APPROVING FINAL LANDSCAPING, 1,10111NG, SOUND WALL, AND SIGN PLANS FOR AN
EXISITNG SERVICE STATION

FINDINGS:
The Architectural and Site Approval Committee finds as follows with regard
to this application:
1) That the Sign Program as conditioned herein is consistent with title
17 of the Cupertino Municipal Cade.
2) That the masonry wall as proposed meet the requirements of condition
12 of 17-U-90.
CONDITIONS:
1-8) Standard Architectural and Site Approval Committee conditions to the
extent that they do not conflict with the special conditions listed
herein. In the event of conflict, the specific conditions listed
herein shall prevail.
9) The approval is based upon site plan dated March 29, 1991, sign
elevations dated September 26, 1990 (2 sheets), Masonry wall criteria
dated March 29, 1991 (3 sheets), and Landscape plans dated November
21, 1990 (2 sheets) except as may be amended by conditions enumerated
herein.
10) The applicant shall provide staff a letter frcan a Landscape Architect
reccu¢nending appropriate ground cover for under the Oak trees prior
to issuance of building permits.
11) 'Ihe Landscape irrigation plans shall be certified by a landscape
Architect prior to issuance of building permits for conformance with
the Xeriscape Guidelines.
12) The utility vault adjacent to Homestead Road shall be screened from
view with appropriate landscaping.
13) The lighting plan shall be approved by staff prior to issuance of
building permits.
14) The monument sign shall be rotated 45 degrees so as to face the
center of the intersection. The overall height shall be no higher
than 8 feet.
15) The address numbers shall be located on the base of the sign so as to
be visible to passing motorists.

At their regular meeting of March 18, 1991, the Cupertino, City Council
granted a Negative Declaraticn and approved your application per Planning
Comission Resolution No. 4329 with the following conditions:

Street widening, iEprvvements and dedications shall be provided in
accordance with City staroards and specifications and as required by
the City Engir*es.

in accordance with grades and standards as specified by the City
Engineer•

Mminage shall be provided to the satisfaction of the City Engineer.

Utilities Ordinance No. 331 and other related Ordinances and
regulations of the city of cupeitino, and shall coordinate with
affected utility providers for installation of underground utility

The recommendation of approval is based can Sheet Al (11/21/90), A-2
(09/26/90 and irl (11/21/90), e=mpt as may be amended by the
conditions contained in this Pimolution.
Exhibit A-2 shall be modified to reflect a continm s stucco fascia
treatment for the pump island canopy. A small portion of said stucco
treatment may be deleted for a wood or painted metal backdrop for a
sign is said sign is approved as part of a formal sign prcgnam through
the Architectural and Site Approval Catmittee.
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised develgment
shall be submitted to the Director of Planning and Development. If
the Director makes a finding that the changes are minor and do not
result in a material effect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said chargess is withheld„ the applicant may appeal to the
Plaruhing Cocul ion.
If the Director finds that the requested changes are material, such
dharx3es shall be referred to the Planning o®nission for apprwal. If
the changes are denied by the Planning Ocmmmission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may
be mods to the City Council by any interested panty. Further, any
Member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said changes by the
Plarming Ct mJ ion.
The subject use permit with on„s the constnaction and operation of a
single -stall car wash, food market, and fueling stations as depicted
an the wdhibits listed in condition 9 above. Equipment installed in
the car wash -structure shall replicate the sound generation
described in the Fitzroy/Dobbs study of 01/24/91 and
03/11 /91.
The developer shall install an eight (8) ft. high masonry wall on the
northerly site boundary adjoining residential property. Said masonry
wall materials and appearance shall be subject to ASAC review prior to
issuance of building permits.
The vacuum unit depicted on Sheet Al shall be removed on the building
permit application plan set.
13. HOURS OF OPERATION
The Car wash facility shall operate only between the hours of 7:00
A.M. and 10:00 P.M. daily. Operation of the food mart and fuel pumps
shall be restricted to the haws of 6:00 A.M. to 11:00 P.M. daily.
14. ON -SITE PARKIIIG
All automobiles parked on site shall be placed in striped off-street
parking stalls.
Operation of the car wash facility shall be limited to a single pass
wash -rinse cycle. Said facility shall also be fitted with water

WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;

WHEREAS, the applicant has met the burden of proof required to support

The reccmmhdation of approval is based on Sheet Al (11/21/90), A-2
(09/26/90 and L-1 (3.1/21/90) except as may be amended by the Conditions
contained in this Resolution.
Exhibit A-2 shall be modified to reflect a carhtinuous stucco fascia
treatment for the puup island canopy. A small portion of said stucco
treatment may be deleted for a Mood or painted metal bacvkdrop for a
sign if said sign is approved as part of a formal sign program through
the Architectural and Site Approval Co mittee.
In the event that the applicant or subsequent property owner shall
desire to make any minor charges, alterations or amen tent of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Develcpent.
If the Director makes a finding that the changes are minor and do not
result in a material affect upon the appearance or function of the
project, said charges may be certified on the revised plan. If
approval of said charges is withheld, the applicant may appeal to the
Planning Ccnnnission.

If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Commission for approval. If
the changes are denied by the Planning Commission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may
be made to the City Council by any interested party. Further, any
Member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said changes by the
Planning commission.
The subject use permit authorizes the construction and operation of a
single -stall car wash, food market, and fueling stations as depicted on
the exhibits listed in condition 9 above. Equipment installed in the
car wash structure shall replicate the sound generation characteristics
described in the Fitzroy/Dobbs study of 01/24/91 and 03/11/91.
The developer shall install an eight (8) ft. high masonry wall on the
northerly site boundary adjoining residential property. said masonry
wall materials and appearance shall be subject to ASAC review prior to
issuance of building permits.
The vaoumm unit depicted on sheet Al shall be removed on the building
permit application plan set.
The car wash facility shall operate only between the hairs of 7:00 AM
and 10:00 PM daily. Operation of the food mart and fuel pimps shall
be restricted to the hags of 6:00 AM to 11:00 PM daily.
All automobiles parked on site shall be placed in striped off-street
