At their regular meeting of June 18, 1990, the Cupextim City CbLmoil
granted a Negative Declaration and approved Application: No. 27-U-89 per
Planning Commission Resolution No. 4269 amended as follows:

The recamaendation of approval is based on the sheets 1 through 11
dated 05/25/90 of Application 27-U-89, exaept as may be amended by the
Conditions contained in this Resolution.

on the final map and shall meet Central Fire District stm-d rds.
Pedestrian easements over the sidewalk area shall be prepared by the
developer, approved by the City Attorney and recopied against the
subject property prior to issuance of building permits.
The city may require the amu txucticn of additional dwelling units
reserving them for affordable rental occupancy by senior citizens
according to the terms of a supplemental agreement approved by the
City Cumcil, and by the City Attorney prior to recordation. said
supplemental agreement shall restrict occupancy of said units for a
minim— period of 20 years. Mm agreement: shall be recorded.

Mw remaining units may divided for resale as condominium limits at the
discretion of the developer or owner. There shall be at least one (1)
additional lot held in common ownership. The exact placement of
interior partitions may be modified subject to staff approval.
The total number of subsidized dwellings and the City's participation
in cost underwriting of improvements to accommodate elderly residents,
such as elevator installation, as well as waiver or reduction of fees
or other benefits, shall be approved by City council at the Precise
Plan stage based cn recommendaticn of the senior CitizerVHardicapped
Person Flnhd Committee.
The developer shall install a solid acoustical barrier (masorny wall)
at the northerly perimeter of the site. The barrier shall be
configured to attain an effective 6 foot height above highest
adjoining grade at any point along its reach.
The developer may be required to install additional parking stalls
beyond the minimum number described on sheet 3 if the city determines
that additional parking is necessary. The determination shall be made
following a public hearing by the Planning Comaission and city
council, and based upon submittal of a report describing parking
deficiencies. If additional parking is required, said spaces shall be
installed within six (6) months of the close of the public hearing.
The developer shall install a chain barrier at the west end of the
service yawl behind the existing ommommirh structure for purposes of
limiting access to said area for delivery/service activity, and to
prevent thrmugh traffic access.
Delivery activity is restricted in acoordance with the Municipal Code.
The developer shall install trees on the north perimeter as
oos�ceptually indicated on Shest 3 except that trees are not required
in the service alley. 7ne applicant is required to install trees on
residential properties which adjoin the service alley is such trees

The subject use permit authorizes a maximum presence of 36,000 s.f. of
retail space, up to one third of which may be devoted to office use,
with restaurant occupancy limited according to demand for not more
than 27 parking spaces. ReSidential — is restricted in accordance
with Cbrriition 14 above.
Zhe applicant or subsequent applicant may submit a new use permit
request to consider additional development on the project site
including the area located west of the existing building.
Moe development plan shall be revised to indicate installation of wing
walls on the north elevation of the main commercial building to
encompass placement of trash containers for use of building tenants.
The Director of public Works shall review the northeast corner of the
site for the purpose of designing a better pedestrian access for
pedestrians entering the site from Mann Drive.

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOK4 ND1NG APPROVAL OF A USE PERMIT TO
EXPAND AN EXISTING RETAIL, COMPLEX TO INCLUDE 36,000 S.F.
OF OFFICE/RETAIL SPACE AND 12 DWELLING UNITS,
INCLUDING 4 UNITS OF AFFORDABLE HOUSING FOR SENIOR CITIZENS
SECTION I• FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrimental to existing uses or to
uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby recommended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 27-U-89 as set forth in the Minutes of the Planning
Commission Meeting of June 11, 1990, and are incorporated by reference as
though fully set forth herein.

1. STREET WIDENING
Street widening, improvements and dedications shall be provided in
accordance with City Standards and specifications and as required by the

The developer shall comply with the requirements of the Underground
Utilities Ordinance No. 331 and other related ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall submit detailed plans showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.

