granted a Negative Declaration and approved your application per Planning
Cmmissicn Resolution No. 4295 antended to include the following

Street widening, improvements and dedications shall be provided in

in accordance with grades and standards as specified by the City
Engineer.

devices. The developer shall sul-it detailed plans showing utility
undergroux-id provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City EMineer.
The recoamendaticn of approval is based on Eddbits Plan Sheet 1 and
2, revision 1, dated 9/90, Site Plan, Floor Plan, and Elevation,
exmpt as may be amended by the Conditions contained in this
Resolution.
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Dizec^tar of Planning and Development.
If the Director makes a finding that the changes are minor and do not
result in a material effect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the
Planning Comaisaion.
If the Director finds that the requested changes are material, such

to create diversification. The building square footage, floor area
ratio, building coverage and relative setbacks may not be increased,
but the building envelope can be shifted on -site or inverted.

WEW.A.S, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WrOREAS, the applicant has met the burden of Proof required to support
said application.; and
WHMEAS, the Planning Conmiission finds that the application meets the
following requirements: -
a) That the use or uses are in oonfcrmanoe with the General plan of
the City of Cupertino.
