application for interpretation of Condition 21 of Use Permit 19-U-89; and
WHEREAS, the necessary public notices have been given in accordance with
the Procedural Ordinance of the City of Cupertino, and the Planning
Coamnission has held one or more Public Hearings on the subject
application; and

That after careful consideration of maps, facts, exhibits, testimony and

This will confirm the action by the City Council at their meeting of 1
November 20, 1989 at which the subject application was approved per the
following findings:
1. The proposed building colors and roofing materials are not coupatible
with surrounding developments. The approval is based upon the
submitted materials/color palette describing white, beige and tan
colors.
2. The proposed landscaping is acceptable with the exception of the
liquid ambar trees. Installation of public street frontage landscape
improvements shall be deferred until the core area landscaping
guidelines for Stevens Creek Boulevard are adopted.

Building Area: 6,435 sq. ft.
Lot Coverage: 24%
Due to the configuration of the building, the need to place display
racks against the walls is needed to create an adequate interior
circulation pattern and for adequate display of merchandise.

The property owner received approval in September, 1989 to construct a
6,500 square feet retail building. As the building nears ompletion,
the single tenant/lessee is seeking interpretation of Condition 21 as
it compares to their use display scheme and a request for a
minor modification to the Use Permit with regard to building material
replacement.
Condition 21 states:
"Window display of merchandise se on the Stelling and
Stevens Creek frontages shall be configured to avoid
obscuring views into the sales area from the public
sidewalk. T.emposary window signs on these frontages
shall not obscure more than 10% of the glazing area."

- Staff supported use of obscure spandrel glazing to hide rack
displays on the south and east elevations, as these areas are not
readily visible from Stevens creek Blvd. or Stalling Rd., and
reoanmended that spandrel sections on the north elevation oomply
with the 10% maximum obscurity requirement.
PLAN NIM CC14USSICN:
- The intent of the condition was to allow views into the business
from the roadway as well as the sidewalk. The Commission did not
support the minor modification requ6st regarding the use of
spandral glass, with the enmeation of the windows surrounding the
office on the south elevation. Zhe Ccam ssian indicated that the
use of merchandise display racks should not be placed against any
glazing area, including the south and east elevations.
