At their regular meeting of February 4, 1991, the Cupertino City Council
amexded Condition No. 1 to read as follows:

Street widening, iTT>pmements and dedications shall be provided in
accordance with City standarrs and specifications and as required by
the City Engineer.
Said improvement shall include modification of the Mariani
Avenue/Dehnza intersection. East approach improvements shall be
implore nted concurrently with the first phase of project oonstsvction.
South approach improvements shall be implemented as directed by the
City. To ensure caupletion of said south approach improvements, the
developer shall provide a Letter of Credit in the a=u nt of $130,000
valid for a period of seven years from the effective date of the use
permit.
Prior to. issuance of building permits for Ccnsbnn cn of all or any
portion of the approved deve1cpneunt, the developer shall provide
suitable financial seamity for widening of the DeAnza Boulevard

The Planning Commission finds that the following amendment to said
Condition 1 will relieve uncertainties as to the developer's obligation to
fund said improvements while still ensuring that the irprovermnts
obligations are completed in accordance with the original project