The property owner shall record a deed restriction on 4 dwelling units
reserving them for affordable rental occupancy by senior citizens
according to the terms of a supplemental agreement approved by the
City Council, and by the City Attorney prior to recordation. Said
supplemental agreement shall restrict occupancy of said units for a
minimum period of 20 years.
The remaining 8 units may divided for resale as condominium units at
the discretion of the developer or owner. There shall be at least one
(1) additional lot held in common ownership. The exact placement of
interior partitions may be modified subject to staff approval.
City participation in cost underwriting of improvements to accommodate
elderly residents, such as elevator installation, as well as waiver or
reduction of fees or other benefits, shall be approved by City Council

at the southerly and westerly perimeter of the site adjacent to the
oakdell Ranch subdivision. The barrier shall be configured to attain
an effective 6 foot height above highest adjoining grade at any point
along its reach.

beyond the minimum number described on sheet 3 if the City determines
that additional parking is necessary. The determination shall be made
following a public hearing by the Planning Commission and City

At their regular meeting of April 2, 1990, the Cupertino City Council
expressed support of Application 27-U-89 as submitted with the building on
the southeast corner possibly three stories with retail on the street
level and the upper stories used for senior citizen apartments. A
flexible parking plan will be omsidered if the building is three stories.
The city c= nr_il also determ ned that the owner or subsequent owners may
apply for a new use permit in the future to develop the westerly portion
of the site.
Council directed that the plan be referred to the Planning Commission and
that a report c1®e back within ninety (90) days.

This will confirm the action by the City council at their meeting of
February 20, 1990 at which the following actions were taken:
Directed Application 27-U-89 be brought back to Council at their March
19, 1990 meeting with two or three different conceptual plans (can be
very sketchy) that in essence are responsive to such concerns as
layout of the center. The layouts that should satisfy the problems
pointed out at this meeting, including pedestrian movement and safety,
autrjobile access by residents, possible removal of Monta Vista
Hardware building, and should contain more residential aryl less
commercial;
Requested information as to how much residential/commercial/retail you
would like the development to contain.

SEMON I • FINDINGS
WHEREAS, the Planning commission of the City of Cupertino received an
appl-ication for a Use Permit, as described on Page 2 of this Resolution;
and
VMZE fS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following req,irenpa ts:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrinen a to existing uses or to
uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the nneighborhood.
NOW, THEREFORE, BE IT PIMLV D:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby reooamp-nded for approval, subject to the conditions which are
emxnerated in this Resolution beginning on Page 2 thereof; and
That the suboonnclusions upon which the findings and ocrnditions specified
in this Resolution are based and contained in the Public Hearing record
Kerning Application 27-U-89 as set forth in the Minutes of the Planning
Ommi Gion Meeting of February 14, 1990, and are incorporated by reference
as though fully set forth herein.

1. STREET WIDINLTIG

accortianoe with City Standards and specifications and as required by the
City Engineer.

Curbs and gutters, sidewalks and related structures shall be installed in
accordance with grades and standards as specified by the City Engineer.
3. STREET ESGHrING INSTALLATION
Street lighting shall be installed and shall be as approved by the City
Enginneer. I&ghting fixtures shall be positioned so as to preclude glare and
other fares of visual interfe ence to adjoining properties, and shall be no
higher than the maximum height permitted by the zone in which the site is
located.
4. FIRE SAFETY
Developer shall fly with all fire safety requirements specified by the
City in omsultat:ion with the Cerntral Fire District.
5. STREET TREES
Street trees shall be planted within the Public Right of Way and shall be of
a type approved by the City in accordance with Ordinance 125.
6. GRADING
Grading shall be as approved and required by the City Engineer in accordance
with Ordinance 125. First floor finished floor elevation shall not exceed
24 inches above the highest top of curb elevation on the adjoining Stevens
Creek Blvd. frontage, unless the need for greater elevation is demonstrated
to the City Engineer for purposes of achieving proper site drainage or
resolving other technical constraints.
7. DRATbU,GE
Drainage shall be provided to the satisfaction of the City Engineer.

The developer shall comply with the requirements of the Underground
Utilities Ordinance No. 331 and other related Crdinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of under Txmd utility
devices. The developer small submit detailed plans showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.

The project developer shall enter into a development agreement with
the City of Cupertino providing for payment of fees, including but not
limited to cx-king and inspection fees, storm drain fees, park
dedication fees and fees for u' M of utilities. Said
agreement shall be executed prior to issuance of construction permits.
10. TRANSF3iS
Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping
or located underground such that said equipment is not visible from
public street areas.

The recommendation of approval is based on the sheets 0 through 9
dated 02/01/90 of Application 27-U-89, except as may be amended by the
Conditions contained in this Resolution. Further, the office floor
area above the main shopping center shall be deleted. The
architectural featires of the main shopping center building shall be
subject to ASAC approval.

The development rights to the Cowman Area shall be dedicated to the
City of Cupertino in advance of recordation of the final subdivision
map to ensure that open space area is available to the entire
development.
13. FTRE ACCESS IANES
Emergency fire aocess lames shall be recorded as fire lane easements
an the final map and shall meet Central Fire District standards.

condominium plan shall be approved by the Department of Planning and
Development and by the City Attorney prior to recordation.
