90 as set forth in the Minutes of the Planning Commission
Meeting of January 14, 1991, and are incorporated by reference as though fully
set forth herein.
