The Architectural and Site Approval Conmdttee finds as follows with regard
to this application:
1) That the sign program as proposed is consistent with title 17 of the
Cupertino Municipal Code as conditioned herein.
2) That this approval meets the condition 12 of resolution 1635 requiring
the applicant to return in 90 days with a sign program.
CONDITIONS:
1-8) Standard Architectural and Site Approval Committee conditions to
the extent that they do not conflict with the special conditions
listed herein. In the event of conflict, the specific conditions
listed herein shall prevail.
9) The approval is based upon sign program details dated October 31,
1991 except as may be amended by conditions enumerated herein.
10) Mm address numbers shall be placed on the base of the man m:PSYt
sign. The letter height shall be a minimum of 5 inches.
11) The applicant shall keep landscaping around the sign trimmed so
to keep the address numbers on the base of the monument sign
visible to passing motorists.
12) All existing non -conforming and illegal signs on the site shall
be removed as soon as possible.

At their regular meeting of January 22, 1991, the Cupertino city Council
granted a Negative Declaration and approved your application per planning
Comni.ssion Resolution No. 4315 with the follow conditions:
The recommendation of approval is based on two -sheet plan set revision
dated 01/07/91, except as may be amended by the conditions stated in
this Resolution. Color selection of blue or pastel green may be made
at the applicant's discretion, according to the color diagrams
presented at the January 14, 1991 hearing.
2. USE RESTRif'LTON
The subject use permit authorizes operation of a minor automotive
repair facility as said use is defined in the General Commercial
zoning Ordinance. Said use shall be limited to the hours of 8:00 a.m.
to 7:00 p.m. daily, and may include simultaneous operation of the
existing 150 sq. ft. snack shop.
All repair work shall be conducted within the service building, no
repair work, diagnostics, testing or replacerent of parts may occur
outside of the repair bays. vehicles awaiting service may be parked
on the site, but only within a striped designated parking stall.
No other uses or activities beyond those described in the preceding
paragraphs of this condition are authorized or allowed.

The area labeled "Fixture Expansion" on Sheet Lrl is not approved at
this time.
6. FENCED AREA
The area between the west side of the building and the adjoining
property line shall be enclosed with permanent, wood fencing as
approved by the Architectural and Site Approval Committee. Said area
shall not be used for service work on vehicles, or for storage of
vehicles, parts, materials or refuse.
7. SIGN PR7Gl2AM
The developer shall obtain ASAC approval of a sign program. Sign
information indicated on the approved exhibits is not approved.

Prior to commencement of the approved use, the developer shall provide
to the City a final letter of closure from the Santa Clara Valley
Water District, or other agency(ies) with jurisdiction, certifying
adequate remediation of existing soils contamination conditions
resulting from removal of the underground fuel storage tanks.
The driveway and sidewalk modifications indicated on Sheet Irl shall
be completed within 90 days of the effective date of the subject Use
Permit entitlements. Completicn of landscape and building
improvements per the approved exhibits stated in Condition 1 of this
Resolution shall occur within one (1) year of the effective date of
the subject Use Permit.

AS THE PRINCIPAL USE OF THE SITE
SECTION I • F 4DINGS
WHEREAS, the Planning Commission of the City of Cupertino has received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the necessary notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and the Planning Commission
has held one or more Public Hearings on this matter; and
WIMU S, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Caenission finds that the application meets the
following requirements:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrimental to existing uses or to
uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to
acoaaDodate the proposed use.
c) That the proposed use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
Property and improvements in the neighborhood.
NOW, TII PJ70RE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 20-U-90 as set forth in the Minutes of the Planning
Commission Meeting of January 14, 1991, and are incorporated by reference
as though fully set forth herein.
