Said agreement shall be executed prior to issuance of construction permits. 9. TRANSFORMERS Electrical transformers, telephone vaults and similar above ground equipment enclosures shall be screened with fencing and landscaping or located undergroiand such that said equipment is not visible from public street areas to be determined by the City Engineer. Pedestrian easements over the sidwalk area shall be prepared by the developer, approved by the City Attornmey and recorded againsta the subject property prior to issuance of building permits. 11. MASONRY The existing concrete block wall on the site's northerly boundary with residential property shall be maintained at an effective height of 6 feet. Said wall shall be subject to inspection and necessary repair to ensure satisfactory noise attenuation. •• • • • • �• i• �� •• • 31 • . 1D • 71• •� D The recommendation of approval is based on Exhibits Al through A6, dated November 6, 1990, except as may be amended by the Conditions contained in this Resolution. In the event that the applicant or subsequent property owner shall desire to make any minor changes, alterations or amendment of the approved development plan, a written request or revised development plan shall be submitted to the Director of Planning and DevelopTent. If the Director makes a finding that the changes are minor and do not result in a material affect upon the appearance or function of the project, said changes may be certified on the revised plan. If approval of said changes is withheld, the applicant may appeal to the Planning Conmiission. If the Director finds that the requested changes are material, such charges shall be referred to the Planning Commission for approval. If the changes are denied by the Planning Commission, the applicant may appeal to the City Council as provided in City Ordinance No. 652. Resolution No. 4310 (21-U-90) 11/13/90 Page -4- 13. (Cont'd.) 14. If said changes are approved by the Planning Cc=dssion, an appeal may be made to the City Council by any interested party. Further, any Member of the City Council may refit a hearing before the City Council regarding said approved changes. Said request shall be made within ten (10) days from the date of approval of said charges by the Planning Commission. The developer shall provide a minimum of 116 parking spaces. The handicapped parking space(s) located in the 50 ft. landscape setback area adjoining Stevens Creek Blvd. shall be relocated. it is recognized that the parking ratio is below the minimum requirement of ordinance 1277, but that variation in hours of operation justifies shared use of these spaces, and overflow parking to the adjoining office center is provided through reciprocal rigthts of access. If parking problems, especially spillover parking to the adjoining residential neighborhood, are reported, the City may initiate action to modify the subject use permit to reuire the property owner to abate the parking problem. The City may, after exhausting good faith efforts to resolve parking problems, initiate an action to revoke the Use Permit according to the provisions of Ordinance 652. The applicant shall record an appropriate deed restriction and covenant running with the land with the adjoining property owner east providing for reciprocal ingress/egress easements to and from the affected parcels. The alternative joint driveway plan in Use Permit 28-U-82 shall be referred to for the shared access provisions. Said easements shall be recorded prior to release of the occupancy permit. Said easement shall be subject to closure upon finding of the Commission, through a duly noticed public hearing, that noise or traffic safety problems result from joint access activity. The cost of closure installation, which may include a gate or construction of a permanent masonry wall, shall be borne by the property owner. 16. LANDSCAPING The final landscaping plans shall reflect mourning in the planter along the Blaney Avenue frontage. The box size for the tree species proposed for the landscape bed along Blaney and within the parking lot shall be greater than 32" boa. Additionally planting shall be provided along the south building face of Building B and along the west building face of Building A. The final landscape and irrigation plan shall be consistent with the Xeriscape guidelines, and shall be reviewed and approved by the Architectural and Site Approval Carmiittee prior to issuance of building permits. 17. USE LIMITATIONS — (GENERAL COMERCIAL) Permitted uses may include all uses allowed without the securing of a Use Permit in the City of Cupertino OG (General Conwxcial) zoning district. All other uses requiring Use Permit review in the CG zone shall require Use Permit review. Restaurant and restaurant/lounge uses shall be limited as follows: "NulliganIset space: 72 seats with dance floor for informal use (No organized live entertaiment or Ds host) "Freestanding" space: 20 seats 18. FLOOR AREA RATIO The Planning Ccmmiission finds that the developer has satisfied the criteria specified in Policy 2-31 of the Iasi Use Element of the General Plan to allow 5,000 s.f. of office floor space beyond that allowed under the floor area ratio. No public address system or paging system, powered megaphone or similar no;semaking device shall be permitted outdoors at any time. 20. MODIFICATION OF APPROVED DEVELOR4ERr PLAN In the event that the applicant or subsequent property owner shall desire to make any minor changes, alterations or amenrhment of the approved develcpmszt plan, a written request or revised development plan shall be submitted to the Dissector of Planning and Development. If the Director makes a finding that the changes are minor and do not result in a material effect upon the appearance or function of the project, said changes may be certified on the revised plan. If approval of said changes is withheld„ the applicant may appeal to the Planning Commission. If the Director finds that the requested changes are material, such changes shall be referred to the Planning Commission for approval.
