At their regular meeting of September 18, 1990, the Cupertino City Council
approved your application per ASAC Resolution No. 1568 with the following
conditions:
1-8) Standard Architectural and Site Approval committee conditions to
the extent that they do not conflict with the special conditions
listed herein, in the event of conflict, the specific conditions
listed herein shall prevail.
9) The approval is based upon Sheets Al, 12 arri 12 dated July 26,
1990, and Sheet E-1 dated April 9, 1990, except as may be amended
by conditions enumerated herein.
10) prior to issuance of building permits, the applicant shall obtain
written approval for the AM campy lights frm the Sheriff's
Deparbwxrt Crime Prevention Unit.
11) Prior to issuance of building permits, the applicant shall obtain
certification of the landscape and irrigation plans for
conformance with the City's Xeriscape Guidelines by a registered
landscape Architect.
12) Ingress easement shall specify that the trash enclosure shall be
moved at time of implementation. Rhe new location shall be
subject to formal ASAC review.

granted a Negative Declaration and approved your application per Planning
Cession Resolution No. 4268 with the following auditions. Council
also directed staff to look at diagonal parking, particularly in the area
of the DeAnza Boulevard entrance, and authorized staff to have final
approval of that parking plan.

Street right-of-way acquisition, widrenin9, improviments and
dedications shall be provided in accordance with City Standards aryl

in acco darwe with grades and standards as specified by the City
Engineer and paid by the property owner.

City Engineer. Lighting fixtures shall be positioned so as to
preclude glare and other forms of visual interfeserre to adjoining

devices. The developer shall submit detailed plans showing utility
urrlerground previsions. Said plans shall be subject to prior approval
of the affected Utility prwider and the City Engineer.

r1he project developer shall enter into an improvement agreement with
the City of Cupertino providing for payment of fees, including but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for tip* mound* g of utilities. Said
agreement shall be executed prior to issuance of construction permits.
Electrical transformers, teleFhcne vaults and similar above grct3ld
equipment enclosures shall be screened with fencing and landscaping or
located underground such that said equipment is not visible from
public street areas.

Uhe recommendation of approval is based on Mdnibits A-1, A-2, A-3,
A-4, PLrl dated 6/1/90, and E-1 dated 5/31/90 except as may be amended
by the conditions stated in this Fesoluticn.
Zhe subject use permit authorizes addition of approximately 600 sq.
ft. of floor area for expanded use of an exiting retail bank and
installation of up to six (6) automatic teller rachines.
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amenctmer* of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the charrjes are minor and do not
result in a material affect upon the appearance or functican of the
Project, said changes may be certified on the revised plan. If
1pprcwal of said changes is withheld, the applicant may appeal to the
Planning Commission.
If the Director finds that the requested ctzriges are material, such
c2nanges shall be referred to the Plarming Camdssicn for approwal. If
the changes are denied by the Planning Commission, the applicant may
appeal to the City CoL=il as provided in City Orsitnance No. 652.
If said chances are approved by the Planning Qaissicn, an appeal may
be made to the City Council by any interested party. Further, any
Member of the City Council may request a heariM before the City
Council regardim said approved dsanges. Said request shall be made
within within ten (10) days from the date of approval of said charges
by the Planning Comni.ssicri.
15. SECUFZTTY
The automatic taller machine area shall be equipped with a video
taping surveillance camera system, the operation and specifications of
which shall be subject to city approval in consultation with the
Sheriff's Departmeat Crime Prevention office.
The property owner shall record an appropriate deed restriction and
covenant running with the lard subject to approval of the City
Attorney, to provide for necessary reciprocal ingress and egress
easements to and from the adjoining site to the east which is already
obligated under Ccrriiticn 17 of Use Permit 15-U-83 to provide
reciprocal access.
The property owner shall also record a separate legal agreement
agreeing to p—ide shared driveway access with the property to the
south. Said agreement shall provide that suds access shall be
implemented at such time as the city can require participation in
shared access of said southerly property through a conditional use
permit procedure or other discretionary entitlement.
As part of the precise development plan required under Section 4(C) of
ordinance No. 618, the developer shall obtain formal architectural
site approval of the comprehensive planting, irrigation and site
lighting plan, and in accordance with the following directions:
A) Parking area light fixtures shall be adjusted to ensure adequate
protection of motorist from intrusive effects of glare.
9) Lighting for the ATM area shall be subject to prior review by the
Sheriff's Dept. Crime Prevention Unit.
C) landscaping along the north portion of the site adjoining
Rodrigues Avenue shall screen visibility of parked cars but shall
not interfere with visual access to the ATM area for police
surveillance.
d) New larscaping and i'=i4dticn shall be certified as ,mplying
with the cityyIs Xeri,scape CaidelirAs as adopted by thh City
Council = June 4, 1990.

WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the applicant has met the burden of proof required to support
said application.; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a) That the use or uses are in conformance with the General Plan of
the City of Cupertino, and are not detrimental to existing uses
or to uses specifically permitted in the zone in which the
proposed use is to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over
and above that of the capacity of the exist xj street system,
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious
to property and improvements in the neighborhood.
NOW, TH RMRE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 10-U-90 as set forth in the Minutes of the Planning
Commission Meeting of June 11, 1990, and are incorporated by reference as
though fully set forth herein.

Street right-of-way acquisition, widening, improvements and dedications
shall be provided in accordance with City standards and
and as required by the City Engineer and paid by the property owner.

Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards as specified by the City
Engineer and paid by the property owner.
3. STREET LIGHTING INS ALLATION
Street lighting shall be installed and shall be as approved by the City
Engineer. Lighting fixtures shall be positioned so as to preclude
glare and other forms of visual interference to adjoining properties,
and shall be no higher than the maximum height permitted by the zone in
which the site is located.
4. FIRE EIYDRAAlI'
Fire hydrants shall be located as required by the City.
5. TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the
City.
6. GRAD
Grading shall be as approved and required by the City Engineer in
accordance with Ordinance 125.
7. DRAINAG
Drainage shall be provided to the satisfaction of the City Engineer.

The developer shall comply with the requirements of the Underground
Utilities Ordinance No. 331 and other related Ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall submit detailed plans showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.

The project developer shall enter into an improvement agreement with
the City of Cupertino providing for payment of fees, including but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for undeigrounding of utilities. Said
agreement shall be executed prior to issuance of construction permits.

Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping
or located undergran-4 such that said equipment is not visible from
public street areas.

12. APPROVED W IBITS
The reammendation of approval is based on Exhibits A-1, A-2, A-3,
A-4, pL-1 dated 6/1/90, and E-1 dated 5/31/90 except as may be amended
by the conditions stated in this Resolution.
13. APPROVED USES
The subject use permit authorizes addition of approximately 600 s.f.
of floor area for expanded use of an existing retail bank and
installation of up to six (6) automatic teller machines

In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the changes are minor and do not
result in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the
Planning Commission.
If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Commission for approval. if
the changes are denied by the Planning Ccmmission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said changes are approved by the Planning Commission, an appeal may
be made to the City Council by any interested party. Further, any
Member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall 'be made
within ten (10) days from the date of approval of said changes by the
Planning Commission.

The automatic teller machine area shall be equipped with a video
taping surveillance camera system, the operation and specifications of
which shall be subject to City approval in consultation with the
Sheriff's Department Crime Prevention Office.

The property owner shall record an appropriate deed restriction and
covenant running with the lard subject to approval of the City
Attorney, to provide for necessary reciprocal ingress and egress
easements to and from the adjoining site to the east which is already
obligated under Condition 17 of Use Permit 15-U-83 to provide
reciprocal access.
The property owner shall also record a separate legal agreement
agreeing to provide shared driveway access with the property to the
south. Said agreement shall be provide that such access shall be
implemented at such time as the city can require participation in
shared access of said southerly property through a conditional use
permit procedure or other discretionary entitlement.
17. PRECISE DEVELOPMFSIf PLAN REVIEW
As part of the precise development plan required under Section 4(C) of
ordinance No. 618, the developer shall obtain formal architectural
site approval of the comprehensive planting, irrigation and site
lighting plan, and in accordance with the following directions:

A) Parking area light fixtures shall be adjusted to ensure adequate

Rodrigues Avenue shall screen visibility of parked cars but shall

with the City's Xeriscape Guidelines as adopted by the City
COlulcil on June 4, 1990.
