6, 1988 at which your Application 3-U-88 was approved per the following

In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved develcpmennt plan, a written request or revised development

plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the changes are minor and do not
result in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the

If the Director finis that the requested changes are material, such
changes shall be referred to the Planning Commission for approval. If
the changes are denied by the Planning C =ussien, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.

as securing a paid driver and sufficient paying passengers to defray
the cost of acquiring and operating the vehicle.
17. PARK= - BUILDING 200
The Use Permit reduces parking for Buildings 200 and 55 resulting in
a deficiency fray current parking standards. By implementing this Use
Permit, applicant/property --r agrees to mitigate future parking
problems identified by the Cupertino Planning Commission or City
Council including but not limited to installing sufficient spaces to
meet the ordinance standard.

The applicant/property owner shall design the landscaping, parking,
access and driveway entrances to minimize potential on -site flooding
of existing and proposed structures. The final grading details shall
be subject to staff approval.
19. DEUELAPMENr PHASING
All site landscaping and parking improvements shall be installed prior
to occupancy of the recreation building. Creek channel improvements
and pedestrian overc ossi.rgs may be installed at the developer's
discretion.
20. WATERWAY CbNSITUCTI
Applicant agrees to indemnify, hold harmless, and defend City with
respect to any claim brought by any person resulting from personal
injury or property damage which may result applicant's operation and
maintenance of the waterway constructed in the creek channel as part
of this application.

parking lot for the Santa Clara Paris site. Additionally, the
applicant agrees to work with Valloo Park to attest to extend the
wall northerly along the rear yards of two adjacent homes. Said wall
shall be at least eight feet in height (as measured from highest
adjoining finished grade). Me masonry wall shall be faced with a
stucco finish subject to staff approval.
15. INGRESS/—EMESS FASEMEMS
11he applicant shall demonstrate that an appropriate deed restriction
and covenant running with the lard exists for all parcels which share
a common private drive or private roadway with one or more other
parcels.
16. APPROVED USES
Approved is granted to construct a 40,200 sq. ft. industrial office
building including a 10,500 sq. ft. anechoic chamber.
17. BICYCLE PAFKIrIG
The applicant shall install one secured bicycle locking device
(Bicycle Locker) for every 6,500 sq. ft. of building floor area.
Secured bicycle locking spaces required by this ooditicn may off -set
required vehicle parking spaces on a 1 for 1 basis.
18. TREE PFU—TE ION
The applicant shall provide a plan for preservation of the existing
specimen trees on the subject property. Said plan shall include
graphic depiction of protection devices to be installed along the
dripline perimeter of each tree for the duration of construction
activities. The plan shall include a written report from a consulting
arborist or landscape architect, whose selection shall be approved by
the Department of Planning and Development prior to preparation of the

report. said report shall detail measures to be taken to ensure the
survival of said specimens during and after construction. Trees along
the easterly property line which are no longer living shall be
replaced with 24 ft. box trees of a comparable variety.
The applicant or successor in interest shall record a covenant

The existing cooling tower shall be relocated to the south easterly
portion of this site, subject to staff approval.
The applicant shall install and/or repair the existing cyclone fence
along the park botrdary at a minimtmt height of 6 ft. subject to
approval by staff in consultation with the City of Santa Clara.
Exterior constnic'tion activity shall be limited to the hours of 8 a.m.
to 5 p.m., Monday through Friday. All other ccnstzucticn shall be
limited to the interior/enclosed portions of the building, conforming
to the Noise Ordinance requirements.

WHMEAS, the Planning Cou nission of the City of Cupertino received an
