Street widening, iuprovements and dedications shall be provided in
accordance with City standards and specifications and as required by
the City Engineer.

Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards as specified by the City
Engineer.
3. STREET LIGHIM C: INSTALLATION
Street lighting shall be installed and shall be as approved by the
City Enginser. Lighting fixtures shall be positioned so as to
preclude glare and other forms of visual interference to adjoining
properties, and shall be no higher than the maximum height permitted
by the zone in which the site is located.
4. FIRE HYC£tANT
Fire hydrants shall be located as required by the City.
5. TRAFFIC SI131S
Traffic control signs shall be placed at locations specified by the f
City.
6. MEEr TREES
Street trees shall be planted within the Public Riot of Way and shall
be of a type approved by the City in accordance with Ordinance 125.

Drainage shall be provided to the satisfaction of the City Engineer.
Surface flow across public sidewalks may be allowed in the R-1, R-2
and R-3 zanes unless storm drain facilities are deemed necessary by
the City Engineer. Development in all other zoning districts shall be
served by on site storm drainage facilities ccra*cted to the City
storm drainage system. if City storm drains are not available,
drainage facilities shall be installed to the satisfaction of the City
Engineer.
9. UHDEE�ROUND Z1TIlSiTES
The developer shall comply with the requirements of the Underground
Utilities Ordinance No. 331 and other related Ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of uundergruud utility
devices. The developer shall subnit detailed plans showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.
10. EEVELOR JEM AGREIIgNP
The project developer shall enter into a devalopment agreement with
the City of Cupertina providing for payment of fees, including but not
limited to checking and inspection fees, storm drain fees, park
dedication fees and fees for of utilities. Said
agreement shall be executed prior to issuance of construction permits.
11. BUS DUGIQ7fTt
The bus duckrut as shown on the approved edLibits shall be shifted to
the west of the main driveway. The former duckcut space shall be usedi
for a deceleration lane. Duck art design shall be approved by the

City and the Santa Clara County Transit District. Applicant shall
install a concrete pad as required by the Santa Clara County Transit
District. Applicant is not responsible for installation of a bats stop
shelter. Applicant shall provide a pedestrian easement over the pad
area prior to issuance of building permits.

The reounendation of approval is based on Ddzibits A, A-1, A-2, B-1,
B-2, C, F-1 and Crl of Application 46-U-87, except as may be amended
by the Conditions contained in this Resolution.
13. SIMS:
The signs shown in the approved exhibits are rxrt approved under this
application. Applicant shall file the appropriate sign program
application with the architectural and site Approval Committee for
approval of signs.
14. MINIMLIK SETBACK:
The new retail center structure shall be setback a minimum of
twenty-five feet from the Stevens Creek Boulevard curbline as required
by the Stevens Creek Boulevard conceptual Zoning Plan.
15. LANDSCAPE PLAN:
The final landscape plan shall be submitted to the Architectural and
site Approval Ca mittee for formal approval prior to occupancy of the
new retail center.
The Ocmnittee shall review the landscape and sidewalk design for the
Stevens Creek Boulevard frontage. The review shall eaphasize tree
plantings and shall determine an appropriate strestscape standard
which can be applied to the entire Crossroads area.
The Cc mittee shall examine the landscape treatment on the east side
of the retail center to ensure that the landscaping will provide an
effective vegetative screen of the east elevation when viewed from
Bandley Drive.
the landscape area adjacent to a bus stop pad or enclosure shall be
adjusted to maintain an width of approximately seven feet. The
adjustment shall be shown on the final landscape plan.
16. APPROVED USES:
Permitted uses may include all uses allowed without the securing of a
Use Permit in the City of Cupertino oG (General Ccmm=ial) zoning
district.
In the 13,000 square foot retail center, restaurant and food service
uses including ice-cram stores, yogurt shops, and delicatessens may
be approved by the Plary ing Director subject to the following
findings:
1. Sufficient parking exists to acoomedate the use
2. The total area of food service uses does not exceed 25t of the
gross floor area of the retail center.
3. The use does not include entertairmerut or a separate bar.
4. The hours are limited to 7 AM to 11 PM.
5. The use is of a type which will fly with the findings of the
I= Associates traffic study dated January 25, 1988.
The Planning Director may forward a potential restaurant or food
service tenant to the Planning Commission for an interpretation of
consistency with the aforementioned findings. Should the Planning
Director withhold approval of a potential restaurant or food service
tenant, the tenant may appeal the decision of the Planning Director to
the Plarmirg commission. The decision of the Planning Commission may
be appealed to the City Council as provided in Ordinance No, 652. All
uses not discussed above shall require a use permit.
The Plarming Cx—issicn reserves the authority to review and charge
the approved uses should problems relating to parking, noise, haul of
operation, or traffic arise in the future.
17. NOISEMAKU,* DEVICES'
No public address system or paging system. Powered megaphone or
similar noisemaking device small be permitted outdoors at anytime.
18. TRASH ENCLIMW:
Applicant shall provide a trash enclosure for the retail center. The
location of the enclosure shall be approved by staff prior to issuance
of building permits. The enclosure shall be screened from public
view.
19. CCkUMaANCE WITH CONDITZCNS
Applicant shall record a covenant running with the lard, in a form
approved by the City Attorney, which shall obligate the owner of
owners of all lard subject to this use permit to amply with the
om-iditicns contained herein.
20. REVIEV:
The applicant shall modify the eastern elevation of the retail center'
to provide additional architectural interest. The modifications shall
be formally reviewed by the Architectural and Site Approval Committee
and approved by the City Council prior to issuance of building
permits.
21. HE-09MCAL EQ IPMENf'
No mechanical equipment shall be visible to the public above the
parapet of the retail center.
The expiration date of the use permit is April 4, 1990 (Section 6.4 of
Ordinance No. 652 as revised by Ordinance No. 1136).

WHEREAS, the Planning C=nissicn of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;

WHEREAS, the applicant has met the burden of proof required to support

1) The proposed landscaping design will enhance the vlaual and aesthetic
characteristics of the site.
2) The landscaping approval is in partial conformance with City Council
action for 46-U-87 dated April 11, 1988. Approval of the Stevens
Creek Boulevard streetscape design will be required when a streetscape
study has been completed by Staff.
3) The landscape design conforms to the Xeriscape GLlidelines.
CONDITIONS:
