At their regular meeting of May 21, 1990, the Cupertino City Council
approved the granting of a Negative Declaration and approved Application
No. 6-U-90 per Planning C7o=iseion Resolution No. 4254 with the follaaing
Coalitions:
Street widening, impo:ovements and dedicatioms shall be provided in
accordance with City Standards and specifications as required by the
City anineer.
2. CURB AND GUrrE t
Curbs and gutters, sidewalks and related strtbmms shall be installed
in accordance with grades and standards as specified by the City
Engineer.
3. STFa= LT-GREIM »ATION
Street lighting shall be installed and shall be as approved by the
City axjineer.
Fire hydrants shall be located as required by the City.
Traffic control signs shall be placed at locations specified by the
City.
Street trees shall be planted within the public -right-of-way and shall
be of a type approved by the city in accordance with Ordiname 125.

Grading shall be as approved and required by the City Engineer in
accordance with Ordinance 125.
Only drainage shall be provided to the satisfaction of the city
Engineer.
9. MU E CKM UTILIZZES
The developer stall oomply with the requirements of the Undergroutid
Utilities Ordinance No. 331 and other related Ordirames and r-
regulations of the City of 04*rtino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall submit detailed plans showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.
10.
Electrical transformers, telephone vaults and similar above ground
equipment enclosures stall be screened with fencing and landscaping or
located underground such that said equipment is not visible from
public street areas.

The project developer shall enter into a developoent agreement with
the city of Cupertino providing for payment of fees, including but not
limited to che&JM and inspection fees, storm drain fees, park
dedication fees and fees for urdeng=w ding of utilities. Said
agreement stall be wmcuted prior to issuance of construction permits.

February 22, 1990, except as may be amended by the Conditions
contained in this Ressoluticn.
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or ameflebient of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Ommamity Development. If
the Director makes a finding that the changes are miner and do not
result in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the
Planning C•n•i ssi on.
Adequate space for three (3) Rancticnally independent off street
parking spaces shall be provided on the parcel to aupensate for the
lack of public street parking. One (1) space shall be enclosed within
a garage, and the additional two (2) spaces may be ormits uncovered
spaces.
The subject use permit authorizes oamstructicn of the two-story
detached single-family residential dwelling unit not to exceed .45
floor area ratio including a ate -car garage.
Zthe first and second story setbacks shall be a minimw of seven (7)
feet on both the east and west property lines. Mm fencing for this
site shall be in conformance with ordinance (#686) as it applies to
the street intersection site triangle and inside yard view triangles.
Any fencing ptoposed for the northwest portion of the parcel shall
have a minimum 7 foot setback from Orange Avenue.
18.
Prior to iuplementation of this use permit, the property owner shall
ocaplate proceedings for anneomticn of the subject property to the
City of Cupertino. Said annexation process shall be ocupleted prior
to issuance of any line development entitlements.
All wells located on the property shall be covered.

MMUAS, the Planning Ocrm itGion of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
Lam, the applicant has met the burden of proof required to support
said application.; and
MMU AS, the Planning Omission finds that the application meets the
folluding requirements:
a) That the use or uses are in conformance with the General Plan of
the City of Cupertino, and are not detrimental to existing uses
or to uses specifically permitted in the zone in which the
proposed use is to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over
and above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious

That after careful consideration of maps, facts, exhibits, testimony and
other evidence submittedin this matter, the application for Use Permit is
hereby recammensded for approval, subject to the conditions which are

SECTION I: FINDINGS
WHEREAS, the Planning Comission of the City of Cupertino has received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHMW, the necessary notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and the Planning Commission
has held one or more Public Hearings on this matter; and
WHEREAS, the applicant has failed to meet the burden of proof required to
support this application, and has not satisfied the following
requirements:
1) the floor area ratio is to high for the size of the lot.
2) The proposed design of the home is too booty, the building is too
close to the street, the patio can be easily enclosed as
currently designed and the roof pitch is not appealing and makes
the height of the structure appear too high.
That after careful =nsideraticn of maps, facts, adubits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for denial by the City Council of the City of
Opettino; and
