L : FINDINGS:
The Planning O mmnission finds as follows with regard to this application:
1. Zha proposed phasing plan will result in the hmiediate implementation
of the SCB Conceptual Zoning Plan.
2. The proposed work will inprove and enhance the property.
3. The fencing off of the undeveloped southerly portion of the property
will lessen the noise impact to the adjoining residential neighborhood.
1. Condition 25 of 8-U-88 is modified as follows:
The intention of the revised phasing plan is to cmplete public
streetscape improvements in the initial stages of the project.
Accordingly, the first phase shall excoapass the following and shall
reflect the revised exhibit labeled "Conceptual Grading Plan" dated
1/21/89.
- Installation of storm drains, curbs, gutters, sidewalk and walkways
around the Hamasushi Restaurant Building and SCB frontage.
- Relocation of two driveways on SCB.
- Installation of landscaping and irrigation along east and west
property lines and SCB frontage.
- Installation of a temporary chain link fence and gate between the
parking lot and undeveloped southerly portion of the property, to be
removed when phase two construction beings.

The external remodeling of the Hamasush{ Restaurant building and the
completion of the noise attenuation wall and perimeter landscaping may
be deferred until the new co mnercial/office building construction
beings (phase two).

Prior to issuance of a building permit for on -site improvements, a bowl
shall be secured to ensure completion of the landscaping in accordance
with the SCB Conceptual Zoning Plan. All landscaping shall be reviewed
and approved by the A.S.A.C.
3. Previous Conditions
All previous conditions pertaining to Application 8-U-88 not in
conflict with conditions contained herein shall remain in full form
and effect.

This letter is a follow-up to mine of November 8, 1993, which requires compliance with
Condition No. 27 of City Council Action letter dated November 2, 1988. This letter provided a 30 day
compliance date for recordation of said ingress/egrcss agreement. As agreed by Steven Hoffman in his
letter of December 6, 1993, the agreement would be recorded within 60 days (February 6, 1994). This
document was received on January 18, 1994, and comments were given and reviewed with Mr. Hoffman
on January 26, 1994. To date we have yet to receive the final recorded document and we are forced to
forward the revocation proceeding to City Council. As a final concession we will allow five working days
to receive the recorded document before the referral is forwarded to City Council. If 1 canbe of any

USE PERMIT
Requesting approval of the first phase development plan for a multi -tenant
retail complex, as required by condition 25 of Use Permit 8-U-88.
2) jQISCLISSION:
A. The applicant is preparing to begin some necessary repair work for the
existing parking lot on the subject property. Since the existing paving
will be removed, the applicant saw this as an appropriate time to begin
implementing the approved development plan for the site. A condition
of approval for 8-U-88 stipulates that the first phase shall include the
restaurant building remodel, and installation of perimeter landscaping
and noise attenuation walls.
B. The applicant proposes to complete the following work as phase one of
the project:
1. Installation of storm drains.
2. Relocation of two driveways on Stevens Creek
Boulevard and
installation of curbs and gutters.
3. Removal
of existing sidewalk and installation of new
sidewalk along
Stevens
Creek Boulevard frontage.
4. Removal
of pavement, grading and repaving and
restriping of
parking
area surrounding the restaurant.
5. Patching
and overlay (as needed) of a portion of the
parking lot to
the rear
of the restaurant.
6. Installation of new walkways around the existing restaurant and
connecting to the frontage sidewalk.
7. Installation of curbs, irrigation systems and landscaping along the
cast and west side property lines.
8. Installation of landscaping and irrigation system along Stevens
Creek Boulevard frontage.
9. Installation of a temporary chain link fence and gate to close off the
undeveloped southerly portion of the property (to be removed once
phase two is underway).
C. It is proposed that the remodeling of the Hamasushi restaurant building
and the installation of a masonry wall along the south property line be
done at the same time that the new building is constructed at the rear of
the property (phase two).
D. Phase two will include the demolition of the existing 6500 square foot
retail building (Blaney Center), construction of the new 28,000 square
foot retail/office building, the remodel of the restaurant building,
installation of the masonry wall and completion of parking lot
improvements and landscaping on the rear portion of the property.
E. Staff feels that it is a positive step that the Stevens Creek Boulevard
frontage improvements and landscaping will be implemented as a part
of the proposed first phase. From the applicant's perspective, it is more
cost effective to tic the construction of the new building and the
remodeling of the restaurant building together. Due to lease constraints
construction of the new building cannot take place for several years.
The installation of the masonry noise attenuation wall along the rear
property line could be deferred until such time that construction of the
new building begins since access to the southerly portion of the site
will be controlled by the temporary fence, and there will not be any
construction taking place at the rear of the property.
3. RECOMMENDATION
A. Staff recommends approval of the proposed phasing plan for
application 8-U-88 per the findings and conditions contained within the
model resolution.
B. The environmental review for this project was previously completed.
